Members Present: Dave Pfeiffer,Joe Burton,Tony Sebek, Paul Grebe, Fan-is Nabors, Dave Alberson, Michael Annis (alternate), and Tom Phillips (alternate) Members Absent: Call to order at 7:00 p.m. by Dave Pfeiffer, Chairman. Roll Call. Motion was made by Tom Phillips to accept the minutes from the January 9, 2003 meeting. Joe Burton seconded the motion, motion passed 6-0 in favor. Appeal Requests: 1. An appeal request by Tim Cagle, at 2044 Broadway, for a variance from section 1003.4 "Oil Separators Required"of the 2000 International Plumbing Code. Mr. Cagle presented his appeal request to the board. He had rented the property to an auto detailing business. Fire Inspector, Sam Welker, inspected the property for a business license and found the property was not in complication for the use as an auto detailing shop. To comply, the property must be brought up to code. The code requires an oil separator in the floor drain, but the building does not have a drain and the owner did not want to break up the floor to install a drain. He said his renters would not be washing cars inside the building. Inside the building they would only be detailing the interiors of the cars, therefore he did not feel the requirement for an oil separator in the drain would be required. Joe Burton made a motion to approve the appeal request presented by Mr. Cagle to vary section 1003.4 of the 2000 International Plumbing Code; with a stipulation to add an amendment to the contract the owner has with the renters they would wash engines and wheel wells at a car wash. No second to the motion, motion died. Tony Sebek made a motion to approve the appeal request with the restrictions that no engines be washed at location. Joe Burton seconded the motion; motion passed 8-0 in favor. BOARD OF APPEALS MINUTES July 10, 2003 Page 2 2. An appeal request by Jay Meystedt, at 237 N. Ellis, for a variance from section 903.2.8 "Group R-2 Automatic Sprinkler System"of the 2000 International Building Code. Mr. Meystedt presented the appeal request to the board. Architect Charlie Herbst was also present representing Mr. Meystedt. Mr. Meystedt owns a three-story dwelling he would like to convert to a boarding house. The code requires that board houses above two floors to have a sprinkler system installed. Because of the age of the building and the configuration of the floors a sprinkler system would be cost prohibitive. He requests a variance from the board from the sprinkler system and use as an alternative he would install egress windows and one-hour separation in the area to be renovated. Tom Phillips made a motion to approve the substitution of the fire sprinkler system with installing one-hour separation in the area being renovated and the stairway, fire rated doors on the sleeping rooms, interconnected smoke detectors in all bedrooms (including existing) and egress windows. Joe Burton seconded the motion; motion passed 8-0 in favor. 3. An appeal request by Douglas Kouba, Gale A. Hill&Associate Inc., for a variance from Table .503 " Allowable Height and Building Areas" of the 1996 BOCA Building Code at First Presbyterian Church, 345 Broadway. Mr. Kouba, architect, presented the appeal request to the board. The plans for an addition at 345 Broadway, the First Presbyterian Church, was reviewed under the 1996 BOCA Building Code. Mr. Kouba requested the existing 1-2 use group (the church's nursery) to remain in the existing 3-B construction, which is unprotected. The code states a nursery is not permitted in an unprotected construction, Mr. Kouba would like to vary the code to allow the nursery in a 3-B construction. Mr. Kouba pointed out the nursery would have appropriate adult supervision. Dave Alberson made a motion to approve the appeal request for the First Presbyterian Church to vary from Table 503 in the 1996 BOCA Building Code. Paul Grebe seconded the motion; motion passed 7-0 in favor,Tom Phillips abstained from voting. 4. An appeal request by Linda Bohnsack, at 833/835 Broadway Suite 110, for a variance from the definition of A-3 under the 2000 International Building Code. Ms. Bohnsack presented the appeal request to the board. Under the 2000 International Building Code the proposed business the "Garden Gallery" would be classified by the fire department as A- 3 instead of M (which is mercantile.) Ms. Bohnsack indicated to the board the building has always been mercantile and she proposes the Garden Gallery would be mercantile because she would be selling arts and crafts products and set up as a gallery with showings. If the Garden Gallery is BOARD OF APPEALS MINUTES July 10, 2003 Page 2 classified as A-3 this would be a change of use and it would require the area is bought up to code, including new fire separation. Mr. and Mrs. Bohnsack would like to have a determination from the board on the proposed Garden Gallery. Dave Alberson made a motion to classify the Garden Gallery at 833/835 Broadway as "M" mercantile. Tony Sebek seconded the motion; motion passed 7-0 in favor (Tom Phillips was unable to attend the remaining meeting). Election of Officers Dave Alberson made a motion to elect Joe Burton as Chairman.
