ZONING COMMISSION PLANNING & ZONING COMMISSION MEETING MINUTES June 8, 2022 City Hall -Council Chambers 44 North Lorimier Street Commission Members Present: Scott Blank, Kevin Greaser, Derek Jackson, Patrick Koetting, Nick Martin, Melissa Stickel, Ed Thompson, Sid Whittington, Deborah Young Commission Members Absent: None Staff Present: Carol Peters, Ryan Shrimplin Call to Order Chairman Greaser called the meeting to order at 7:00 p.m. Approval of Minutes The minutes of the May 11, 2022 meeting were unanimously approved upon a motion made by Mr. Koetting and seconded by Mr. Thompson. REZONINGS, SPECIAL USE PERMITS, AND EXCEPTIONS 1. A public hearing was scheduled for the request of Maurice and Mellen Gross to rezone property located at 2617 Maria Louise Lane from R-1 (Single-Family Suburban Residential District) to R-4 (Medium Density Multifamily Residential District). Mr. Shrimplin explained that the applicant has plans to purchase the property, but she recently learned that the seller has entered into a contract with another party. The applicant has requested that the Commission table the hearing for now. A motion was made by Mr. Koetting and seconded by Ms. Stickel to table the public hearing on the rezoning request. The motion passed via a unanimous vote. 2. A public hearing was held on the request of Chris and Sheniqua Sparks for an exception from Development Code Section 25-161 (a), fence height and surface requirements, for property located at 1542 North Water Street. Ms. Sheniqua Sparks was in attendance to answer questions from the Commission. She explained that she and her husband opened a commercial day care on the property and installed a chain link fence in the front yard to enclose the outdoor play area. At the time, they were not aware that the code did not allow a chain link fence in the front yard of a commercial property. A staff report was submitted to the Commission, which contained the following findings of fact: Criterion #1: As part of the exception request, a "substantial equivalent" is proposed. "Substantial equivalent" means an alternate design, method or feature that accomplishes the same purpose as the applicable Development Code requirement. City of Cape Girardeau Planning & Zoning Commission Meeting Minutes June 8, 2022 Page 2 of 3 Finding: The purpose of the requirement is to ensure high-quality commercial development through the use of fence styles, materials, and finishes that are decorative when located in the front yard. The fence was recently installed without any permits or approvals. It has a standard galvanized finish, which is not considered decorative. Painting or coating the fence to give it a decorative look would serve as a substantial equivalent. Criterion #2: Approval of the exception request is consistent with the general spirit and intent of the Development Code. Finding: If the aforementioned substantial equivalent were to be imposed as a condition of approval, it would ensure fairness among property owners and tenants, thus making approval of the exception request consistent with the general spirit and intent of the Development Code. Based on the above findings, staff recommended approval of the exception request, subject to the following condition: 1. The fence shall be painted or coated to give it a decorative look. The type and color of paint or coating shall be subject to approval by the City staff. Chairman Greaser asked Ms. Sparks if she had read the staff report and had any concerns with the recommended condition of approval. Ms. Sparks confirmed that she had read the staff report. She asked Mr. Shrimplin if painting the fence black would be acceptable. Mr. Shrimplin stated that black would be an appropriate paint color for the fence. Chairman Greaser opened the public hearing and, seeing no appearances to speak, he closed the public hearing. A motion was made by Mr. Thompson and seconded by Mr. Jackson to approve the exception request with the staff-recommended condition. The motion passed with a roll call vote of 9 in favor, O in opposition, and O abstaining (Aye: Blank, Greaser, Jackson, Koetting, Martin, Stickel, Thompson, Whittington, Young). SUBDIVISION PLATS 3. The revised record plat of Capaha Place was reviewed by the Commission. Mr. Gerry Jones, the developer, was available for questions from the Commission. A staff report was submitted to the Commission, which recommended approval of the record plat. A motion was made by Mr. Koetting and seconded by Ms. Stickel to recommend approval of the record plat. The motion passed with a roll call vote of 9 in favor, 0 in opposition, and 0 abstaining (Aye: Blank, Greaser, Jackson, Koetting, Martin, Stickel, Thompson, Whittington, Young).
