The Board of Appeals met Thursday, July 13, 1995 at 7:00 p.m. in the Council Chambers, City
Hall, 401 Independence St.
Members Present:
Dave Alberson, Roy Halbert, Ralph Maxton, Tony Sebek
Jim Arnzen (Alternate)
Members Absent:
Dave Pfeiffer
Call to order at 7:05 p.m. by Ralph Maxton, Chairman.
Roll call.
Upon motion made, the minutes of the June 8, 1995 meeting were unanimously approved.
Variance Requests:
Randy McFarland, representing Lt. Col. Ronald L. Benward, of the Missouri National
Guard, submitted an appeal request for variance from the 1993 BOCA Fire Code, Section
3207.0, Above Ground Storage Tanks, to install a 5,000 gallon mobile diesel fuel tank at
their existing facility located at 2626 Independence Street. Tony Sebek motioned to approve
the variance as requested with the stipulation that the fire department be notified at the time
of installation for an inspection. Dave Alberson seconded the motion and motion passed with
a 5-0 vote in favor.
Gary Semmler, representing the Dana Corporation, requested variance from the 1993 BOCA
Fire Code, Section 3207.0, Above Ground Storage Tanks, to install an above ground tank
at their existing facility located at 2075 Corporate Circle. The 4,000 gallon tank will hold
diesel fuel for their back-up generator. Tony Sebek motioned to approve the variance as
requested. Roy Halbert seconded the motion and motion passed with a 5-0 vote in favor.

Other Business:
City staff reported that the City Council approved the amendment to the 1993 BOCA
Building code, Section 121.2.1, membership requirements for the Board of Appeals and also
reappointed Dave Pfeiffer to the Board. Mr. Pfeiffer's term will expire June 4, 2000.
Upon motion made, the meeting adjourned at 7:20 p.m. The next meeting of the Board of
Appeals is scheduled for August 10, 1995.
