Appeal Requests:
E.R. Thompson of E.R. Thompson Construction, requested variance from Section 603.1
and Table 602, Note D of the 1996 National Building Code for a remodeled mall space at
3049 William Street, Space 5555, J.C. Penney Co. E.R. Thompson Construction
requested that wood studs be allowed in the renovation of the Vision Center, located inside
the mall space. Mr. Thompson stated that although the building is rated as 2C , requiring
non-combustible materials, untreated wood had always been used in this space. He
explained that this was the reason wood was used for the remodeling instead of metal, even
though metal studs were specified on the approved building plans for the renovation. Fire-
rated sheet rock and a sprinkler system were also installed. Mr. Thompson further stated
that the project is complete and that the owners of J.C. Penney have expressed no concern
about the use of wood instead of metal. Tony Sebek motioned to approve E.R.
Thompson's request to allow the use of wood studs with 5/8" drywall in a totally
sprinklered area in the J.C. Penney Vision Center. Bruce Hacker seconded the motion
and the motion was approved with a 5-0 vote in favor.
