fl Variance Requests:
In a variance request by Ms. Sarah Hale, for her business
located at 817 Broadway, from Section 703 . 2 of the Building
Code, Section P306. 1 of the Plumbing Code and Section M1604 . 1
of the Mechanical Code, which requires public bathrooms to be
ventilated by natural or mechanical ventilation, Sebek
motioned to table the request until the November 14 , 1991
meeting at which time Ms. Hale will provide verification on
at least three contractor bids for the work required to bring
the ventilation system up to code. Halbert seconded the
motion, all voted in favor and motion passed.
In a variance request submitted by Thomas Holshouser for the
Municipal Airport Terminal, from the Building Code, Section
601. 0 and Subsection 601. 11 on Smoke Control, it was
determined that City staff may have the authority to make the
decision under Art. 32 of the BOCA Code and/or under the
exceptions listed in Section 601. 1. Sebek motioned to table
the request for further evaluation by the City staff. If,
after further revaluation, the City staff determines that the

the word "platform" be changed to "step. " Murray was
instructed to proceed with the mail-out upon making the noted
change.
Roy Halbert requested that Murray also send out a memorandum
to area mechanical contractors reminding them that the use of
copper pipe and tubing is not allowed in Cape Girardeau, per
the amendments to the 1990 Mechanical Code adopted by the City
Council.
The Board discussed with Murray and Steve Williams the Minimum
Residential Property Maintenance Standards submitted to the
Board by the City Staff. These standards, currently used in
the Neighborhood Block Grant Program, were given to the board
as a guideline for adopting a set of standards for the City.
Williams noted that these standards require the minimum
maintenance on residential properties, maintaining health and
life-safety standards. Sebek expressed his concerns about
enforcing a maintenance code on home-owners (non-rental
properties) . Two suggestions presented were: establish one
code for rental properties and another code for home owners;
if one code is adopted, address rental and personal properties
separately.
The Board postponed further discussion on the Minimum
Maintenance Code until the November meeting.
Upon motion made and passed, the meeting adjourned at 9: 26
p.m. The next meeting of the Board of Appeals is scheduled
for November 14 , 1991.
Respecfully Submitted,
