REZONINGS. SPECIAL USE PERMITS. AND EXCEPTIONS
A public hearing was held on the request of Joanna D. Peek Trust, et al to rezone property
located at 2327 Boutin Drive and adjacent property along State Highway W from R-1
(Single -Family Suburban Residential District) to AG (Agricultural District). Chris Koehler,
Koehler Engineering & Land Surveying, the applicant, presented the request. He explained
that this property has been in the same family since 1853. The property has always been
farm land and his client would like the zoning to reflect the current use of the property.
Secretary Koetting opened the public hearing. Paul Nenninger, 2727 Partridge Court, stated
that a few years ago there was discussion about a portion of the property being converted to
a dog park. He asked if the property owner intends to establish a dog park or a commercial
use on the property. Mr. Koehler replied that his client has no such intentions.
Seeing no other appearances to speak, Secretary Koetting closed the public hearing. A
staff report was submitted to the Commission, which recommended approval of the rezoning
request. A motion was made by Ms. Stickel and seconded by Mr. Jackson to recommend
approval of the rezoning request. The motion passed with a roll call vote of 8 in favor, 0 in
opposition, and 0 abstaining (Aye: Blank, Greaser, Jackson, Koetting, Martin, Stickel,

OTHER ITEMS AND COMMUNICATION
7. Chapter 25 Amendment Regarding Driveway Spacing Requirements
Mr. Shrimplin presented a proposed amendment to the driveway spacing requirements in
the Development Code (Chapter 25 of the City's Code of Ordinances). He explained that
the amendment adds language to clarify that each unit is allowed a driveway for each full

80 -foot section of lot frontage along a street for single-family detached, townhouse, and two-
family (duplex) residential uses. The current language does not allow a duplex to have two
separate driveways (one for each unit) unless the lot has at least 160 feet of frontage. Most
duplex lots have less than 160 feet of frontage, and staff believes it is reasonable to allow
each unit to have its own individual driveway on a lot with a lesser frontage. The
amendment also corrects an erroneous section reference.
A motion was made by Mr. Koetting and seconded by Mr. Jackson to recommend approval
of the amendment as proposed by staff. The motion passed with a roll call vote of 8 in
favor, 0 in opposition, and 0 abstaining (Aye: Blank, Greaser, Jackson, Koetting, Martin,
Stickel, Whittington, Young).
Amendment to the Rules of Procedure
Mr. Shrimplin explained that the City recently recodified its Code of Ordinances, which changed
some of the section numbers. He presented an amendment to the Commission's Rules of
Procedure, which updated the section number references to match the Code. A motion was
made by Mr. Koetting and seconded by Mr. Whittington to adopt the amendment. The motion
passed by a unanimous vote.
