 CITY ATTORNEY REPORT
March 1984
 PENDING LITIGATION
Westborough Mall, Inc. v. City: Plaintiffs filed their Notice of
Appeal on March 5 , 1984 . The City filed a Notice of Appeal on
the issue of attorneys ' fees on March 19 , 1984 . Under the normal
briefing schedule Appellants ' brief would be due in late May and
our brief would be due in late June. However, because of the
length of the transcript and complexity of the issues, I would
expect some considerable delay in this case.
Union Electric Rate Case : The City filed its Application to
Intervene in this case on March 22 , 1984 . Efforts are being made
to coordinate our opposition to the proposed rate increases with
 other Missouri cities.

CITY
 OF
CAPE GIRARDEAU
POLICE DEPARTMENT
 MONTHLY REPORT
MARCH, 1.984
 NARRATIVE SUMriARY
In early March, 1984, Lt. Shannon ['. Kelley, Station Commander, submitted request
for retirement following nearly 35 years of active service. Lt. Kelley will begin
terminal leave April 1, 1984 with the retirement date effective May 1, 1984.
On Friday, March 23, 1984, at 11:35, the first fatal accident for the calendar year
1984 occirred at the intersection of Independence and test End Blvd. In the acci-
dent a 23 year old Cape Girardeau resident, Jamie Denise Werner, was driving south
on West End Blvd. , and apparently disobeyed the traffic signal at the intersection,
and was struck broadside by a west bound vehicle operated by Ricky Joe Long, age
23, of Cape Girardeau. Mr. Long was charged in state court with driving while
 intoxicated.
March lOth marked the first of six sobriety checkpoints funded by the Missouri
Division of Highway Safety. Our checkpoints are aimed at removing intoxicated
drivers from our city streets. The local effort is part of a nation-wide program
to reduce the number of alcohol related accidents and fatalities.
On March 6, 1984, department members attended the annual Weather Spotters program
conducted by the Cape Girardeau County Emergency Disaster Center and the St. Louis
deather Bureau. In conjunction with the program, the Department participated in a
state-wide tornado drill on March 14, 1984. During the exercise, the Department
conducted a simulated personnel recall, and notified local hospitals, day care
centers, and schools of the drill alert.
On March 20, 1984, members of the administrative staff and Traffic Division attended
a program sponsored by the Tlissouri Department of Highway Safety on Missouri's new
Child Safety Restraint Law. The program was highly infoative, and officers are
making an effort to enforce provisions of the law.
In March, 1984, the Cape Girardeau Police Department Annual Report was completed
and distributed to local media and city government officials. The new Department
Written Directive rianual, a product of a two-year revision program was completed,
assembled and distributed to Department officers. The manual streamlines policy
 and procedure in the Department.
The Emergency Operations Plan, a long-term city-wide project, was completed and
is currently being assembled in binders for distribution. The manual is a compre-
hensive guide to emergency disaster recovery efforts, and will be of great future
value in case of a wide variet} of emergency situations.
March was again a busy month for the Cape Girardeau Police Department Crime Preven-
tion Program. Crime Prevention officers again participated in a 30 minute talk show
on the Neighborhood Watch Program on Channel 10, Cable access. On March l, and
again on March 8, participated in a program on vacation tips to lessen the risk of
burglary. The Crime Prevention Officers also participated in the Southeast Missouri

Homebuilders Show at the Arena Building on Marcli 9, 10, and 11, and offered informa-
tion, brochures and tips to interested homeowners on the importance of burglary and
 loss prevention.
On March 27, the Crime Prevention Officers participated in a city-wide Neighborhood
Watch Program at Central High School resulting in eighty-five new members joining
the program.
On Wednesday, March 22, the Cape Girardeau Police Department staged a mock bank
robbery as a training exercise for the employees of the Centerre Bank. The exercise
was conducted after normal working hours, and in graphic realism displayed the chain
of events occurring during an actual armed robbery. The program was presented in
1983 at the Boatmen's Bank with similar success.

