Call to Order
Chairman Blank called the meeting to order at 5:30 p.m.
Approval of Minutes
A motion was made by Mr. Chris Martin and seconded by Mr. Greaser to approve the minutes of
the September 10, 2025 meeting as submitted. The motion passed by a unanimous vote.
REZONINGS SPECIAL USE PERMITS AND EXCEPTIONS
1. A public hearing was held on the request of the City of Cape Girardeau to rezone property
located at 121 South Sprigg Street from CBD (Central Business District) and DCC (Downtown
Commercial Corridor Overlay District) to C-2 (Highway Commercial District). Mr. Shrimplin
presented the request on behalf of the City. He explained that the property was developed in
the 1970s. It was most recently occupied by Save A Lot, which closed earlier in the year. The
property is on the market, and he has been contacted by several realtors who inquired about
the zoning and the allowable uses. The inquiries prompted him to meet with the City Attorney,
Greg Young, to assess the appropriateness of the CBD -DCC zoning for the property. They
concluded that, other than location, the characteristics of the property are more typical of C-2
zoned properties, thus making it more appropriate for C-2 uses. They noted that an adjacent
property to the west is zoned C-2, as are other properties further west on William Street. He
then contacted the property owner, who was in support of the rezoning. Mr. Greaser, noting
that the building had been divided into two tenant spaces, asked if the rezoning request covers
the entire building. Mr. Shrimplin stated that the request covers the entire building as well as
the rest of the parcel. He stated that Tina McMahon with McMahon Properties, LLC, owner
of 108 and 110 South Sprigg Street, called him to express her support for the rezoning
request.
Chairman Blank opened the public hearing. Seeing no appearances to speak, he closed the
public hearing. A staff report was submitted to the Commission, which recommended
approval of the rezoning request. A motion was made by Mr. Greaser and seconded by Mr.
Nick Martin to recommend approval of the rezoning request. The motion passed by a roll call
vote of 9 in favor, 0 in opposition, and 0 abstaining (Aye: Bertrand, Blank, Greaser, Guard,
Jackson, Jones, C. Martin, N. Martin, McElreath).

2. The record plat of Presley's Addition was reviewed by the Commission. Ms. Leslie Morrow,
the applicant, presented the request. She explained that her husband applied for a special
use permit for a vehicle tire sales, service and repair facility on the property, which was
reviewed by the Commission last month and is pending approval by the City Council. When
she met with Mr. Shrimplin to discuss the application, he informed her that the property
consists of three tracts and that they would need to submit a record plat to combine the tracts
into a single lot to ensure that the parking and other accessory uses are located on the same
lot as the building. A staff report was submitted to the Commission, which recommended
approval of the record plat, subject to staff's comments being successfully addressed. A
motion was made by Mr. Bertrand and seconded by Mr. Chris Martin to recommend approval
of the record plat, subject to staff's comments being successfully addressed. The motion
passed by a roll call vote of 9 in favor, 0 in opposition, and 0 abstaining (Aye: Bertrand, Blank,
Greaser, Guard, Jackson, Jones, C. Martin, N. Martin, McElreath).
I The record plat of Capaha Place Subdivision was reviewed by the Commission. Mr. Jones
recused himself from the discussion and vote due to a financial conflict of interest. Mr. Chris
Koehler, Koehler Engineering & Land Surveying, presented the request on behalf of the
applicant. He explained that the property is an undeveloped tract that is proposed to be
subdivided into 11 townhouse lots and one lot for access, stormwater detention, and open
space. Mr. Nick Martin asked how the units would be accessed. Mr. Koehler stated that each
unit would have a driveway connecting to the adjacent street. He added that there are no
plans to extend the existing private drive connecting to Penny Avenue. A staff report was
submitted to the Commission, which recommended approval of the record plat, subject to
staff's comments being successfully addressed. A motion was made by Mr. Bertrand and
seconded by Mr. Guard to recommend approval of the record plat, subject to staff's comments
being successfully addressed. The motion passed by a roll call vote of 8 in favor, 0 in
opposition, and 1 abstaining (Aye: Bertrand, Blank, Greaser, Guard, Jackson, C. Martin, N.
Martin, McElreath; Abstain: Jones).
OTHER ITEMS AND COMMUNICATION
4. Chapter 25 Amendment Regarding Number and Spacing of Driveways
Mr. Shrimplin presented a proposed amendment to Section 25-250, Number and Spacing of
Driveways; Multifamily Residential and Nonresidential Uses, of the Development Code
(Chapter 25 of the City's Code of Ordinances). He stated that, currently, this section limits
multifamily residential and nonresidential uses to one driveway for each full 150 -foot section
of lot frontage along an arterial street or each full 75 -foot section of lot frontage along a
collector or local street. The amendment adds a provision allowing, for nonresidential uses,
one additional driveway for each full 150 -foot or 75 -foot section of lot frontage (depending on
the street classification) if each of the driveways is designated as one-way (enter only or exit
only) by means of signs and pavement markings. Adding this provision provides flexibility for
developers and property owners because they can choose between having one full -
movement driveway or two one-way driveways per section of lot frontage. Mr. Bertrand noted
that the amendment would remove the staff's ability to apply discretion in allowing the
additional driveway; if approved, it would allow the additional driveway by right. Mr. Shrimplin
stated that the City Engineer is the one who suggested amending the code to allow it by right.

