The Board of Appeals met Thursday, April 13, 1995 at 7:00 p.m. in the Council Chambers, City
Hall, 401 Independence St.
Members Present:
Dave Alberson, Roy Halbert, Dave Pfeiffer, Tony Sebek
Alternate: Jim Arnzen
Members Absent:
Ralph Maxton
Call to order at 7:00 p.m. by Dave Pfeiffer, Chairman.
Roll call.
Upon motion made, the minutes of the February 9, 1995 meeting were unanimously approved.
Variance Requests:
Phil Penzel, representing Ryder Truck Rental, requested variance from the 1993 Fire Code,
Section F3207.1, Above Ground Storage Tanks, for storage tanks to be built on their lot
located on Southern Expressway. The Fire Code restricts the amount of combustible liquid
stored in above ground tanks to 660 gallons and 6,000 gallons for motor fuels. Ryder
requested permission to install: (1) 12,000 gallon double walled UL rated diesel fuel tank,
(1) 1000 gallon double walled UL rated bulk oil storage tank and (1) 500 gallon double
walled UL rated waste oil tank. Tony Sebek motioned to allow the above ground tanks be
installed based upon the provision that they meet all other requirements set forth by the fire
marshal and provided they meet pre-plan approval by the Fire Marshal. Dave Alberson
seconded the motion and motion passed by a 5-0 vote.
Other Business:
Tim Singleton of Star Communication approached the Board with a problem on a building
project at 2911 Bloomfield. Mr. Singleton would like to hook up a proposed accessory
building to the existing sewer line of the main building, which City ordinance prohibits. The
Board discussed his options but advised Mr. Singleton that the Board of Appeals does not
grant variances to city ordinance.

Upon motion made, the meeting adjourned at 7:45 p.m. The next meeting of the Board of
Appeals is scheduled for May 11, 1995.