NARRATIVE SUMMARY
The activity sheet for this month again reflects the ffects the severe winter
has caused to our gravel streets and alleys. This problem will most likely
exist until the spring rains are over. The 53 cubic yards of concrete noted on
the statistics sheet were used at 1.4 different locations. These were street
patches which also required concrete removal. The amount of curb miles swept
were again low due to excessive rainfall, which also impeded other activities.
We have started our ditch cleaning operation which will be in effect as long
as weather conditions will permit. Alterations in the vehicle washroom have
begun and should be beneficial to the department and shop. We also hauled
gravel from West Lake Quarry at Neely's Landing to the landfill March 6th and
7th totaling 228.80 tons. This gravel was again applied to the all-weather
road leading to the landfill.

Waste Disposal
 Month of March, 1984
NARRAT I V E S U1IMARY
There were an unusual number of commercial concellations for the month of March,
1984. Some of these were due to business relocations out-of-town, but most
were due to the businesses closing and not re-opening such as Broadway Theatre
and Chase Cafeteria.
There were also a large number of special time charge pickups for this month.
Most of these were due to the commercial cancellations and new businesses
opening up.
At our present Landfill this month, a dragline excavation was attempted in
order to enlarge our disposal area. The dragline equipment was unable to
perform the required task and a different excavation operation with D-8's
and scrapers will be starting soon. The unusually wet weather is hampering both
the new excavation and normal Landfill operatio s.

CITY OF CAPE GIRARDEAU
 Department of Parks and Recreation
Month of March 1984
 NARR.ATIVE SUMMARY
This has been a very busy month for us at the Park Department
preparing for our active season ahead, activities such as hauling
dirt when possible for ball diamonds and preparing soccer fields.
There was considerable damage to trees in our parks due to the
hard winter and storms. We have also had a lot of water line
leaks and sewer problems that we discovered when reopening the
restrooms. The new Riverfront Park was finished. Because of
high water post and hand rails at the park were removed.
March is always an extremely busy month of activities at the
Arena Building. There was only 3 days that the building was not
in use. The approximate attendance was 50, 276 compared to 6, 334
last month.
We conducted three tours at the Airport for school children. Had
snow removal for several days. Repaired one water line due to
the cold weather. We now are trying a new custodian at the
airport due to the sudden illness of our regular custodian, who
will be off for six weeks.
The Recreation Department held it' s regular scheduled classes
with the exception of one week off due to spring break, when many
of the employees who are college students were gone.
The Gold Course had a bad month due to the snow and rain. The
course was completely closed for 9 days compared to 2 days last
year in March. There were no carts rented at all due to the wet
grounds this month compared to 18 days where carts ran in March
1983 . Therefore the revenue for this month was low.

 DEPARTMENT OF PUBLIC WORKS
Sewer Division
 Month of March, 1984
 NARRATIVE SUMMARY
Sewer System:
Much of the time in March was spent at 4 lift station. One pump was pulled to
be repaired, three check valves were completely overhauled, six gate valves were
disassembled and cleaned. March 26 when Walnut & Henderson grit station was
checked, it had been vandalized over the weekend. Rocks had been thrown at the
control panel and rocks were in the auger, damaging a hanger. One switch on the
control panel had to be replaced by an electrician. The auger bearing hanger
had to be replaced. The grit classifier at College & Henderson grit station
was painted in March.
 Wastewater Plant :
Trickling filter nozzles were all removed and steam cleaned on the 5th. Acid
cleaned the drains on the south coilfilter tray. Repaired influent automatic
sampler suction line. Installed bottom bearing plate on north screw pump. The
plant flood pumps were turned on March 6th because of the Mississippi River
rising above the gravity outfall line, turned them off March 9th. Flood pumps
turned on again March 20th and they remain on at March 31st.