A pair of one-way driveways is safer than a full -movement driveway because it restricts turning
movements and reduces the potential for conflicts.
A motion was made by Mr. Greaser and seconded by Ms. McElreath to recommend approval
of the amendment as submitted. The motion passed by a roll call vote of 9 in favor, 0 in
opposition, and 0 abstaining (Aye: Bertrand, Blank, Greaser, Guard, Jackson, Jones, C.
Martin, N. Martin, McElreath).
5. Commission Appointment Recommendation
Chairman Blank stated that the Commission needs to make two appointment
recommendations: one for Mr. Jones' position and one for Mr. Greaser's position. Mr. Jones'
term expires November 1, 2025; he is eligible for reappointment. Mr. Greaser's term also
expires November 1, 2025; he has reached his term limit and cannot be reappointed. The
Commission reviewed the City Advisory Board and Commission applications on file for those
interested in serving on the Planning & Zoning Commission. Mr. Jones expressed interest in
being reappointed. A motion was made by Mr. Guard and seconded by Mr. Nick Martin to
recommend that the City Council reappoint Mr. Jones and appoint Blake Hagedorn. The
motion passed by a unanimous vote.
Commission Communication
Chairman Blank recognized Mr. Greaser for his many years of service on the Commission and
thanked him for his dedication to serving the community.
Mr. Greaser stated it was a privilege and an honor to serve on the Commission and work with the
City of Cape Girardeau.
Mr. Chris Martin mentioned that he noticed a new wall sign on the building at 632 Broadway. He
expressed concern about the sign design and its seemingly random placement on the fagade.
He asked if the property is zoned CBD (Central Business District) and if so, do the design
standards in the ordinance apply to signs such as this one. Mr. Shrimplin confirmed that the
property was zoned CBD. He stated that the design standards only apply to buildings. However,
the sign in question does require a sign permit and a License and Indemnity Agreement. He
stated that, to his knowledge, a License and Indemnity Agreement has not been prepared for the
sign. In cases where a License and Indemnity Agreement is required, the Inspection Services
Division is not supposed to issue the permit until the Agreement is executed by both the owner
and the City. Mr. Martin stated that Columbia, Missouri has launched a sweeping review of its
regulations and processes in an effort to curb violence in the community, especially in the
downtown area, and to make Columbia more inviting to businesses and people. He emphasized
that community image is an important factor in attracting new residents and businesses.
Staff Communication
Mr. Shrimplin gave the following updates:

MEETING DATE: November 12, 2025
SUBJECT: Rezoning Request for Property at 825 South Ellis Street
A rezoning application has been submitted for the property at 825 South Ellis Street.
The applicant is requesting that the property be rezoned from NC (Neighborhood
Commercial District) to R-3 (High Density Single -Family Residential District).
The immediately surrounding properties are zoned R-3 (High Density Single -Family
Residential District) to the north and east, and R-2 (Single -Family Urban Residential
District) to the south and west. This area is characterized by single-family residential
uses. The Cape Vision 2040 Comprehensive Plan's Future Land Use Map shows the
subject property as Low Density Residential.
In considering a rezoning request, the Planning & Zoning Commission and the City
Council must determine if the proposed zoning district is reasonable and in reasonable
conformity with the existing uses and value of the immediately surrounding properties.
The subject property was zoned R-3 until 2020 when it was rezoned to NC to allow for a
commercial day care. The day care has closed, and the owner would like to use the
entire building for residential once again. NC does not allow residential uses in the front
of the building on the ground floor. Given the property's prior R-3 zoning and the fact
that the rest of the block on both sides of South Ellis Street is zoned R-3, the proposed
zoning district is reasonable and in reasonable conformity with the existing uses and
value of the immediately surrounding properties.
Based on the above findings, staff recommends approval of the rezoning request.

