BOARD OF APPEALS
City of Cape Girardeau
P.O. Box 617
Cape Girardeau, MO 63702-0617
October 9, 1997
The Board of Appeals met Thursday, October 9, 1997 at 7:00 p.m. in the Council Chambers, City
Hall, 401 Independence St.
Members Present:
Dave Alberson, Ralph Maxton, Dave Pfeiffer, Tony Sebek,
Bruce Hacker
Members Absent:
Farris Nabors, Leonard Henson, James Arnzen (alternate)
Call to order at 7:00 p.m. by Tony Sebek, Chairman.
Roll call.
Upon motion made, the minutes of the July 17, 1997 meeting were unanimously approved.
Appeal Requests:
Greg Sacks of Access Lifts and Elevators, Inc., representing Cape Bible Chapel, requested
variance from ANSI A117.1 Part 25 to install a Limited Use/Limited Application (LULA)
elevator in a church addition at 2911 Kage Road and to vary the maximum travel distance
of that elevator from 25' to 28'. The applicant waived his right to a vote by a full Board.
There were five (5) out of the seven board members present. It was noted that a LULA
elevator does not offer fire service (no call button). However, it does operate on a battery
back up system which returns the elevator to the lowest level during a power outage. It was
also noted that the lowest level of the church does provide an exit. Ralph Maxton motioned
to approve the variance as requested. Dave Alberson seconded the motion and motion passed
with a 5-0 vote in favor.
Other Business:
Rick Murray reported on the recently released Insurance Services Office (ISO) report. The
Division of Inspection Services received a rating of "5" out of "10" with "1" being the
highest rating and "10" being the lowest.
