OTHER BUSINESS C.1. Chapter 30 Amendment Regarding NC, Neighborhood Commercial District Mr. Shrimplin presented a proposed amendment to Section 30-64 (NC, Neighborhood Commercial District) of the Zoning Code (Chapter 30 of the City's Code of Ordinances). He explained that he was recently contacted by someone who was interested in operating a martial arts school on an NC-zoned property. This use falls under "school and studios for art, dancing, drama, music, photography, interior decorating or similar courses of study" in the NC district, which requires a special use permit. Staff did not feel that schools and studios for specialized disciplines should require a special use permit when uses having a greater potential to impact surrounding properties, such as restaurants and bars, were permitted by right. This prompted staff to prepare the amendment. Mr. Shrimplin then gave an overview of the changes, as follows: • The permitted principal uses list is being expanded to include other uses that are appropriate for this type of district (including instructional schools for art, dance, music, martial arts, or other disciplines, which is being moved from the special uses list). • "Drive-in or drive-through facilities" is being added to the special uses list. • The list of uses exempted from the requirement that all activities and permitted uses be conducted indoors is being expanded. • The architectural compatibility language is being replaced with new language that is more specific but also gives the City flexibility in cases where the proposed building design does not adhere to the standards but is nonetheless compatible. • The maximum building height is being increased to match that of the R-1, Single- Family Suburban Residential District. • The minimum setback and open space requirements are being revised to match those of the C-1, General Commercial District. • The parking regulations subsection is being replaced with a general provision stating that all development projects are subject to the City's development requirements. He stated that the amendment also includes some minor changes for clarification purposes. Mr. Chris Martin asked how deviations from the architectural design standards would be handled. Mr. Shrimplin stated that staff would handle deviations for permitted uses and the City Council would handle deviations for special uses. The standards are intended to provide for compatibility with the general architectural character of the surrounding buildings. However, there may be cases where the proposed design is compatible withoutadhering to City of Cape Girardeau Planning & Zoning Commission Meeting Minutes September 9, 2026 Page 3 of 3 the standards . For example, a one-story building with an all-brick exterior may not need to have at least two exterior wall materials on each elevation to be compatible . A motion was made by Mr. Jackson and seconded by Mr. Chris Martin to recommend approval of the amendment as submitted. The motion passed unanimously .
