 CITY ATTORNEY REPORT
December, 1984

PENDING LITIGATION
Westborough Mall v. City: Appellants were granted a final
extension for filing their brief. The brief is now due on
 January 9, 1985 . .
Eric Russell v. City of Cape Girardeau : An answer was
filed in this suit by a twelve year old boy for injuries
allegedly sustained at the College and Henderson Grit Station .
Meyer et al . v. Tooke et al . : Judge Seier declined to
issue a preliminary order in mandamus in this lawsuit to compel
the City to hold an election on the location of the multi-use
center on property owned by the University.
Missouri Pacific Railroad Company Proposed Abandonment of
Cape Girardeau Subdivision: On December 10, 1984 the City
filed written comments and protest with the Interstate Commerce
Commission concerning the proposed abandonment by Missouri
Pacific of 3. 3 miles of the Cape Girardeau Subdivision of the
railroad ' s line . A number of businesses along the line have
also protested abadonment of this line. The Missouri Highway
and Transportation Department submitted a statement in
opposition to the proposed abandonment. The City and
businesses cite the adverse impact on existing businesses and
jobs within the City and the adverse impact on potential future
industrial development in the City. The Highway and
Transportation Department, in addition to the economic
arguments, challenges the figures the railroad has provided on
the cost of rehabilitating the line . On December 28, 1984 the
Commission made the proposed abandonment the subject of an
 investigation.
Ricky Dean Burton : On December 27, 1984, a coroner 's
inquest was conducted in the matter of the shooting death of
Ricky Dean Burton by a police reserve officer at Southeast
Missouri Hospital . The jury ruled that the shooting was
justifiable homocide . The evidence indicated that Mr . Burton
had pu.led pocket knife and was advancing on the officer who
shot and killed Mr . Burton in self-defense .
Cape Motor Lodge, Inc. , et al . v. City, et al . : This
lawsuit was filed on December 26, 1984 by a number of
corporations and individuals challenging, on various grounds,
the validity of the bond election, the bond ordinance, the
license tax on gross receipts of hotels , motels and restaurants
and the authority of the City and University to cooperate in
building and operating a multi-use center .

 CITY OF CAPE GIRARDEAU
POLICE DEPARTMENT MONTHLY REPORT
 Month of December, 1984
 NARRATIVE SUMMARY
The eight police officer recruits who graduated the academy in
November completed their field training this month and have
been placed on active duty with the patrol force. With this
additional manpower now available, our department still remains
two officers short of this authorized strength. However, we
have begun the initial phase of our recruitment selection
process. Our efforts will be directed toward the recruitment
of lateral entry candidates, those having completed the State
Mandated training and currently certified by the state of
Missouri as active police officers .
In May of 1984 , the Police Department, in conjunction with the
Southeast Missourian newspaper, established a crime watch
program. Under this program, select crimes are highlighted in
the newspaper and a public plea is made for anyone having
information regarding the crime to come forward. A tip-line
was established at the Police Department and a method of
anonymously reporting information made available through the
newspaper. Based on the severity or magnitude of the crime, a „
monetary reward is offered to those persons providing
information. On December 6, two persons, one a city employee,
became the first recipients of a reward for information
provided, which led to the recovery of numerous banners that
had been stolen from the downtown district.
Our department has received the IBM II Computer through the
Highway Safety Grant. Primary use of the computer will be to
automate our traffic files, but sufficient capacity should
remain for other administrative and operational programs.
Administrative Assistant Juanita Henley and two other clerical
employees attended a two-day training session at Central
Missouri State University, Warrensburg, on use of the computer
and its programs. Currently, we are building the street code
for the program which is expected to be completed sometime
during the month of January.
Other personnel matters included one dispatcher attending the
Basic Communications School at the Highway Patrol Academy,
Jefferson City, Missouri ; a second dispatcher, during December,
completed her on-the-job training and is now serving at full
capacity. One officer resigned during the month to accept
employment with the St. Louis County Police Deartment, the
second to do so in recent months.
On December 20, the University of Missouri , Columbia, and the
Western Missouri District of the U. S. Marshal ' s Office,
conducted a one-day homicide crime scene investigation seminar
at the Holiday Inn, here in Cape Giradeau. Fifteen officers

from this department, including all department evidence
technicians, attended the seminar.
While all the statistical data is not in at this writing, it
appears that overall crime decreased appproximately 2 in the
City of Cape Girardeau during 1984 . The category of assault
reflects the largest single increase due, at least in part, to
change in the method of reporting and not necessarily an
increase in the number of actual assaults occurring. `•
Preparations are now under way to compi}-e he nnual report

