Definitions 3. Mr. Shrimplin presented a proposed amendment to the Zoning Code (Chapter 30 of the City Code). He explained that the amendment makes several changes to Section 30-105 (Definitions). Some of the changes are corrections to or clarifications of existing definitions. Other changes involve deleting, adding, or rewording definitions. Several of these changes relate to terms used throughout Chapter 30 or used by City staff in discussing zoning matters (such as lot line, setback, special use, use permitted by right, and yard). In addition, the terms heavy manufacturing and industrial facility and light manufacturing and industrial facility are being changed to be less broad in their scope. Both definitions currently include facilities engaging in "the manufacturing, fabrication, assembly, printing, packaging or shipping of products or materials; or the testing, cleaning, servicing, repair, or storage thereof'. There are many businesses located in commercial zoning districts which do not engage in manufacturing but do engage in the other activities listed. Because heavy manufacturing and industrial facility and light manufacturing and industrial facility are not permitted uses in any of the commercial districts, these businesses are considered nonconforming, and any business of this nature wishing to be located in a commercial district is prohibited from doing so. Both definitions are reworded to focus on the manufacturing aspect. A motion was made by Mr. Skinner and seconded by Mr. Spooler to recommend approval of the amendment to Zoning Code Section 30-105, Definitions. Chairman Glenn asked why the definition of stop work order is being revised to replace "director of development services" with "city manager". Mr. Shrimplin explained that Section 30-105 contains a definition of city manager, which is worded to mean the City Manager or his or her designee. Replacing "director of development services" with "city manager" provides flexibility in terms of who may issue a stop work order. Mr. Skinner asked if the definition of commercial recreation facility is intended to apply to situations where the recreation activity is incidental to another use, such as a couple of pool tables in a bar. Mr. Shrimplin responded by stating that is not the intention. Mr. Skinner suggested adding language to the definition for clarification. He also asked how the staff would distinguish between "large or heavy articles", included in the definition of heavy manufacturing and industrial facility, and "small or light articles", included in the definition of light manufacturing and industrial facility. Mr. Shrimplin responded by stating that the staff would need to make an interpretation based on the nature of the business and the specific products. There being no further discussion, the Commission unanimously passed the motion to recommend approval of the amendment to Zoning Code Section 30-105, Definitions, with the added language to the definition of commercial recreation facility per Mr. Skinner's request. Staff Communication • Update on Council actions taken on items from previous Commission Meeting Mr. Shrimplin reported that there were no items from the Commission's July 11, 2018 meeting on the last City Council agenda. • Update on Transportation Trust Fund (TTF) Projects City of Cape Girardeau Planning & Zoning Commission Meeting Minutes August 8, 2018 Page 3 of 3 Mr. Shrimplin reviewed the status of TTF4 and TTF5 projects. He noted that most of the TTF4 projects have been completed. One project, Mustang Drive, has not moved forward because the City is looking for an opportunity to acquire land for this proposed second access for the airport. TTF5 includes several LED streetlight conversion projects, some of which have been completed; the rest were recently awarded to contractors. The annual contracts for concrete street repair and asphalt overlay were also recently awarded. Projects for the Sloan Creek Bridge superstructure replacement/slope stabilization and for the reconstruction of West End Boulevard from Rose Street to Bertling Street are in process. Also in process is the traffic study for Independence Street from the roundabout to North Sunset Boulevard. Mr. McClanahan mentioned that it will soon be time to begin planning for TTF6.
