Staff: Ryan Shrimplin, City Planner Agenda: July 20, 2026 AGENDA REPORT Cape Girardeau City Council TITLE BILL NO. 26-56, an Ordinance approving the record plat of Brick & Ivy Second Subdivision. Second and Third Readings. SUMMARY A record plat has been submitted for Brick & Ivy Second Subdivision, located at 539 Olive Street. The proposed subdivision is zoned R-5, High Density Multifamily Residential. The plat combines three lots along with a portion of a vacated alley and the vacated North Frederick Street right-of-way between Olive Street and Mason Street to create one new lot. The plat shows an exception for the omission of the required 10-foot utility easement along the rear lot line. Staff supports the exception because there are no existing or proposed utility main or primary lines in the area where the easement is required. STAFF RECOMMENDATION The staff report to the Planning & Zoning Commission recommended approval of the record plat. BOARD OR COMMISSION RECOMMENDATION The Planning & Zoning Commission, at its March 11, 2026 meeting, recommended approval of the record plat by a vote of 7 in favor, 0 in opposition, and 1 abstaining. Boundary adjustment plats do not go through the subdivision plat process. Instead, they are reviewed by staff only and, if approved, staff submits the plat prints to the County Recorder of Deeds Office for recording. A boundary adjustment plat cannot change the number of lots, reduce existing lots below the required minimum size, or change easement or utility lines. Applicants who are unsure of which type of plat they need to submit or have other questions should contact: City of Cape Girardeau Planning Services Division 44 North Lorimier Street Cape Girardeau, MO 63701 (573)339-6327 cityplanning@cityofcape.org For preliminary plats and record plats, the application deadline is four (4) weeks prior to the Planning and Zoning Commission meeting date. The Commission meets monthly on the second Wednesday. Applications must be delivered to the Planning Services Division using the above contact information. City staff will review each application for completeness. If required information and/or items are missing, then the applicant will be contacted. Incomplete applications will not be reviewed until the requested information and/or items are provided. Once an application has been deemed complete, it will be placed on the next Planning and Zoning Commission agenda. Staff will review the plat for compliance with the subdivision plat requirements (see attached) as well as the City’s zoning and subdivision regulations. If a resubmission is necessary, then a staff review letter will be prepared and sent to the applicant. The resubmission and review process continues until all staff comments have been successfully addressed and the plat is in its final form. A staff report will be prepared and delivered to the Planning and Zoning Commission one (1) week prior to the meeting. The staff report, along with the meeting agenda, will also be delivered to the applicant. The staff report will contain one of the following recommendations: a) approval of the plat; b) approval of the plat, subject to staff’s comments being successfully addressed; c) denial of the plat; or d) action on the plat be tabled (postponed). If the plat is not in its final form by this time, then the staff report will recommend b, c, or d. At the meeting, the Planning and Zoning Commission will review the plat and make a recommendation to the City Council. The applicant or their representative must attend the meeting to answer any questions regarding the plat. A plat must be in its final form in order to be reviewed by the City Council. It is the applicant’s responsibility to stay informed as to the status of the plat and to address any issues affecting the review schedule. Once staff has determined that a plat is in its final form, the applicant will be notified to submit the requisite number of prints. Each print must be signed and sealed by the professional surveyor and, in the case of a record plat, contain the notarized signature of each Property Owner of Record. The deadline for submitting prints is one (1) week prior to the Council meeting. If the subdivision created by the plat involves new public improvements (such as water or sanitary sewer mains, streets, street lights, sidewalks, etc.), then those improvements must be completed and/or covered under a performance guarantee agreement in accordance with the City’s Code of Ordinances before the City Council reviews the plat. The City Council will vote on a motion to approve the plat. Preliminary plats are approved by motion and do not go on to the next Council meeting. Record plats are approved by ordinance and must receive approval of the first reading at one meeting and approval of the second and third readings at the next meeting. If approved, the plat prints will be signed