CITY ATTORNEY REPORT
 June, 1986
 PENDING LITIGATION
Tax Protest Lawsuits : Motions to Dismiss these lawsuits
were heard on June 9 , 1986 by Judge Grimm and on June 23 , 1986
by Judge Seier . The issues raised in these lawsuits are being
litigated state wide. Since the total dollar amount involved
in Cape Girardeau County is relatively small , it is likely that
no action will be taken on these cases until the Supreme Court
decides the issues .
Westborou h Mall Case: On June 17 , 1986 the Eighth Circuit
Court of Appea s reversed the judgement of the District Court
and remanded the case for a new trial . On June 27 , 1986 the
Court granted the City and private developers until July 11 ,
1986 to file a Petition for Rehearing.

MONTHLY ACTIVITY REPORT
 Month of June, 1986
 NARRATIVE SUMMARY
Most of the month of June was consumed making the conversion of
the City' s financial management system to the new computer.
This conversion included the estabiishment of the new accrual
accounting system with a new chart of accounts, accounts
payable, utility billing, and payroll. Over 150 hours of
overtime was required to implement this conversion. The first
month ' s calculation and printing of 13,000 utility bills was
completed on schedule on June 30, 1986 .
A meeting was held with all department heads and various staff
members to review the approved budget amounts, new chart of
accounts, various purchasing problems, and new payroll
procedures. Additional meetings with individual department
staff will be scheduled in the coming months to review specific
line-item appropriations and line-item accounts that have been
 established.
Leslie Stubenrauch left the department to take a job as a
regional sales tax auditor for the State Department of
Revenue. Marlena Conner was employed on a full-time basis to
assist with the new utility billing system. Tom Pridy' s role
has expanded to include responsibility for overseeing the
 business license administration.

investment period to the next. ) In December, 1985, the Finance

 CITY OF CAPE GIRARDEAU
PARKS AND RECREATION DEPARTMENT
 MONTHLY REPORT
Month of June, 1986
 NARRATIVE SUMMARY
June is traditionally one of the busiest months for the
Department and this month is no exception. The extreme heat and
lack of rain has been both a problem and a blessing. The
weather has allowed us to catch up on our mowing time that was
lost immediately after last month ' s flood . However,
maintenance equipment breakdowns continue to be a serious
problem.
The hot weather has also increased or kept constant pool
attendance. Despite the temperatures, the recreation programs
continue to do well. The weather has had its heaviest toll on
the golf course. The intense heat and lack of rain has left
most fairways brown and hard.
 AQUATIC - CAPAHA POOL
The Parks and Recreation Department 's swimming courses started
June 16th with an attendance of 1,504 .
Kiwanis and Jaycees are using Capaha from 10 a.m. to 1 p.m. for
their swim program. They conduct four sessions during this
period, Monday through Thursday. The City receives no revenues
from these programs (i .e. , rental fee or participant fee) . All
funds are collected and used by the sponsor group.
Our new parent/child swim program on Friday and Saturday from
9 a.m. to 11 a.m. has proven to be very popular with an
approximate daily attendance of 36 at Capaha Pool.
 A UATIC - CENTRAL-MUNICIPAL POOL
The Department 's swimming classes started June 16th with an
attendance of 2,790 . The Jaycees use the baby pool from 9 a.m.
to 12 noon, Monday through Thursday for no fee to conduct their
 swim classes.
On June 27, a Sikeston Youth Group rented the pool for a
private party.
The Cape Gators hosted a swim meet on June 25th with Poplar
Bluff, Farmington and Jackson.
The City held its annual "Fun Day" races on June 28, from 11
a.m. to 12 noon.

