Regular Session August 21 , 2023 LL-321 STUDY SESSION—August 21,2023 NO ACTION TAKEN DURING THE STUDY SESSION The Cape Girardeau City Council held a study session at the Cape Girardeau City Hall on Monday, August 21, 2023, starting at 5:00 p.m. with Mayor Stacy Kinder presiding and Council Members Mark Bliss,Robbie Guard,Tameka Randle,Nate Thomas, and Shannon Truxel present. Dan Presson was absent. • REGULAR SESSION—August 21,2023 CALL TO ORDER The Cape Girardeau City Council convened in regular session at the Cape Girardeau City Hall on Monday, August 21, 2023, starting at 5:12 p.m. with Mayor Stacy Kinder presiding and Council Members Mark Bliss,Robbie Guard,Tameka Randle,Nate Thomas, and Shannon Truxel present. Dan Presson was absent. ADOPTION OF THE AGENDA A Motion was made by Robbie Guard, Seconded by Nate Thomas,to approve and adopt. Motion passed. 6-0. Ayes: Bliss, Guard,Kinder,Randle,Thomas, Truxel.Absent: Presson. CONSENT AGENDA Approval of the August 7, 2023, City Council regular session Minutes and the August 15, 2023, special session and closed session Minutes. BILL NO. 23-114, an Ordinance Providing for the Levying of the Annual City Revenue Tax: Public Health Tax; Special Business District No. 2; for the Fiscal Year Ending June 30, 2024. Second and Third Readings. BILL NO. 23-115, an Ordinance annexing land located at 2797 Benton Hill Road into the city limits of the City of Cape Girardeau,Missouri. Second and Third Readings. BILL NO. 23-116, an Ordinance amending Chapter 30 of the Code of Ordinances of the City of Cape Girardeau, Missouri, by zoning newly annexed property located at 2797 Benton Hill Road as R-1, Single-Family Suburban Residential District. Second and Third Readings. BILL NO. 23-117, an Ordinance extending the boundaries of Ward 6 to include property newly annexed into the city limits of the City of Cape Girardeau,Missouri. Second and Third Readings. BILL NO. 23-118, an Ordinance amending Chapter 30 of the Code of Ordinances of the City of Cape Girardeau, Missouri, by changing the zoning of property located at 97 North Kingshighway, in the City and County of Cape Girardeau, Missouri, from M-1 to C-2. Regular Session August 21 , 2023 LL-322 BILL NO. 23-119, an Ordinance accepting Permanent Easements from The Mary Ann and Bert J. Kellerman Foundation for property located at 401 Independence Street, in the City of Cape Girardeau, Missouri. Second and Third Readings. BILL NO. 23-120, a Resolution authorizing the City Manager to execute a General Services Agreement with Wilson&Company, Inc., Engineers&Architects, for Sewer Projects in the City of Cape Girardeau,Missouri.Reading and Passage. BILL NO. 23-121, a Resolution authorizing the City Manager to execute an Agreement with RailWorks Track Services, Inc., for the Nash Road Railroad Tie Repair Project. Reading and Passage. Accept the Improvements and Authorize Final Payment to Zoellner Construction Co., Inc. for the Capaha Park Pond Dredging Project. A Motion was made by Mark Bliss, Seconded by Shannon Truxel,to approve and adopt. Motion passed. 6-0. Ayes: Bliss, Guard,Kinder, Randle,Thomas,Truxel.Absent: Presson. BILL NO. 23-114 will be Ordinance NO. 5674; BILL NO. 23-115 will be Ordinance NO. 5675; BILL NO. 23-116 will be Ordinance NO. 5676; BILL NO. 23-117 will be Ordinance NO. 5677; BILL NO. 23-118 will be Ordinance NO. 5678; BILL NO. 23-119 will be Ordinance NO:5679; BILL NO. 23-120 will be Resolution NO. 3570; and BILL NO. 23-121 will be Resolution NO. 3571. NEW ORDINANCES BILL NO. 23-123, an Ordinance approving the record plat of Maurer Family Land. First Reading. Mayor Kinder called for public appearances regarding this Bill.No one appeared. A Motion was made by Nate Thomas, Seconded by Robbie Guard,to approve. Motion passed. 6-0.Ayes: Bliss, Guard,Kinder,Randle,Thomas,Truxel. Absent: Presson. BILL NO. 23-124, an Ordinance authorizing the Mayor to execute a Special Warranty Deed to Missouri Highways and Transportation Commission for property along Minnesota Avenue at the intersection of Route 74, in the City of Cape Girardeau, Missouri. First Reading. Mayor Kinder called for public appearances regarding this Bill.No one appeared. A Motion was made by Nate Thomas, Seconded by Mark Bliss,to approve. Motion passed. 6-0.Ayes: Bliss, Guard,Kinder,Randle,Thomas,Truxel. Absent: Presson. APPOINTMENTS Appointment to the Convention and Visitors Bureau Executive Board A Motion was made by Mark Bliss, Seconded by Tameka Randle, to appoint Nathaniel Saverino to the Convention and Visitors Bureau Executive Board for a term expiring December 31, 2025. Motion passed. 6-0.Ayes: Bliss, Guard,Kinder, Randle,Thomas,Truxel.Absent: Presson. Proceedings of the City Council, City of Cape Girardeau, Mo. Regular Session August 21 , 2023 LL-323 Appointment to the Planning and Zoning Commission A Motion was made by Robbie Guard, Seconded by Nate Thomas,to appoint Gerald W. Jones, II to the Planning and Zoning Commission for a term expiring November 1, 2025. Motion passed. 6-0.Ayes: Bliss, Guard,Kinder,Randle,Thomas,Truxel.Absent: Presson. Appointment to the University of Missouri Extension Council. A Motion was made by Shannon Truxel, Seconded by Mark Bliss, to confirm the Mayor Stacy Kinder's appointment of James Newman to the University of Missouri Extension Council for a term expiring February 28, 2025. Motion passed. 6-0.Ayes: Bliss, Guard,Kinder,Randle,Thomas,Truxel.Absent: Presson. OTHER BUSINESS Lisa Green appeared before Council and presented a picture of the aerial view of 1218 College. She noted that the she constructed the shed with reclaimed materials and she noted the importance or recycling. MEETING ADJOURNMENT A Motion was made by Robbie Guard, Seconded by Tameka Randle,to adjourn the meeting. Motion passed. 6-0. Ayes: Bliss, Guard,Kinder,Randle,Thomas, Truxel.Absent: Presson.