by the City Clerk, who will also affix the City seal to them. For a preliminary plat, the developer may then proceed with the submission of the record plat for the first phase of the subdivision. For a record plat, the City Clerk will wait until the mandatory ten (10) day waiting period for ordinances has passed before signing and sealing the prints. Staff will then submit the plat prints to the County Recorder of Deeds Office for recording. Staff will notify the applicant when their copy of the recorded plat is ready for pick-up. For questions, please contact the Planning Services Division at (573) 339-6327 or cityplanning@cityofcape.org. Second and Third Readings. SUMMARY A record plat has been submitted for CPC Subdivision, located on South Farrar Drive. The proposed subdivision is zoned C-2 (Highway Commercial). The plat subdivides a tract to create two new lots. The plat shows an exception for the omission of the required 10-foot utility easement along the rear lot lines of both lots. STAFF RECOMMENDATION The staff report to the Planning & Zoning Commission recommended approval of the record plat. BOARD OR COMMISSION RECOMMENDATION The Planning & Zoning Commission, at its May 13, 2026 meeting, recommended approval of the record plat by a vote of 8 in favor, 0 in opposition, and 0 abstaining. Second and Third Readings. SUMMARY A record plat has been submitted for Knight Subdivision, located at 306, 308, 406, and 450 North Main Street. The proposed subdivision is zoned CBD (Central Business District). The plat resubdivides several tracts to create two new lots. The plat shows an exception for the omission of the required 10- foot utility easement along the rear lot lines of both lots. Staff supports the exception because there are no existing or proposed utility main or primary lines in the area where the easement is required. STAFF RECOMMENDATION The staff report to the Planning & Zoning Commission recommended approval of the record plat. BOARD OR COMMISSION RECOMMENDATION The Planning & Zoning Commission, at its May 13, 2026 meeting, recommended approval of the record plat by a vote of 8 in favor, 0 in opposition, and 0 abstaining. First Reading. DEV - Trevor Pulley SUMMARY In the early 1970’s, a new construction restaurant, Long John Silver’s, built a private sewer line extension running to the north to connect to an existing City sewer main at the intersection with Independence Street. As additional restaurants were constructed south of the Long John Silver’s site, these business all also tied into that private sewer line sharing the expense of the private sewer line maintenance. In 2026, three (3) of the current restaurant property owners on the private sewer line asked the City to take over part of the private sewer line thereby making it a public sewer main. These property owners paid for the private line to be rehabbed and upgraded the condition of the sewer line to meet currents standards. The rehabbed sewer main was inspected and meets City Specs for acceptance as City owned infrastructure. In order to accept this sewer line as public, new easements need to be granted to cover the sewer line that will become public. The three (3) property owners that are granting the new permanent sanitary sewer easements are: Monte Cristo IV, LLC for 25 South Kingshighway; Narvol & Amy Randol for 35 South Kingshighway; and RJ Development, LLC for 31 South Kingshighway. FINANCIAL IMPACT None. The Easements were donated by the property owners. The owners will pay for the cost of recording the easement documents. SUSTAINABILITY: ECONOMIC, ENVIRONMENTAL AND SOCIAL IMPACTS The Easements are necessary to enable the City, its agents, servants and assigns, to use said property to excavate, built, maintain, construct, operate, and repair the sanitary sewer infrastructure in, on, upon, or across said property, together with all the useful, necessary and proper adjuncts, appurtenances, and appliances in connection therewith. STAFF RECOMMENDATION Staff recommends approval of the attached Ordinance accepting Permanent Sanitary Sewer Easements from Monte Cristo IV, LLC for 25 South Kingshighway; Narvol & Amy Randol for 35 South Kingshighway; and RJ Development, LLC for 31 South Kingshighway. APPROVAL OF MINUTES A motion was made by Mr. Bertrand and seconded by Mr. Blank to approve the minutes of the May 13, 2026 meeting as submitted. The motion passed by a unanimous vote. A. REZONINGS, SPECIAL USE PERMITS, AND EXCEPTIONS A.1. A public hearing was scheduled on the request of Robinson Outdoor, LLC for a special use permit for the purposes of constructing, maintaining, and operating a billboard on property located at 53 Doctors Park Drive, zoned C-1 (General Commercial District). Staff presented the Commission with opposition letters received from D. Shawn Parker, MD, and Gregg S. Hallman, MD. Mr. Shrimplin stated that the letters were shared