Call to Order
Chairman Blank called the meeting to order at 5:30 p.m. He welcomed Mr. Hagedorn to the
Commission. Mr. Hagedorn briefly introduced himself.
Approval of Minutes
A motion was made by Mr. Jackson and seconded by Mr. Nick Martin to approve the minutes of
the October 8, 2025 meeting as submitted. The motion passed by a unanimous vote.
REZONINGS, SPECIAL USE PERMITS, AND EXCEPTIONS
1. A public hearing was held on the request of Majeed Investment Group, LLC to rezone property
located at 825 South Ellis Street from NC (Neighborhood Commercial District) to R-3 (High
Density Single-Family Residential District). Mr. Guard recused himself from the discussion
and vote due to a financial conflict of interest. Ms. Toni Majeed presented the request. She
explained that the property was previously zoned R-3. It was rezoned to NC a few years ago
to allow a commercial day care. The day care has now closed, so she and her husband would
like to rezone the property back to R-3.
Chairman Blank opened the public hearing. Seeing no appearances to speak, he closed the
public hearing. A staff report was submitted to the Commission, which recommended
approval of the rezoning request. A motion was made by Mr. Bertrand and seconded by Ms.
McElreath to recommend approval of the rezoning request. The motion passed by a roll call
vote of 7 in favor, 0 in opposition, and 1 abstaining (Aye: Bertrand, Blank, Hagedorn, Jackson,
Jones, N. Martin, McElreath; Abstain: Guard).
2. A public hearing was held on the request of Brent and Alexandra Chaney for an exception
from Development Code Section 25-161(a), fence height and surface requirements, for
property located at 3551 Hopper Road. Mr. and Mrs. Chaney presented the request. They
stated that they would like to install a 4-foot high ornamental aluminum fence in the front yard
to protect their young daughter from the Hopper Road traffic while playing in the yard.

Meeting Minutes
November 12, 2025
Chairman Blank opened the public hearing. Seeing no appearances to speak, he closed the
public hearing. A staff report was submitted to the Commission, which contained the following
findings of fact:
Criterion #1: As part of the exception request, a “substantial equivalent” is proposed.
“Substantial equivalent” means an alternate design, method or feature that accomplishes the
same purpose as the applicable Development Code requirement.
Finding: The purpose of the requirement is to limit fence height to what is reasonable
and necessary for the use of the property. Excessively high fences can adversely
affect the character of the neighborhood. The proposed fence will not adversely affect
the character of the neighborhood because it has a reasonable height, a decorative
appearance, and a mostly open surface. This qualifies as a substantial equivalent.
Criterion #2: Approval of the exception request is consistent with the general spirit and intent
of the Development Code.
Finding: The substantial equivalent proposed by the applicant ensures fairness
among property owners and tenants, which makes approval of the exception request
consistent with the general spirit and intent of the Development Code.
Based on the above findings, staff recommended approval of the exception request.
A motion was made by Mr. Guard and seconded by Mr. Bertrand to approve the exception
request. The motion passed by a roll call vote of 8 in favor, 0 in opposition, and 0 abstaining
(Aye: Bertrand, Blank, Guard, Hagedorn, Jackson, Jones, N. Martin, McElreath).
SUBDIVISION PLATS
3. The record plat of Stone and Story Subdivision was reviewed by the Commission. Mr. Guard
recused himself from the discussion and vote due to a financial conflict of interest. Mr. Ryan
Brase, Bowen Engineering & Surveying, presented the request. He stated that the plat divides
a large parcel on Old Sprigg Street Road into two lots. A staff report was submitted to the
Commission, which recommended approval of the record plat, subject to staff’s comments
being successfully addressed. A motion was made by Mr. Jackson and seconded by Mr.
Jones to recommend approval of the record plat, subject to staff’s comments being
successfully addressed. The motion passed by a roll call vote of 7 in favor, 0 in opposition,
and 1 abstaining (Aye: Bertrand, Blank, Hagedorn, Jackson, Jones, N. Martin, McElreath;
Abstain: Guard).
4. The record plat of Country Place 2nd Subdivision was reviewed by the Commission. Mr. Ryan
Brase, Bowen Engineering & Surveying, presented the request. He stated that the plat
resubdivides two lots on Country Lane to create three new lots. A staff report was submitted
to the Commission, which recommended approval of the record plat, subject to staff’s
comments being successfully addressed. A motion was made by Mr. Guard and seconded
by Mr. Hagedorn to recommend approval of the record plat, subject to staff’s comments being
successfully addressed. The motion passed by a roll call vote of 8 in favor, 0 in opposition,
and 0 abstaining (Aye: Bertrand, Blank, Guard, Hagedorn, Jackson, Jones, N. Martin,

