REZONINGS, SPECIAL USE PERMITS, AND EXCEPTIONS 1. A public hearing was held on the proposed zoning of property located at 608, 620, 632, 644, 656, 668, and 680 Silverado Trail as R-2 (Single-Family Urban Residential District) upon annexation. Mr. Shrimplin explained that 608, 620, 632, and 644 Silverado Trail each contain a single-family detached dwelling while 656, 668, and 680 Silverado Trail are undeveloped. Normally, staff would recommend R-1 (Single-Family Suburban Residential District) but the lots do not meet the R-1 minimum lot standards. With few exceptions, the lots do meet the R-2 (Single-Family Urban Residential District) minimum lot standards. A staff report was submitted to the Commission, which recommended zoning the lots as R-2 upon annexation. Chairman Greaser opened the public hearing and, seeing no appearances to speak, he closed the public hearing. A motion was made by Mr. Whittington and seconded by Ms. Stickel to recommend zoning the lots as R-2 (Single-Family Urban Residential District) upon annexation. The motion passed with a roll call vote of 5 in favor, 0 in opposition, and O abstaining (Aye: Greaser, Jackson, Stickel, Whittington, Young). 2. A public hearing was held on the proposed zoning of property located at 572/576, 584/588, and 596/600 Silverado Trail as R-3 (High Density Single~Family Residential District) upon annexation. Mr. Shrimplin explained that 572/576, 584/588, and 596/600 Silverado Trail each contain a two-family (duplex) dwelling. The lots meet the R-3 minimum lot standards. A staff report was submitted to the Commission, which recommended zoning the lots as R-3 upon annexation. A motion was made by Mr. Jackson and seconded by Ms. Young to recommend zoning the lots as R-3 (High Density Single-Family Residential District) upon annexation. The motion passed with a roll call vote of 5 in favor, 0 in opposition, and 0 abstaining (Aye: Greaser, Jackson, Stickel, Whittington, Young). 3. A public hearing was held on the request of Koehler Engineering & Land Surveying, Inc. on behalf of SEMO Corner LLC for a special use permit for the purposes of constructing, maintaining, and operating a combined convenience store with fast food and a vehicle fueling station (not including service and repair) at 2090 North Sprigg Street, zoned NC (Neighborhood Commercial District). Chris Koehler, Koehler Engineering & Land Surveying, presented the request. He explained that the owner plans to develop the property for a convenience store with a quick-service restaurant and fuel sales. A fueling station requires a special use permit in the NC district. Ms. Stickel asked if anyone had expressed opposition to the request. Mr. Koehler replied that he was not aware of any opposition. Chairman Greaser opened the public hearing and, seeing no appearances to speak, he closed the public hearing. Mr. Shrimplin stated that, upon review of the application, staff identified two (2) exceptions from the Development Code, as follows: 1. The first exception is for the width of the southernmost driveway. The proposed width is forty (40) feet, which exceeds the maximum driveway width of thirty (30) feet for commercial uses. Staff supports the exception because a wider driveway is needed to accommodate fuel delivery truck turning movements when entering the site. 2. The second exception is for the throat length of the southernmost driveway. The proposed length is approximately sixty (60) feet, which is less than the minimum throat length of one hundred (100) feet for a driveway on an arterial street. Staff supports the exception because the site layout includes multiple access points, which reduces the amount of vehicle queueing space needed for this particular driveway. A staff report was submitted to the Commission, which recommended approval of the special use permit request, subject to the following conditions: 1. Except as provided for herein, the special use authorized by this permit shall comply with all applicable laws and regulations. 2. Major modifications to said special use (including, but not limited to, the site plan) shall require the approval of the City Council. 3. This permit shall automatically expire twelve (12) months from the date of issuance if the building permit for said special use has not been issued. If the building permit is issued within this time frame and later expires due to lack of progress, then this permit shall automatically expire upon the expiration of the building permit. 4. This permit is not transferable without the approval of the City Council. City of Cape Girardeau Planning & Zoning Commission Meeting Minutes September 14, 2022 Page 3 of 5 5. All structures shall be subject to design approval by the City staff to ensure they are constructed using materials, surfaces, textures, and colors that are compatible with the surrounding development in accordance with the NC, Neighborhood Commercial District regulations. 6. No individual retail store, personal service establishment or other permitted use shall have a gross floor area greater than five thousand {5,000) square feet in accordance with the NC, Neighborhood Commercial District regulations. 7. An exception from Section 25-1 of the Development Code is hereby granted as part of this permit to allow the southernmost driveway to exceed the maximum driveway width of thirty (30) feet as shown on the site plan. 8. An exception from Section 25-248(2)(a) of the Development Code is hereby granted as part of this permit to allow the southernmost driveway to have a throat length less than the minimum driveway throat length of one hundred (100) feet as shown on the site plan. A motion was made by Mr. Whittington and seconded by Ms. Stickel to recommend approval of the special use permit request, subject to the conditions in the staff report. The motion passed with a roll call vote of 5 in favor, 0 in opposition, and O abstaining (Aye: Greaser, Jackson, Stickel, Whittington, Young). 4. A public hearing was held on the request of Derek and Karla Cornelius for a special use permit for the purposes of constructing, maintaining, and operating a V-shaped LED billboard at 3849 Business Park Place, zoned M-1 (Light Manufacturing/Industrial District). Mr. Kevin O'Shea, legal counsel for the applicant, presented the request. He explained that a special use permit for the billboard was previously issued but it expired because the owners did not obtain a building permit within the 12-month time frame. The billboard meets all of the applicable code requirements and will be located in the northwest corner of the property, near Interstate 55. Chairman Greaser opened the public hearing and, seeing no appearances to speak, he closed the public hearing. A staff report was submitted to the Commission, which recommended approval of the special use permit request, subject to the following conditions: 1. The special use authorized by this permit shall comply with all applicable laws and regulations. 2. Major modifications to said special use (including, but not limited to, the site plan) shall require the approval of the City Council. 3. This permit shall automatically expire twelve (12) months from the date of issuance if the'building permit for said special use has not been issued. 4. This permit is not transferable without the approval of the City Council.
