Regular Session March 20, 2023 LL-267 STUDY SESSION—March 20,2023 NO ACTION TAKEN DURING THE STUDY SESSION The Cape Girardeau City Council held a study session at the Cape Girardeau City Hall on Tuesday, March 20, 2023, starting at 5:00 p.m. with Mayor Stacy Kinder presiding and Council Members Mark Bliss, Robbie Guard, Dan Presson, Tameka Randle, and Nate Thomas present. Shannon Truxel was absent. REGULAR SESSION—March 20,2023 CALL TO ORDER The Cape Girardeau City Council convened in regular session at the Cape Girardeau City Hall on Tuesday, March 20, 2023, starting at 6:34 p.m. with Mayor Stacy Kinder presiding and Council Members Mark Bliss, Robbie Guard, Dan Presson, Tameka Randle, and Nate Thomas present. Shannon Truxel was absent. ADOPTION OF THE AGENDA A Motion was made by Robbie Guard, Seconded by Dan Presson,to approve and adopt. Motion passed. 6-0.Ayes: Bliss, Guard,Kinder,Presson, Randle,Thomas.Absent: Truxel. CONSENT AGENDA Approval of the March 6,2023, City Council regular session minutes. BILL NO. 23-30, an Ordinance amending Chapter 30 of the Code of Ordinances of the City of Cape Girardeau, Missouri, by changing the zoning of property located at 2403 South Sprigg Street, in the City and County of Cape Girardeau, Missouri, from M-2 to AG. Second and Third Readings. BILL NO. 23-31, an Ordinance granting a Special Use Permit to Walmart Real Estate Business Trust for the purposes of placing, using, and maintaining a shipping container at 3439 William Street, in the City and County of Cape Girardeau,Missouri. Second and Third Readings. BILL NO. 23-32, an Ordinance approving the record plat of Bertrand Subdivision. Second and Third Readings. BILL NO. 23-33, an Ordinance authorizing the acquisition of Temporary Construction Easements and Permanent Drainage Easements from various property owners for the Sherwood Drive / Hood Drive / Brookwood Drive Drainage Improvements Project, in the City of Cape Girardeau, Missouri. Second and Third Readings. BILL NO. 23-34, an Ordinance accepting a Collector's Deed from Cape Girardeau County for property located at 416 Second Street, in the City of Cape Girardeau,Missouri. Second and Third Readings. BILL NO. 23-36, a Resolution Adopting the 2023-2028 Capital Improvements Program, in the City of Cape Girardeau,Missouri. Reading and Passage. BILL NO 23-37, A Resolution Authorizing the City Manager to execute an Agreement with Bacon Farmer Workman Engineering & Testing, Inc., for Cape Rock Drive Sidewalk Project Phase I for Pedestrian Improvements in the City of Cape Girardeau, Missouri. Reading and Passage. BILL NO 23-38, a Resolution Authorizing the City Manager to execute an Agreement with Bacon Farmer Workman Engineering & Testing, Inc., for Cape Rock Drive Sidewalk Project Phase II for Pedestrian Improvements in the City of Cape Girardeau, Missouri. BILL NO. 23-39, a Resolution authorizing the City Manager to execute a License and Indemnity Agreement with Cape Auto Sales, LLC, for parking lot improvements at 1230 Meadowbook Lane, in the City of Cape Girardeau. BILL NO. 23-40, a Resolution authorizing the City Manager to execute an Agreement with Southeast Missouri State University for the 2023 Historic Resource Survey, in the City of Cape Girardeau, Missouri. Reading and Passage. Approval of the preliminary plat of Strawberry Fields Subdivision. A Motion was made by Mark Bliss, Seconded by Tameka Randle,to approve and adopt. Motion passed. 6-0. A Motion was made by Dan Presson, Seconded by Tameka Randle,to approve. Motion passed. 6-0. Ayes: Bliss, Kinder, Presson, Randle, Thomas. Absent: Truxel. Abstain Guard. Council Member Robbie Guard abstained, due to his employment with MRV Bank. BILL NO. 23-42, an Ordinance approving the record plat of Hotty Toddy Court Subdivision. BILL NO. 23-44, an Ordinance to enable the City of Cape Girardeau to join the Missouri Clean Energy District Pursuant to the Property Assessment Clean Energy Act of Missouri. First Reading. The Mayor called for public appearances regarding this Bill.No one appeared. A Motion was made by Robbie Guard, Seconded by Tameka Randle,to approve. Motion passed. 6-0.
