Box 617 Cape Girardeau, Missouri 63702-0617 March 11, 2004 The Board of Appeals met on Thursday, March 11, 2004 at 7:00 p.m. in the Council Chambers, City Hall 401 Independence St. Members Present: Dave Pfeiffer, Paul Grebe, Farris Nabors, Tony Sebek and (Michael Annis-alternate) Members Absent: Joe Burton, Dave Alberson and (Tom Phillips- alternate) The meeting was called to order at 7:00 p.m. by Tony Sebek and the roll was called. Motion was made by Dave Pfeiffer to accept the minutes from the November 13, 2003 meeting. Paul Grebe seconded the motion. The motion passed 6-0 in favor. Appeal Requests: 1. An appeal request by Tom Leggett, Maple United Methodist Church, at 2441 Jean Ann Drive, for a variance from Section 1004.2.2.1 "Two exit or exit access doorways"of the 2000 International Building Code and a variance from Section 403.3 and Table 403.3 " Ventilation Rate "of the 2000 International Mechanical Code. Tom Holshouser, Architect, was present for the appeal request for Maple United Methodist Church, at 2441 Jean Ann Drive. Dave Pfieffer suggested that the exits and the ventilation be considered as separate issues. Tony Sebek wants to vote separately on the exits and ventilation requests. Appeal A is for the required "Two exit or exit access doorways': Mr. Holshouser stated where two exit or exit access doorways are required on the portion of the exit access, the exit doors or exit access doorways shall be placed at a distance apart equal to not less than half of the length of the maximum overall diagonal dimension of the building or area to be served measuring a straight line between the exit doors or exit access doorways. Mr. Holshouser indicated in his presentation, since the kitchen has its own outside exit and all the other rooms empty into the Fellowship Hall BOARD OF APPEALS r‘ MINUTES March 11, 2004 Page 2 he feels the diagonal dimension should be of the area to be served, not the entire building. If this set of plans were being reviewed under the 1996 BOCA code, the kitchen exit would be allowed to be used and this would meet the requirement. When phase 3 is built there will be an additional exit stairway at the northeast corner, which is now listed as a storeroom. This will provide an additional exit. Dave Pfieffer fees the plans may not meet letter of the code, but does meet the intent of the code. Dave Pfeiffer made a motion to approve the request for a variance from section 1004.2.2.1 of the 2000 International Building Code "Two exit or exit access doorways". Paul Grebe seconded the motion. Motion passed 5-0 to approve the appeal request. Appeal B is for the required "Ventilation Rate': Mr. Holhouser stated that the Church Fellowship Hall would only be used intermittently. He feels that the required 3500 CFM of outdoor air is excessive for a 3,660 CFM system. This is based on 175 occupants @ 20 CFM each. This will require the church to add another heating and cooling system to preheat and cool this large amount of outdoor air. As designed they are providing 1,390 CFM of outside air with the 3 furnace and air conditioning systems. The building is also equipped with full casement ventilated windows providing 54 SF of window openings. This space will only be used 5% of each 8-hour day, seven days a week, two hours on Sunday morning and a dinner once a month. Tony Sebek made a motion to approve the request for a variance from section 403.3 and table 403.3 of the 2000 International Mechanical Code "Ventilation Rate'. Upon the condition of the installation of an exhaust fan that will change air 1-1/2 times per hour for the area in question. Dave Pfeiffer seconded the motion. Motion passed 5-0 to approve the appeal request. 2. An appeal request by Christey Heath, Dalhousie Downtown, at 19 S. Spanish, for a variance from Section 506.3.13.2 "Termination through an exterior wall"and Section 506.3.13.3 "Termination location"of the 2000 International Mechanical Code. Christey Heath, Mike Vandeneyl and Greg Landys were present for the appeal request for Dalhousie Downtown, at 19 S. Spanish Street. Mike Morgan, Fire Marshall was present to represent the City of Cape Girardeau Fire Department. Ms. Heath is requesting a variance from the board for the location of the exhaust hood system for the kitchen of Dalhousie Downtown. The exhaust system has been installed by using the window instead of penetrating an exterior wall. Mike Morgan sent Ms. Heath a letter regarding the location of the exhaust hood system. Mike Conrad, Interim Inspection Services Director read the letter to the Board of Appeals. Mike Morgan is concerned about the height of the hood system on the outside of the building and location as a public nuisance. Ms. Heath stated they used the window because it was a historical building. She used the window that was already there in order to preserve the integrity of the building, by not drilling into the walls. Ms. Heath stated they have considered placing a screen in BOARD OF APPEALS MINUTES March 11, 2004 Page 3 front of the exposed exhaust fan on the outside of the building, this screening will have to be a minimum of 10 feet from the exterior of the exhaust hood system. Even with a screen there will probably be grease that will be transmitted on passing vehicles. Tony Sebek suggested to the manager of Dalhousie Downtown to check with the manufacturer of the exhaust hood system about deflectors to redirect the exhaust upward and this should be done by an exhaust engineer, this information should be forwarded to the city for review. Dave Pfeiffer made a motion to approve the appeal variance from section 506.3.13.2 and section 506.3.13.3 of the 2000 International Mechanical Code. Approved based upon inclusion of window screen, exhaust fan and enclosing fence. Farris Nabors seconded the motion. Motion passed 5-0 to approve the appeal request. Being there was no other business at this time, a motion was made to adjourn. The meeting adjourned at 8:05 p.m. The next meeting of the Board of Appeals is scheduled for April 8, 2004. Respectfully Submitted, ca-tiPaul Grebe Secretary