A problem developed this month with our chlorine feeding
system. A pressure test was run on the line and no blockage
was found, suggesting that there is a break in the feeder line
running under the pool deck from the bathhouse area to the
filter pit. Delta Engineering has been contracted to determine
how we might best remedy the situation. We are presently
feeding the chlorine to the pit through the automatic feeding
system monitoring hose. This means that automatic pool water
quality can no longer be read through the system.
 CEMETERY
This month brought hot dry weather. Slowing down the grass
growing and allowing us to do some of the things that have
needed attention, such as tree trimming, cemetery cleanup and
mowing of the large fields. The month also brought the removal
from service (deadlining) of some of our equipment by the Fleet
Management at the City Garage. Deadlined were two of our three
push mowers and two of our three trim mowers. No money has
been allocated for replacements thus requiring the Park
Division to reduce its fleet of mowers to cover the Cemetery
Division. One of our riding mowers has been in the shop for
two months awaiting parts. The other rider has been in the
shop at least one week each month. With the City Garage ' s
present policy of deadlining old equipment that they feel to be
too costly for repairs, without consideration of allocations
for replacement, our problems will worsen.
June was a slow month for burials in the cemeteries . Having
only five burials and selling only one grave plot.
With the rate of selling of grave plots in recent years, the
cemetery will be void of grave spaces in approximately eight
(S ) to ten (10 ) years. There are about 625 plots in new
Lorimier and about 380 or 765 plots in Fairmount. Depending on
the planned acquisition by Union Electric of one 100 x 250 foot
section of Fairmount Cemetery. We could lose 385 or more grave
plots and would require the moving of approximately 40 deceased
persons.
 GOLF, - MAINTENANCE
In June we completed extensive drainage work on Fairway #17 .
We continued to have problems with our present irrigation
system this month.
We began spreading dirt over the new lake dam and preparing the
soil for seeding.

All tees were s ri ed with Bermud r
p gg a g ass to repair damage
caused by using them as winter greens last season.
In an effort to enhance course revenues, we ailowed outside
groups to host tournaments on the course. Tournaments were
held by the Cape Elks and Rumors Night Club.
GOLF - PRO SHOP
The Golf Course has finaily settled in with their summer help.
Petunias were planted out front to help beautify the pro shop
entranceway.
We started the month off with an unexpected tournament by the
Elks Club; surprisingly enough, it ran well. We had about 72
people. We had another tournament on the 27th of June. It was
sponsored by Rumors Night Club. It didn't run as smooth as we
had expected. There will be a few more tournaments before the
summer is over and we are getting better at administering them.
The pro shop has been researching the possibility of getting a
new cash register or adding another unit to the one we have; an
up-to-date register would help with the inven{ory and cash
accounting.
Another planned acquisition is a new safe. The new safe would
enable the workers to place their deposits in the safe at the
end of each shift. This would eliminate a nightly trip to the
 bank and improve security. .
PARK - ARENA BUILDING
The Arena this month had three events that were re-scheduled
from the flood in May which were: the Jehovah Witnesses, SEMO
Area on Aging, and the Exchange Ciub Dance.
On June 4th, the Parks and Recreation Department held their
annual signup for the Summer Recreation Program, Kiwanis Swim
and Jaycee Swim at the Arena Building. The Recreation
activities that are held in the Arena Building Monday through
Thursday of each week are the Youth Choir and the Adult
Aerobics.
The annual Southeast Missouri Dog Show, Antique Flea Market and
the Cristy Lane Concert brought many out-of-town people to Cape
 this month.
PARK - MAINTENANCE
The first half of the month we continued working on flood
cleanup and intensified our mowing schedule due to the large
amount of precipitation received during this period. Our
mowing is still hampered by equipment breakdown resulting from
 .

the flood, however, by the end of the month we were getting
caught up on our mowing. The two major projects this month were
the installation of new playground equipment in Arena Park and '
preparation of Riverfront Park for Riverfest. Over 700 man
hours were spent on the playground installation and 160 man
hours and 15 truck loads of materials were used for the
Riverfest preparation. Ball field maintenance was also
intensive this month with many weekend rainout games scheduled.
 RECREATION
The month of June has been a busy one in the Recreation
Division. We started the month with the first day of
registration for the Summer Recreation Programs. On that day,
we enrolled a totai of 2,514 people in all programs . Since
that time, the enrollment has climbed to 2,659 in all programs,
all sessions . In addition to taking enrollment for all our
classes, we have taken enrollment for the Cape County Jaycee
swim lessons and the Kiwanis swim programs.
The first session of the Summer Recreation Program has run very
smoothly and all staff inembers are working out well and seem to
 enjoy what the are doing.
A great deal of time and energy was put in the 1986 Riverfest
of which the Parks and Recreation Department is a sponsor.
Superintendent Barringer was in charge of the childrenS -
activities for the affair.
Plans were finalized and the Third Annual City Employee ' s Fun
Day was held in June. The events took place on 2 evenings and
all day Saturday with approximately 300 employees
participating. (The Police Department's domination of the last
2 years was crushed by the run away victory of the Parks and
Recreation Department. ) Time was also spent on the planning
and implementation of one rather large and one small golf
tournament at the Golf Course and meetings with the Sports Fest
' 86 Planning Committee.