An exception application has been submitted for the property at 3551 Hopper Road,
which is zoned R-1 (Single -Family Suburban Residential). The applicant is requesting

Section of the Development Code from which the exception is requested:
Describe the nature of the exception request.
Dear Members of the Board,
I am writing to formally request a variance for the installation of a 4' decorative aluminum fence in the front
yard of my property at 3551 Hopper Rd. I understand that the current zoning ordinance for my district restricts
front yard fences. I am seeking a variance for a front yard fence, so that my children can play safely in the
front where their playset is to be located. I understand and respect the purpose of the zoning ordinance, but
this rule creates an unnecessary hardship due to the unique circumstances of my property. Our house is
located on a high traffic road and the fence will not block sightlines or create a traffic hazard.
Thank you for your time and consideration of my request. I am available to answer any questions you may
have. I look forward to the opportunity to discuss this matter with you.
Sincerely,
Brent L. Chaney

RE: Stone and Story Subdivision Record Plat
Dear Mr. and Mrs. Todt:
City staff has completed its review of the above plat. During the review, the following items
were found which need correction or attention:
Reviewer #1 Comments — Ryan Shrimplin, City Planner (573) 339-6327; rshrimplin'@ ityofcape,or
1. Community Development application forms are updated every July to reflect the new fee
schedule. The 2024 version of the subdivision plat application form was submitted, which
listed fees that are now outdated. The 2025 version of the application form is attached for
future use until next July. The review fee increased by $10.00. Please submit payment in this
amount.
2. Revise the description beneath the plat title to read as follows:
PARTS OF THE NORTHEAST QUARTER AND SOUTHEAST QUARTER OF SECTION 30,
TOWNSHIP 31 NORTH, RANGE 1PAST OF THE FIFTH PRINCIPAL MERIDIAN, IN THE
CITY AND COUNTY OF CAPE GIRARDEAU, STATE OF MISSOURI
3. A record plat cannot divide an existing lot or tract without including the entire lot or tract. The
southern portion of proposed Lot 1 is part of an existing tract that extends to the west. Revise
the plat to include the rest of the tract and label it as Lot 2 along with the acreage and square
footage.
4. The plat is missing a vicinity map. Refer to the Minimum Requirements Checklist for more
information.
5. In the Survey Notes section, first line, change "New 1 Lot Subdivision" to "New 2 Lot
Subdivision".
6. In the References section, correct the URL for the Cape Girardeau County online mapping
records. The correct URL is https:Hmaps.camavision.com/capegirardeaumo.

7. In the Zoning and Lot Information section, change "10,000 aquare feet" to "10,000 square
feet".
8. In the Zoning and Lot Information section, change "Number of Lots = 1" to "Number of Lots =
3".
9. In the Zoning and Lot Information section, remove "Lot 1 = 37.79 Acres" and replace it with the
following (fill in the blanks):
Largest Leat = 37.79 Ages ( sq. ft.)
Smallest Lot () Acres ( sq. ft.)
10. The subdivision area consists of four tracts. Show the existing tract lines using a unique
symbol. Add the symbol to the legend and label it as LOT LINE TO BE ELIMINATED.
11. The plat is missing two existing easements. Refer to Teresa Heifner's comments for more
information. Show the easement lines using a unique symbol. Add the symbol to the legend
and label it as EXISTING EASEMENT.
12. Add the flood zone line symbol to the legend.
13. Add the centerline symbol (shown on Bertling Street) to the legend.
14. The Section line symbol appears identical to the EXTERNAL PROPERTY LINE symbol.
Change it to a unique symbol and add it to the legend.
15. Change the west right-of-way line of Old Sprigg Street Road (i.e., the line containing C1, C2,
C3, and C4) to the RIGHT OF WAY LINE symbol. Make this change in both the main exhibit
and Inset No. 1.
16. Add the right-of-way widths to the labels for Oakley Drive (30 feet) and Bertling Street (60
feet).
17. Add the square footage to the Lot 1 label.
18. In the label for the total road area to be dedicated, change "Road" to "Right of Way".
19. Add the building setback lines to Lot 1 and Lot 2.
20. Remove "SUBDIVISION" from the Oak Hills Subdivision label.
21. Change the side lot lines of Lots 13 through 22 of Oak Hills to the EXTERNAL PROPERTY
LINE symbol.
22. Show the boundaries of the lots in Maryland Addition and Flentge's Subdivision closest to the
subdivision boundary line. Be sure to label the lot and block numbers. The area labeled Mahy
Subdivision is incorrect. The correct reference is Lot 9, Block 3 of Maryland Addition.