STAFF REPORT
TO: Planning & Zoning Commission
FROM: Ryan Shrimplin, City Planner
MEETING DATE: December 10, 2025
SUBJECT: Zoning of Property upon Annexation – Property Adjacent to Airport
On December 1, 2025, the City Council acknowledged receipt of an annexation petition
for property adjacent to the Cape Girardeau Regional Airport. As part of the annexation
process, the Planning & Zoning Commission is charged with making a recommendation
to the City Council regarding how the property should be zoned upon annexation.
The adjacent airport property is zoned A-1 (Airport District). The other adjacent
properties are outside the city limits and are not zoned. This area is characterized by
agricultural, airport, and industrial uses. The Cape Vision 2040 Comprehensive Plan’s
Future Land Use Map shows the subject property as Airport.
In considering a zoning district for a property to be annexed, the Planning & Zoning
Commission and the City Council must determine if the proposed zoning district is
reasonable and in reasonable conformity with the existing uses and value of the
immediately surrounding properties. The City is installing a perimeter/security fence
around the Cape Girardeau Regional Airport. In two areas, the fence cannot be
installed on the existing airport property because the fence would infringe on the
Runway Obstacle-Free Zone (OFZ) under FAR Part 77 which establishes standards
and notification requirements for objects affecting navigable airspace. The City recently
acquired two tracts to allow the fence to be installed outside of the OFZ. These tracts
comprise the property for which the annexation petition was submitted. The property
will be incorporated into the airport facility; therefore, zoning it as A-1 (Airport District)
upon annexation is reasonable and in reasonable conformity with the existing uses and
value of the immediately surrounding properties.
Based on the above findings, staff recommends zoning the property as A-1 (Airport
District) upon annexation.

STAFF REPORT
TO: Planning & Zoning Commission
FROM: Ryan Shrimplin, City Planner
MEETING DATE: December 10, 2025
SUBJECT: Exception Request for Property at 1933 Rust Avenue
An exception application has been submitted for the property at 1933 Rust Avenue,
which is zoned M-1 (Light Manufacturing/Industrial). The applicant is requesting an
exception from the following section of the Development Code (Chapter 25 of the City’s
Code of Ordinances):
Section 25-49(c)
Improvement of parking
areas
Requirement
In manufacturing zoning
districts, access
driveways (minimum of
75 feet from the property
line) and vehicle parking
and maneuvering areas
in front yards must be
paved
Request
Approval of an unpaved
temporary driveway and
parking area with a
gravel surface
The Development Code authorizes the Planning & Zoning Commission to grant
exceptions in accordance with Section 25-12(b). In order for an exception request to be
approved, the Planning & Zoning Commission must consider and make findings of fact
with regard to certain criteria. Staff has reviewed the criteria and made the following
determinations:
Criterion #1: As part of the exception request, a “substantial equivalent” is proposed.
“Substantial equivalent” means an alternate design, method or feature that
accomplishes the same purpose as the applicable Development Code requirement.
Finding: The purpose of the code requirement is to promote high-quality
development through the use of paved surfaces, which, unlike gravel, do not
become displaced and scattered by vehicles, storms, etc. Gravel from driveways
can end up in the street and eventually enter the storm sewer system, where it
can accumulate and restrict the flow of stormwater. The application indicates
44 North Lorimier Street Cape Girardeau, MO 63701 (573) 339-6327
cityofcape.org
that the proposed gravel driveway and parking area are temporary improvements
to allow the property to be used as a training facility for a truck driving school until
such time as the property is developed for the owner’s use. Because the gravel
surface is intended to be temporary, staff believes that a substantial equivalent
can be achieved if certain conditions are imposed as part of the approval of the
exception request. The conditions are listed in the staff recommendation below.
Criterion #2: Approval of the exception request is consistent with the general spirit and
intent of the Development Code.
Finding: The substantial equivalent ensures fairness among property owners and
tenants, which makes approval of the exception request consistent with the
general spirit and intent of the Development Code.
Based on the above findings, staff recommends approval of the exception request,
subject to the following conditions:
1. The applicant shall maintain the gravel surface at all times and ensure that any
gravel and debris in the street adjacent to the property is removed in a timely
manner.
2. The applicant shall obtain a driveway permit from the City and construct a 10 -foot
wide paved driveway in the right-of-way in accordance with City specifications.
3. The applicant shall comply with the City’s stormwater management regulations
including, but not limited to, obtaining approval of a stormwater management
plan.
4. This exception shall expire two (2) years from the date of approval or at such
time as permanent improvements are made to the property, whichever comes
first.

