Regular Session February 22, 2022 LL-47 STUDY SESSION—February 22,2022 NO ACTION TAKEN DURING THE STUDY SESSION The Cape Girardeau City Council held a study session at the Cape Girardeau City Hall on Tuesday, February 22, 2022, starting at 5:00 p.m. with Mayor Pro Tempore Robbie Guard presiding and Council Members Stacy Kinder, Dan Presson, Nate Thomas, and Shannon Truxel present. Shelly Moore and Mayor Bob Fox were absent. REGULAR SESSION—February 22,2022 CALL TO ORDER The Cape Girardeau City Council convened in regular session at the Cape Girardeau City Hall on Tuesday, February 22, 2022, starting at 5:14 p.m. with Mayor Pro Tempore Robbie Guard presiding and Council Members Stacy Kinder, Dan Presson, Nate Thomas, and Shannon Truxel present. Shelly Moore and Mayor Bob Fox were absent. ADOPTION OF THE AGENDA A Motion was made by Dan Presson, Seconded by Stacy Kinder,to adopt the Agenda. Motion passed. 5-0. Ayes: Guard, Kinder, Presson,Thomas, Truxel. Absent: Fox,Moore. APPEARANCES None. CONSENT AGENDA Approval of the February 7, 2022, City Council regular session minutes and of the February 14, 2022, City Council special session minutes. BILL NO. 22-22, an Ordinance approving the record plat of Deer Run Estates Phase 1. Second and Third Readings. BILL NO. 22-23, an Ordinance approving the Amended Final Development Plan for the Century Casino Planned Development District, located at 777 North Main Street, in the City and County of Cape Girardeau,Missouri. Second and Third Readings. BILL NO. 22-27, an Ordinance amending Chapter 30 of the Code of Ordinances of the City of Cape Girardeau, Missouri, by changing the zoning of the Shadow Wood Villas Subdivision, in the City and County of Cape Girardeau,Missouri, from PD to R-3. Second and Third Readings. BILL NO. 22-31, an Ordinance granting a special use permit to The Humane Society of Southeast Missouri, for purposes of constructing, maintaining, and operating shipping containers at 2536 Boutin Drive, in the City and County of Cape Girardeau, Missouri. Second and Third Readings. BILL NO. 22-24, an Ordinance appropriating the expenditure of Public Safety and CVB Funds for the fiscal year ending June 30, 2022, in the City of Cape Girardeau, Missouri. Second and Third Readings. Proceedings of the City Council, City of Cape Girardeau, Mo. Regular Session February 22, 2022 LL-48 BILL NO. 22-25, an Ordinance appropriating the expenditure of State Homeland Security Program Grant funds for approved grant expenditures, for the fiscal year ending June 30, 2022, in the City of Cape Girardeau, Missouri. Second and Third Readings. BILL NO. 22-26, an Ordinance authorizing and directing the issuance, sale and delivery of special obligation bonds, Series 2022, and approving certain documents and authorizing certain other actions in connection therewith. Second and Third Readings. BILL NO. 22-29, an Ordinance accepting two Permanent Access Easements and two Permanent Utility Easements from various property owners to service Touchdown Ridge 2, a Subdivision, in the City of Cape Girardeau, Missouri. Second and Third Readings. BILL NO. 22-30, an Ordinance accepting a Permanent Sanitary Sewer Easement from LC Realty, LLC, for property located at 3440 Lowe's Drive, in the City of Cape Girardeau, Missouri. Second and Third Readings. BILL NO. 22-32, an Ordinance accepting a Permanent Access Easement from Cape Land & Development LLC, for property located at the southwest corner of Hopper Road and Old Hopper Road, in the City of Cape Girardeau, Missouri. Second and Third Readings. BILL NO. 22-28, an Ordinance authorizing the Mayor to execute a Quit Claim Deed to Cape Land & Development LLC, for property located at the southwest corner of Hopper Road and Old Hopper Road, in the City of Cape Girardeau,Missouri. Second and Third Readings. BILL NO. 22-33, a Resolution authorizing the City Manager to execute an Agreement with 3 Scanning, LLC, for electronic records imaging services, in the City of Cape Girardeau, Missouri. Reading and Passage. Council Member Robbie Guard abstained from BILL NO. 22-32 and from BILL NO. 22-28, for financial reasons, due to his employment with MRV Bank. A Motion was made by Shannon Truxel, Seconded by Dan Presson,to approve and adopt. Motion passed. 5-0.Ayes: Guard,Kinder, Presson,Thomas,Truxel. Absent: Fox,Moore. BILL NO. 22-22 will be Ordinance NO. 5504; BILL NO. 22-23 will be Ordinance NO. 5505; BILL NO. 22-27 will be Ordinance NO. 5506; BILL NO. 22-31 will be Ordinance NO. 5507; BILL NO. 22-24 will be Ordinance NO. 5508; BILL NO. 22-25 will be Ordinance NO. 5509; BILL NO. 22-26 will be Ordinance NO. 5510; BILL NO. 22-29 will be Ordinance NO. 5511; BILL NO. 22-30 will be Ordinance NO. 5512; BILL NO. 22-32 will be Ordinance NO. 5513; BILL NO. 22-28 will be Ordinance NO. 5514; and BILL NO. 22-33 will be Resolution NO. 3464. NEW ORDINANCES BILL NO. 22-34, an Ordinance approving the record plat of Debby Subdivision. First Reading. A Motion was made by Nate Thomas, Seconded by Stacy Kinder,to approve. Motion passed. 5-0. Regular Session February 22, 2022 LL-49 BILL NO. 22-35, an Ordinance approving the record plat of Church Enterprises Second Subdivision. First Reading. A Motion was made by Nate Thomas, Seconded by Stacy Kinder,to approve. Motion passed. 5-0. Ayes: Guard, Kinder, Presson, Thomas, Truxel. Absent: Fox, Moore. BILL NO. 22-36, an Ordinance amending Chapter 25 of the Code of Ordinances of the City of Cape Girardeau, Missouri,regarding Off-Street Parking Regulations. First Reading. A Motion was made by Shannon Truxel, Seconded by Dan Presson,to approve. Motion passed. 5-0. Ayes: Guard, Kinder,Presson,Thomas, Truxel. Absent: Fox, Moore. BILL NO. 22-37, an Ordinance accepting a General Warranty Deed for new Right of Way and a Temporary Construction Easement from the House of Prayer Outreach Mission, for the Sprigg Street Improvement Project, in the City of Cape Girardeau, Missouri. First Reading. A Motion was made by Nate Thomas, Seconded by Shannon Truxel,to approve. Motion passed. 5-0.Ayes: Guard,Kinder,Presson,Thomas,Truxel. Absent: Fox, Moore. BILL NO. 22-38, an Ordinance appropriating the expenditure of Department of Public Safety Grant Funds for the fiscal year ending June 30, 2022, in the City of Cape Girardeau, Missouri. First Reading.