FIRE DEPARTMENT
 MONTHLY REPORT
Month of December, 1984
 NARRATIVE SUMMARY
December 5 Responded to an alarm at Frederick/Morgan Oak. A
vacant building owned by Riverside Lumber Company
had a light ballast to burn out. The building
was being used for storage. An employee was
reporting for work at that building and smelled
 smoke.
December 5 Responded to the 900 block of North Sprigg. A
resident of the area smelled an odor of natural
gas. The leak was from the nearby Towers Complex.
Personnel from the Union Electric Company were
 notified of the leak.
December 7 Responded to 1554 Revlon. A circuit in the house
was apparently overloaded and had blown a fuse.
December 7 Responded to a request from Union electric that
we stand by while they repair a high pressure
(#50) natural gas line. The line had ruptured.
December 11 Responded to the Christ Episcopal Chruch at Themis
and Fountain. Neighbors of the area thought a
bucket setting on the lawn of the church may be
radioactive. This was found to be unfounded.
December 15 Responded to the Municipal Airport. A small
aircraft was approaching the airport with engine
problems. The fire department was cancelled
before arrival. The airplane had landed safely.
December 17 Extrication equipment was requested at Highland
Drive and N. West End Boulevard. A 1975 Chevy
driven by Mrs. Vera A. Jackson was involved in a
single auto accident. The automobile had to be
extricated from her person.
December 21 Responded to 555 N. Spring where heat tape used
on the plumbing beneath the house trailer had
 shorted out. Minor damage resulted.
December 28 Responded to an apartment house owned by Wright
Realty at 709 North Street. A tenant of the
apartment house smelled smoke. Investigation
by the fire department found that another tenant
had left a pan on a lit burner of the kitchen
 range.

Month of December, 1984
 NARRATIVE SUMMARY
During December we received five new Dodge police cars. One
150 4 x 4 pickup truck was also delivered. This unit adds to
the snow removal and sanding operation of the Street
Department. The 8 1/2 yard sander that fits on the back of the
tandem dump truck was put into operation this month. By
carrying bigger loads of sand and salt, this unit cut the cost
of one truck and operator to do the same amoun of work.

DEPARTMENT OF PUBLIC WORKS
 Waste Disposal
Month of December, 1984
 NARRATIVE SUMMARY
Our records for December again show an increase in new
commercial pickups for residential and commercial routes. For
the year, after deducting all cancelled and deleted stops, we
have averaged three new commercial pickups per month. The
number of lugger containers placed and Wednesday special
pickups is below normal due to the holidays and colder weather,
but the number of Special Time Charge pickups are still above
normal. The eight-inch snow the Cape Girardeau area received
on December 5, 1984 , resulted in Wednesday special pick-ups
being cancelled for that day, but did not pose a major problem
for normal route collection for the following Thursday and
Friday pickups.
The landfill report shows collection in cubic yards done by the
City at near normal but also shows a large increase in the
amount brought in by contractors, resulting in an increase in
average daily cubic yards received.
We are in the process of upgrading our all-weather road system
at the landfill. This will enable us to ease traffic
congestion and decrease unloading time for all vehicles using
the landfill in inclement weather.
Heavy rainfall and increased equipment downtime have again
caused a need for assistance from R.B. Potashnick Construction
Company to continue normal landfill operations.
An inspection made by the Department of Natural Resources and
forthcoming report may cause some problems due to lack of
sufficient intermediate cover in several areas of the
landfill. This cover material would have been applied if
weather had permitted, but like most landfills in the area we
were not able to. Plans for future application have been made
for as soon as weather does permit.

DEPARTMENT OF PUBLIC WORKS
 Sewer Division
Month of December, 1984
 NARRATIVE SUMMARY
Sewer System:
During December, a rebuilt motor was installed at Carolewood
package treatment plant. Sludge was pumped from San Dangaro
package treatment plant for disposal. The panel board controls
for #11 Woodland Hills lift station were vandalized and
reported to the police on the 12th. The panel was repaired by
an electrician.

Wastewater Plant:
During December, a permanent flood light was installed over the
influent sonar sensor to prevent frost and ice build up on the
sensor. The build up made the flow meter give incorrect
readings. Two new exhaust fan motors were installed on the
trickling filter pump station. Installed the following on the
new east primary clarifier: 80 flight wear shoes, drive chain
sprockets, drive chain idler sprockets, drive chains, auger
sprockets, auger chain, the bottom auger bearing and shaft.
Installed new seals on the bottom bearing of the north screw
pump. Installed 80 new flight wear shoes on the new west
primary clarifier. The above was done in addition to routine
cleaning, routine maintenance, checking of equipment, sludge
disposal, and laboratory testing.