RE: Strawberry Fields Subdivision Phase 1 Record Plat
Dear Mr. Moss:
City staff has completed its review of the above plat. During the review, the following items
were found which need correction or attention:
Reviewer #1 Comments – Ryan Shrimplin, City Planner (573) 339-6327; rshrimplin@cityofcape.org
1. On both sheets, in the description beneath the plat title, add a comma after “MERIDIAN”.
2. On both sheets, in the Property Owner box by the title block, change “DEED NUMBER” to
“DOCUMENT NUMBER” or “DOC. NO.”
3. Make the following revisions to the legend:
Add “(FOUND)” or “(SET)” after “IRON PIPE”.
Add “(FOUND)” or “(SET)” after “T-POST”.

do not add up to the 222.76 feet shown on the Lot 3 side of this line. The 100.66 may be
incorrect.
31. The distances of the straight sections of the west lot lines of Lots 2 through 6 do not add up to
the 375.47 feet shown on the other side of this line. It appears to be a rounding error.
32. Move the C16 and C22 labels out to the right-of-way. Add leader arrows, if necessary.
33. Add crows feet to separate the C17-C16-C15 curve and the C30-C16-C31 curve.
34. Add crows feet to separate the C21-C22-C23 curve and the C30-C22-C29 curve.
35. Add crows feet to separate C31 from the straight line having a bearing of S0°35’45”E and a
distance of 223.17 feet.
36. Add crows feet at both ends of the straight lines along Hanna Drive to separate them from the
curves.
37. On Lot 2, the new public utility easement and private drainage easement widens to cover a
proposed fire hydrant. There are additional fire hydrants proposed that do not have the extra
easement width (Lots 6, 10, and 15). Refer to the improvement plans for location details.
Provide a widened easement in these areas.
38. The improvement plans show a new sanitary sewer main running along and very near the lot
line between Lots 5 and 7. Add a new 5-foot public utility easement and private drainage
easement along the south lot line of Lot 5.
39. The improvement plans show a new stormwater line running along and very near the lot line
between Lots 12 and 13. Add a new 20-foot public utility easement and private drainage
easement, centered over the line.
40. The improvement plans show a new stormwater line running along and very near the lot line
between Lots 18 and 19. Add a new 15-foot public utility easement and private drainage
easement along the north lot line of Lot 18.
41. Please contact me to discuss the “FO” line shown on Lot 25 on the improvement plans.
Please make the necessary corrections and email a PDF file of the corrected plat to
cityplanning@cityofcape.org by December 9, 2025. Once the PDF file is received, staff will review it
to verify that all of the comments have been successfully addressed. If the PDF file is not received by
December 9, 2025, then the Planning and Zoning Commission may postpone taking action on the plat
or recommend approval, subject to staff’s comments being successfully addressed. All staff
