The Board of Appeals met Thursday, June 8, 1995 at 7:00 p.m. in the Council Chambers, City
Hall, 401 Independence St.
Members Present:
Dave Alberson, Ralph Maxton, Dave Pfeiffer, Tony Sebek
Members Absent:
Roy Halbert
Call to order at 7:30 p.m. by Ralph Maxton, Chairman (meeting was delayed due to severe weather
conditions).
Roll call.
Upon motion made, the minutes of the May 11, 1995 meeting were unanimously approved.
Variance Requests:
Lt. Col. Ronald L. Benward, of the Missouri National Guard, submitted an appeal request
for variance from the 1993 BOCA Fire Code, Section 3207.0, Above Ground Storage Tanks,
to install a 5,000 gallon mobile diesel fuel tank at their existing facility located at 2626
Independence Street. However, Lt. Benward was not in attendance due to the severity of
the weather. The hearing was therefore continued to the July 13 meeting.
Other Business:
Tom Hinkebein, Fire Marshal, was in attendance and discussed with the Board the adequacy
of the current code concerning above ground tanks. Hinkebein stated that the code was doing
was it was intended to do and that some in some areas, such as the floodplain, there is little
alternative than to install above ground tanks. He attested that case by case variances was
000) the proper method of handling the situation.

Upon motion made, the meeting adjourned at 7:45 p.m. The next meeting of the Board of
Appeals is scheduled for July 13, 1995.