 WASTE DISPOSAL
MONTHLY REPORT
 Month of June, 1986
 NARRATIVE SUMMARY
Most operations in residential and commercial routes were
normal for the month. Preparation and cleanup efforts for the
Riverfest required several extra manpower hours but employees
did a very good job handling the sanitation problems for this
project.
Flood damage cleanup on adjoining property was started this
month at the landfill. It is anticipated that 4 to 6 weeks
will be needed to completed this project. The amount of flood
damaged items coming into the landfill this month and the last
part of last month has shortened life expectancy considerably.
Over 8 ,100 extra cubic yards of just flood damaged items have
been taken in since May 16, 1986 .

CITY OF CAPE GIRARDEAU
 TRANSIT PROGRAM
Month of June, 1986
 NARRATIVE SUMMARY
During the month of June, the City of Cape Girardeau provided
6, 027 taxi rides. For the month of June, the City will receive
a reimbursement from the Missouri Highway and Transportation
Department of $3,695. 62 .
The taxi coupon transportation services bid was awarded in June
to Kelley Transportation Company, the present contractor. The
1986-87 Fiscal Year contract with Kelley calls for a 25
increase per coupon over last year ' s price.
Also during June, the City Council also gave second and third
readings to the ordinance authorizing the City Manager to enter
into a grant agreement with the State in order that the City
may receive Section 18 funds to help defray the costs of this
 program.
Finally, the City' s annual coupon redemption program was
advertised thoroughly through news accounts and paid
advertisements . The City' s coupon redemption program began
three years ago to prevent the elderly and handicapped, who are
generally on a fixed income, from losing any money on any
unused expired coupons. The City, under this program, redeems
unused expired coupons for new transit coupons at the beginning
of each fiscal year.

MONTHLY REPORT
PERSONNEL
 Month of June, 1986
 NARRATIVE SUMMARY
During the month of June, interviews were conducted for five
vacant police officer positions. Seventeen applicants were
interviewed by the Assessment Board. Of that seventeen, four
applicants were eliminated from further consideration by the
Board. The other thirteen applicants were approved by the
Board to continue in the Probationary Police Officer Assessment
process. Because of the large number of applicants cleared by
the Assessment Board, however, we have had to limit the number
of applicants that will take the next series of tests to the
top eight scoring applicants . The next series of tests these
finalists will complete are the polygraph, psychological, and
medical examinations. In mid July, the five best applicants
out of the eight finalists will be appointed as Police Officers
for the City of Cape Girardeau Police Department.
In June, the City also accepted applications on two positions
at City Hall. These positions are a Cashier for the Finance
Department and Secretary for the City Manager ' s Office.
Interviews should be conducted for these positions in early
July. Appointments to these positions should be made later in
that same month.
Also in the month of June, the City appointed its new Golf
Course Superintendent and Assistant Golf Course
Superintendent. Paul Cline was appointed to the position of
Golf Course Superintendent. As you know, Paul has served the
Cape Girardeau Jaycee Municipal Golf Course extremely well for
several years as Assistant Golf Course Superintendent and in
several other capacities. To replace Paul in the Assistant' s
position we have apointed Joseph Herzog, who is currently
serving as the Assistant Golf Superintendent of the A.L. Gustin
Course on the campus of the Univeristy of Missouri, Columbia.
Mr. Herzog holds a B. S. Degree in agriculture with an emphasis
in turf management from the University of Missouri. It is
believed that with the combination of skills and ex rience of
these two men, they should provide a solid manageme team r
one of the City' s most important asse