with the applicant, who then requested that the Commission table the request to the July 8, 2026 meeting to allow time for the applicant to meet with the Doctors Park Covenant Board. A motion was made by Mr. Bertrand and seconded by Mr. Hagedorn to table the special use permit request. The motion passed by a roll call vote of 8 in favor, 0 in opposition, and 0 abstaining (Aye: Bertrand, Blank, Hagedorn, Jackson, Jones, N. Martin, McElreath, Patterson). A.2. A public hearing was held on the request of Miller Mini Storage LLC for an exception from Development Code Section 25-161(a), fence height and surface requirements, for property located at 1200 South West End Boulevard. Ms. Rachel Elliott, Klingner & Associates, presented the request. She explained that the property is proposed to be developed for a self-storage facility. The owner would like a 6-foot tall chain link fence in the front yard to provide better security and to match the height of the fence in the rear and side yards. The fence would have a black vinyl or powder-coated finish. City of Cape Girardeau Planning & Zoning Commission Meeting Minutes June 10, 2026 Page 2 of 4 Chairman Nick Martin opened the public hearing. Seeing no appearances to speak, he closed the public hearing. A staff report was submitted to the Commission, which contained the following findings of fact: Criterion #1: As part of the exception request, a “substantial equivalent” is proposed. “Substantial equivalent” means an alternate design, method, or feature that accomplishes the same purpose as the applicable Development Code requirement, or results in a significant public benefit. Finding: The purpose of the requirement is to prevent privacy fences and galvanized chain link fences in the front yards of commercial properties. The proposed chain link fence has a decorative finish as opposed to a galvanized finish. As long as it does not contain slats, a fabric cover, or other screening element, it will meet the 50% open surface requirement and thus will not be a privacy fence. Criterion #2: Approval of the exception request is consistent with the general spirit and intent of the Development Code. Finding: The substantial equivalent proposed by the applicant ensures fairness among property owners and tenants, which makes approval of the exception request consistent with the general spirit and intent of the Development Code. Based on the above findings, staff recommended approval of the exception request, subject to the following condition: 1. The portion of the fence in the front yard shall not contain slats, a fabric cover, or other screening element. This requirement shall not apply to the portion of the fence along the north property line that is being used to meet the bufferyard requirements in Section 25-224 of the City Code. A motion was made by Mr. Jackson and seconded by Ms. McElreath to approve the exception request, subject to the condition in the staff report. The motion passed by a roll call vote of 8 in favor, 0 in opposition, and 0 abstaining (Aye: Bertrand, Blank, Hagedorn, Jackson, Jones, N. Martin, McElreath, Patterson). A.3. A public hearing was held on the request of St. Vincent De Paul Church for an exception from Development Code Section 25-223(b)(1), parking lot landscaping requirements, for property located at 1912 Ritter Drive. Mr. Sumner Sparkman, Bowen Engineering & Surveying, presented the request. He explained that the request is for approval of a reduced parking lot interior landscaping percentage (10% vs. 15% required) in exchange for providing more plant types and quantities than what is required by the code. Chairman Nick Martin opened the public hearing. City of Cape Girardeau Planning & Zoning Commission Meeting Minutes June 10, 2026 Page 3 of 4 Finding: The purpose of the requirement is to break up the expanse of pavement in parking lots and to provide a balance between the built and natural environments. Landscaping areas make sites more attractive, and they can be designed to incorporate stormwater management features. The Development Code requires parking lot interior landscaping areas to be completely covered with at least one of the groundcover types in Section 25-225(1) and contain at least one of the plant types in Section 25-225(2) through (6). In exchange for approval of a reduced parking lot interior landscaping percentage, the applicant is proposing to provide more plants and plant types than what is required by the Code. This constitutes a substantial equivalent because the applicant is upgrading the landscaping in terms of the plantings while still providing enough landscaping area to break up the pavement area. The final design of the parking lot landscaping shall be subject to approval by the City staff. A motion was made by Mr. Jackson and seconded by Mr. Patterson to approve the exception request, subject to the condition in the staff report.