RE: Country Place 211 Subdivision Record Plat
Dear Mr. and Mrs. Crites:
City staff has completed its review of the above plat. During the review, the following items
were found which need correction or attention:
Reviewer #1 Comments — Ryan Shrimplin, City Planner (573) 339-6327; rshrimplin,@ itofcape.o
Community Development application forms are updated every July to reflect the new fee
schedule. The 2024 version of the subdivision plat application form was submitted, which
listed fees that are now outdated. The 2025 version of the application form is attached for
future use until next July. The review fee increased by $10.00. Please submit payment in this
amount.
2. City Code does not allow building service lines for water or sanitary sewer to cross other lots
or run parallel to the public main with City right-of-way. Based on the new lot lines shown on
this plat, the building service line for water for Lot 3 would have to cross Lot 2 to connect to the
existing water main. Therefore, a water main extension will be required. This may involve
relocating the fire hydrant as well if it interferes with the new driveway for Lot 2. A main
extension for sanitary sewer will not be required as long as the new wye is installed directly on
the main (not the manhole or another wye).
3. Revise the description beneath the plat title to read as follows:
A Resubdivision of Lots 3 and 4 of Country Place ;Subdivision as Recorded in Plat Book 13 at
Page 32 in the Land Records of the County Recorder's Office, and Being a Part of the
Northwest Quarter of Section 34, Township 31 North, Range 13 Past of the Fifth Principal
Meridian, in the City and County of Cape Girardeau, State of Missouri
4. In the References section, first line, add "Noe" after "Book".
5. In the References section, second to last line, remove the comma after "Cape Girardeau".
6. In the Zoning and Lot Information section, add the following note after the setback information:
The 35 -foot front setback shown hereon was established by the record plat of County Place
Subdivision (Plat Soot No. 13 - Page No. 32).

7. In the Flood Zone Note, second to last line, add a space between the panel number and
"Which".
8. In the legend, change "ORIGINAL LOT LINE" to "LOT LINE TO BE ELIMINATED". Also,
change the symbol to one that is clearly distinguishable from the other symbols. The current
symbol is nearly identical to the existing easement line symbol.
9. The legend is missing symbols for existing easement line, centerline (see next comment), and
flood zone line.
10. Using a unique symbol, add the centerline of the Country Lane right-of-way to the exhibit.
11. Add a leader line to the label for the existing 20 -foot utility easement. Also, add the plat
reference (Plat Book 13, Page 32).
12. Using a unique symbol, add a new 10 -foot utility easement along the rear lot lines of Lots 1, 2,
and 3 (continuous, U-shaped). Add the symbol to the legend and label it as NEW EASEMENT
LINE.
13. The record plat of County Place Subdivision (Plat Book 13, Page 32) shows monuments at
both ends of the lot line between Lots 3 and 4. These monuments are not shown on the new
record plat. Were they found? If so, then add them to the exhibit. If not, then add the
following note:
THE RECORD PLAT OF COUNTRY PLACE SUBDIVISION (PLAT BOOK NOa 13 - PAGE
NO. 32) SHOWS MONUMENTS AT BOTH ENDS OF THE LOT LINE BETWEEN LOTS 3
AND 4. THESE MONUMENTS WERE NOT FOUND.
14. Add the following owner name and deed reference label to Lot 2 with leader lines pointing to
Lots 1 and 3:

and Part of Lot 40 of Twin Lakes Subdivision (Plat Book 12, Page 2) and Lot 2 of McKinney
Subdivision (Plat Book 22, Page 24).
19. Add the following labels to the area north of the aforementioned lot line (shift the exhibit to the

building setback line along the southeast lot line.
22. On Lot 3, label the 25 -foot building setback line along the south lot line. Also, label the 6 -foot
building setback line along the southwest lot line. If desired, one of the two 25 -foot building
setback line labels on Lot 2 can be removed.
23. Revise the first paragraph of the Subdivision Dedication section to read as follows:
The Undersigned, Kergious Rickey Crites and Martha Juan Crites, Husband and Wife, the
Owners of All of Lots 3 and 4 of Country Place Subdivision as Recorded in Plat Book 13 at
Page 32 in the Land Records of the County Recorder's Office, and Being a Part of the

27. In the City Clerk's certification, remove the comma after "Passed and Approved".
28. In the notary acknowledgement, the City Clerk's certification, the Recorder of Deeds
certification, and the Surveyor's certification, change the dates to "20 11— .
