Gentlemen and ladies:

� The Planning and Zoning Commission met Wednesday, April 13,
;��� 2005. By majority vote, actual vote counted and in the file,we act and/or
'�'� recommend as follows:

T,�# l. That the request of Melissa Hazel to rezone 505 Oprimist Drive, from M-
i��`� ° 2,Heavy Industrial District to an R-1, Single Family Residenrial District
be recommended for approval. The vote for the motion to approve
was 9 in favor and 0 in opposition. Melissa Hazel presented the
request. Ms. Hazel stated that she needed the property rezoned for
� loan puiposes, as it is a residential house surrounded by other
residential housing. No other citizens appeared in regard to this
request.
2. That the request of Lorenzo and Alesha Martin for a special use permit
�' - for a childcare facility for up to 20 children at 411 South Ellis, located in
�` an R-3, Two-Family Dwelling District be recommended for approval.
�y The vote for the motion to approve was 9 in favor and 0 in opposition.
.,�. � � Alesha Martin, Lorenzo Martin and Lily Martin presented the request.
,�_ Lily Martin stated that they had previously had a childcare center on
� ° - '�� Sprigg Street, but the house was unsuitable for childcare so they
��` '` ±� bought the house at 411 S. Ellis which neighbors Alesha and Lorenzo's

' � . �; own house. No other citizens appeared in regazd to this request.

�� 3. That the request of Rhodes Properties,L.C. for a special use pemut for a
community unit plan at 1110 N. Cape Rock Drive, located in an R-2,
� Single Family Residenrial District be recommended for approval. The

vote for the motion to approve was 9 in favor and 0 in opposition. Bob
Uhrhan presented the request. Mr. Uhrhan stated that they had
contacted a11 the neighbors and nine (9) out of twelve (12) of them
attended a meeting they held regarding the community unit plan. Willis
Ford who lives about a half a block away from 1110 N. Cape Rock
�r�., � Drive spoke out in opposition stating that the area is zoned as single-
family residential and this plan would cheapen the neighborhood. �
Dwayne Black, 1158 Landgraf spoke out in opposirion stating that there
already were traffic problems starting in the morning and conrinuing
"" ' throughout the day on Lombardo from Southeast Missouri students. Bob

�'�� - - LJhrhan stated in response to Mr.Black's assertion that the driveway to the

proposed project was not on Lombardo, but on Cape Rock Drive only.
Truman Smith, 1161 Landgraf spoke out stating he was not so much in .
'� $; .��, opposition but had major concerns regarding the water and stormwater
� issues. Mr. Smith lives at the bottom of the hill and worries the new

#� houses will contribute to the current problem with water drainage and

sewer back-up. Bill Dunham, 1157 Landgraf spoke out in opposirion
stating that he does not wish to stop progress but he has concerns
regarding the value of neighboring property, and about the stormwater
" runoff problem. Bob Uhran replied in response that the Rhodes Group

understands the concerns and is willing to do all they can to make this
� work for all involved. No other citizens appeared in regazd to this

� 4. That the request of the City of Cape Girardeau for a special use permit for
�` a telecommunicarions tower at 2007 Southern Expressway located in an M-
2, Heavy Industrial District be recommended for approval. The vote for
the motion to approve was 9 in favor and 0 in opposition. Martha
Brown,Planning Services,presented the request.
5. T'hat the adoption of the Letter of Map Revision (LOMR) and new Flood
Insurance Rate Maps for Cape La Croix Creek and Walker Branch issued

by the Federal Emergency Management Agency March 3, 2005, and
effective Apri14, 2005, be recommended for approval. The vote for the
�� motion to approve was 9 in favor and 0 in opposition. Kent Bratton,

�,� 6. That the Rock Creek Meadows Townhouses Phase III,Record Plat be
��, recommended for approval. The vote for the motion to approve was
�� 9 in favor and 0 in opposition. No citizens appeared in regard to this
