Mr. Bertrand replaced Deborah Young, whose term expired November 1, 2023. Approval of Minutes The minutes of the October 10, 2023 meeting were unanimously approved upon a motion made by Mr. Nick Martin and seconded by Mr. Chris Martin. REZONINGS, SPECIAL USE PERMITS, AND EXCEPTIONS A public hearing was held on the request of River City Centre, LLC for an exception from Development Code Section 25-47, required number of parking and stacking spaces, for property located at 211-219 South Silver Springs Road. Mr. Nick Martin recused himself from the discussion and vote for financial reasons. Mr. Chris Buerck, Bowen Engineering & Surveying, presented the request. He stated that the request is to provide a reduced number of stacking spaces for a restaurant with drive-through service and on-site seating. He explained that the restaurant will not have an ordering station. Customers will be required to place their orders online or over the phone. If a customer's order is not ready when they pull up to the pick-up window, then they will be directed to park in one (1) of five (5) designated waiting parking spaces provided in the parking lot in front of the building. Vice Chairman Blank opened the public hearing. Seeing no appearances to speak, he closed the public hearing. A staff report was submitted to the Commission, which contained the following findings of fact: Criterion #1: As part of the exception request, a "substantial equivalent" is proposed. "Substantial equivalent" means an alternate design, method or feature that accomplishes the same purpose as the applicable Development Code requirement. Finding: The purpose of the stacking requirement is to ensure that there is adequate room for vehicles with customers waiting to place an order and pick it up. The City of Cape Girardeau Planning & Zoning Commission Meeting Minutes November 8, 2023 Page 2 of 3 application states that the drive-through lane is for pick-up only and not ordering. Customers must place their orders online or over the phone. Not having an ordering station in the drive-through lane allows vehicles to move through the lane more efficiently. The application also states that if an order is not ready when a driver approaches the pick-up window, then the driver will be directed to a designated waiting parking space in the parking lot. Five (5) designated waiting parking spaces are proposed. These spaces are essentially stacking spaces located in the parking lot rather than the drive-through lane. For this reason, they cannot count toward the required number of parking spaces for the development. However, they do qualify as a substantial equivalent for the purposes of the stacking requirement. Criterion #2: Approval of the exception request is consistent with the general spirit and intent of the Development Code. Finding: The substantial equivalent ensures fairness among property owners and tenants, which makes approval of the exception request consistent with the general spirit and intent of the Development Code. Based on the above findings, staff recommended approval of the exception request, subject to the following condition: The five (5) designated waiting parking spaces approved as part of this exception shall not count toward the required number of parking spaces for the development. A motion was made by Mr. Jackson and seconded by Ms. McCauley -Perdue to approve the exception request. The motion passed with a roll call vote of 7 in favor, 0 in opposition, and 1 abstaining (Aye: Bertrand, Blank, Jackson, Jones, C. Martin, McCauley -Perdue, Whittington; Abstain: N. Martin).
