Regular Session September 5, 2023 LL-325 STUDY SESSION—September 5,2023 NO ACTION TAKEN DURING THE STUDY SESSION The Cape Girardeau City Council held a study session at the Cape Girardeau City Hall on Tuesday, September 5, 2023, starting at 5:00 p.m. with Mayor Stacy Kinder presiding and Council Members Mark Bliss, Robbie Guard, Dan Presson, Tameka Randle, Nate Thomas, and Shannon Truxel present. REGULAR SESSION—September 5,2023 CALL TO ORDER The Cape Girardeau City Council convened in regular session at the Cape Girardeau City Hall on Tuesday, September 5, 2023, starting at 5:25 p.m. with Mayor Stacy Kinder presiding and Council Members Mark Bliss, Robbie Guard, Dan Presson, Tameka Randle, Nate Thomas, and Shannon Truxel present. ADOPTION OF THE AGENDA A Motion was made by Dan Presson, Seconded by Tameka Randle,to approve and adopt. Motion passed. 7-0.Ayes: Bliss, Guard,Kinder, Presson,Randle,Thomas,Truxel. CONSENT AGENDA Approval of the September 5, 2023, City Council regular session Minutes. BILL NO. 23-123, an Ordinance approving the record plat of Maurer Family Land. Second and Third Readings. BILL NO. 23-124, an Ordinance authorizing the Mayor to execute a Special Warranty Deed to Missouri Highways and Transportation Commission for property along Minnesota Avenue at the intersection of Route 74, in the City of Cape Girardeau,Missouri. Second and Third Readings. BILL NO. 23-125, a Resolution authorizing an application to the United States Department of Transportation for the Reconnecting Communities and Neighborhoods Grant Program and authorizing the City Manager to execute all necessary documents. Reading and Passage. BILL NO. 23-126, a Resolution authorizing the City Manager to execute a License and Indemnity Agreement with CWC Hospitality, LLC, for installation of a retaining wall at 433 Cape West Crossings, in the City of Cape Girardeau,Missouri. Reading and Passage. BILL NO. 23-127, a Resolution authorizing the City Manager to execute a License and Indemnity Agreement with Ronald M. & Charlotte A. Angles to place certain improvements on an unimproved portion of Flad Avenue, in the City of Cape Girardeau, Missouri. Reading and Passage. BILL NO. 23-128, a Resolution Authorizing the City Manager to Execute an Agreement with Lappe Cement Finishing, Inc., for the Concrete Street Repair 2023 Project in the City of Cape Girardeau,Missouri. Regular Session September 5, 2023 LL-326 BILL NO. 23-129, a Resolution Authorizing the City Manager to Execute an Agreement with Apex Paving Company for the 2023 Asphalt Overlay Program in the City of Cape Girardeau, Missouri.Reading and Passage. BILL NO. 23-130, a Resolution authorizing the City Manager to execute a Demolition Contract with JAC3 Contracting LLC, for the demolition of buildings at various locations in the City of Cape Girardeau,Missouri.Reading and Passage. BILL NO. 23-131, a Resolution of support for the proposal from MACO Development Company, L.L.C., for the Silver Springs II Apartments housing development, in the City of Cape Girardeau, Missouri.Reading and Passage. BILL NO. 23-132, a Resolution of support for the proposal from Starview Development, LLC, for the Star Vue II Apartments housing development in the City of Cape Girardeau, Missouri. Reading and Passage. BILL NO. 23-133, a Resolution authorizing the City Manager to execute an Agreement with Riverside Roofing Company, LLC, for installation of a new roof at the Cape Girardeau Regional Airport. Reading and Passage. A Motion was made by Robbie Guard, Seconded by Nate Thomas, to approve and adopt. Motion passed. 7-0.Ayes: Bliss, Guard,Kinder, Presson,Randle, Thomas,Truxel. Council Member Robbie Guard abstained from Bill No. 23-131 and Bill No. 23-132, for financial reasons, because of his employment with MRV Banks. BILL NO. 23-123 will be Ordinance NO. 5680; BILL NO. 23-124 will be Ordinance NO. 5681; BILL NO.23-125 will be Resolution NO. 3572; BILL NO. 23-126 will be Resolution NO. 3573; BILL NO. 23-127 will be Resolution NO. 3574; BILL NO. 23-128 will be Resolution NO. 3575; BILL NO. 23-129 will be Resolution NO. 3576; BILL NO.23-130 will be Resolution NO. 3577; BILL NO. 23-131 will be Resolution NO. 3578; BILL NO. 23-132 will be Resolution NO. 3579; and BILL NO. 23-133 will be Resolution NO. 3580. A Motion was made by Dan Presson, Seconded by Shannon Truxel,to approve. Motion passed. 7-0. Ayes: Bliss, Guard,Kinder,Presson, Randle,Thomas,Truxel. BILL NO. 23-135, an Ordinance approving the record plat of S & L Subdivision. First Reading. Mayor Kinder called for public appearances regarding this Bill.No one appeared. A Motion was made by Mark Bliss, Seconded by Dan Presson,to approve. Motion passed. 7-0.Ayes: Bliss, Guard,Kinder,Presson,Randle, Thomas,Truxel. BILL NO. 23-136, an Ordinance Appropriating Funds for Operating Expenditures, Capital Expenditures, Debt Service Expenditures, and Transfers for the Fiscal Year Ending June 30, 2023, in the City of Cape Girardeau, Missouri. APPOINTMENTS Appointment to the Golf Course Advisory Board A Motion was made by Mark Bliss, Seconded by Shannon Truxel, to appoint Eric Craiglow (Jaycees Representative) and Lindsey Pippins to the Golf Course Advisory Board for terms expiring September 4, 2026. Motion passed. 7-0. Ayes: Bliss, Guard, Kinder, Presson,Randle,Thomas,Truxel. Appointment to the Public Library Board of Directors A Motion was made by Shannon Truxel, Seconded by Dan Presson, to confirm Mayor Stacy Kinder's appointment of Lauren Clark Hill to the Public Library Board of Directors for a term expiring June 30, 2025. Motion passed. 7-0.Ayes: Bliss, Guard,Kinder,Presson,Randle,Thomas,Truxel. OTHER BUSINESS Alix Gasser, representing a project group with the Leadership Cape 2023 class, appeared to present the group's project to form an accessibility advisory board for the City of Cape Girardeau. MaryAnn Allen appeared in support of the proposal for the redevelopment of the mall. Amber French appeared regarding homelessness in Cape Girardeau. She spoke about activities of Street Level. Lisa Green appeared to reiterate the importance of recycling. Cynthia Durgan appeared regarding homelessness and the activities of Street Level. MEETING ADJOURNMENT A Motion was made by Robbie Guard, Seconded by Tameka Randle,to adjourn the meeting. Motion passed. 7-0.Ayes: Bliss, Guard,Kinder,Presson,Randle,Thomas,Truxel.
