The Board of Appeals met Thursday, February 9, 1995 at 7:00 p.m. in the Council Chambers, City
Hall, 401 Independence St.
Members Present:
Dave Alberson, Roy Halbert, Ralph Maxton, Tony Sebek
Members Absent:
David Pfeiffer
Call to order at 7:00 p.m. by Ralph Maxton, Vice-Chairman.
Roll call.
el) Upon motion made, the minutes of the November 10, 1994 meeting were unanimously approved.
Variance Requests:
Ron Humphries, Capaha Construction, requested variance from the 1990 BOCA
Building Code, Section 1002.9, Fire Suppression Systems, Use Group R-2, for the
remodeling of a 4 unit apartment building located at 904 Themis Street. Mr. Humphries
requested that the building be exempted from the required sprinkler system since the 1993
BOCA Code, Section 904.9, currently under consideration for adoption, exempts this
building from a sprinkler system. After discussion, Mr. Humphries withdrew his request.
He will resubmit the building plans to the city to be reviewed completely under the 1993
Building Code after its adoption.
Vernon (Pee Wee) Rhodes requested variance from Table 501 of the 1990 BOCA Building
Code (Use Group H3, Type 3B construction), Height and Area Limitations of Buildings, for
an addition to the Plaza Tire Building located at 2149 William Street. Mr. Rhodes requested
that the addition be built with a roof height to match that of the existing building, which is
20' 11 1/2". Table 501 of the 1990 BOCA Code limits the roof height to 20'. Roy Halbert
motioned to grant the variance as requested, Tony Sebek seconded the motion and motion
passed with a 4-0 vote.

Other Business:
Rick Murray apprised the Board that the City Council approved the 1993 BOCA Codes with
all but one of their recommended amendments, at their February 6, 1995, meeting. The
amendment not approved dealt with automatic adoption of the BOCA Codes. The 1993
Codes will become active February 17, 1995. It was suggested that the Board review the
BOCA amendments as they are released rather than waiting to review new codes as they are
published.
Upon motion made, the meeting adjourned at 7:45 p.m. The next meeting of the Board of
Appeals is scheduled for March 9, 1995.
