Regular Session October 20, 2003 243 T00111195 REGULAR SESSION — OCTOBER 20, 2003 The Cape Girardeau City Council convened in regular session on Monday, October 20, 2003, at 7:00 p.m. with Mayor Jay B. Knudtson presiding and Council Members Evelyn Boardman, Charles Herbst, Matthew Hopkins, Jay Purcell, Marcia Ritter and Hugh White present. Rev. Wes White of Mt. Auburn Christian Church presented the invocation, and the Pledge of Allegiance was recited. Prior to the regular session, the City Council convened in closed session for purposes of discussing litigation pursuant to RSMo. Section 610.021(1) upon Mr. White's motion, Mr. Hopkins' second, and the following vote: Ayes, Boardman, Herbst, Hopkins, Knudtson, Purcell, Ritter, White. Nays, none. The minutes of the September 30, 2003, special session, and the October 6, 2003, regular and closed sessions were approved upon Mr. Purcell's motion, Ms. Boardman's second, and the following vote: Ayes, Boardman, Herbst, Hopkins, Knudtson, Purcell, Ritter, White. Nays, none. Ms. Ritter stated she was not present at the September 30 meeting, and the minutes should reflect this. The agenda was adopted as distributed, upon Mr. White's motion, Ms. Ritter's second, and the following vote: Ayes, Boardman, Herbst, Hopkins, Knudtson, Purcell, Ritter, White. Nays, none. Mayor Knudtson stated that he had a wager with Jackson Mayor Paul Sander for the Jackson/Central football game. Mayor Sander did wear orange last year, and now it is his turn to wear red. However, he stated he wouldn't put on the shirt until all the Central students attending the meeting left the room. Mayor Knudtson explained that he and the Council received a letter from the Cape Central Student Senate requesting to change the name of a portion of Silver Springs Road running from Mt. Auburn Road to Kingshighway to "Tiger Pride Drive." He requested that a representative of the Student Senate appear to discuss the request. Mr. Edgar Palacios and Ms. Catherine Martin of the Central Student Senate appeared and explained that the request for the proposed name change is to help build pride in their school and to clearly identify the mascot of the school. It will promote positive publicity in the community and increase support of the school from the community. They want to paint tiger paws on this portion of the street, and they will be responsible for maintaining them. The school will change letterhead and maps as needed, and the school will promote the name change. Mayor Knudtson requested the City Manager review this request from the staff's perspective. Mr. Leslie stated that many streets in the city that have been specifically designated on behalf of a person or organization were previously unnamed streets or private streets. There is a question of where the change in street name would start and stop, because Silver Springs Road is continuous to South Kingshighway. Alternatives are to rename the internal streets on the campus, designate the street with an honorary name but still leave the Silver Spring Road address, or designate a mail stop address similar to the University. Mr. Palacios responded that they are specifically asking for Silver Springs Road to be renamed, but they would be willing to accept alternatives. Upon questioning by Ms. Ritter, Mr. Leslie stated that the city had not contacted the other property owners on this street, and Ms. Morton indicated Proceedings of the City Council, City of Cape Girardeau, Mo. Regular Session October 20, 2003 244 700111195 _ that - -e representative o t e sc oo had not contacte tem eit er. r. Hopkins suggested that staff contact the affected property owners along this portion of Silver Springs Road, and if they approve of the name change, then the Council would consider an ordinance officially changing the name. The Council discussed this issue in further detail, including how this would set a precedent for other organizations to ask for a name change. Mr. Mike Cowan, Principal of Central High School, appeared and stated that the school leadership team supports this request. It would be a joint venture between the school and community. This name change was originally discussed when the school selected the location of the high school, but no one followed up on it. Mr. Purcell made a motion, seconded by Mr. Hopkins, directing city staff to prepare an ordinance for the next meeting changing the name of Silver Springs Road from Mt. Auburn Road to South Kingshighway to "Tiger Pride Drive" which could be adopted if the surrounding property owners endorse the change. The Council discussed how this could set a precedent and how it would affect emergency services. Mr. Leslie stated staff will contact the postal service and other emergency services, and have this information available at the next meeting. Following discussion, Ms. Ritter made an amending motion, seconded by Mr. White, that prior to any name change the City should also receive the approval of EMS and other emergency services. The amending motion was approved upon the following vote: Ayes, Boardman, Herbst, Hopkins, Knudtson, Purcell, Ritter, White. Nays, none. The original motion was approved as amended upon the following vote: Ayes, Boardman, Herbst, Hopkins, Knudtson, Purcell, Ritter, White. Nays, none. Public Information Officer Tracey Glenn presented to the Mayor a Jackson High School t -shirt compliments of Mayor Sander from Jackson. Mr. Purcell requested that the Police Department monitor the speed of traffic on New Madrid Street in front of the Senior Citizen Center. Mr. Herbst stated that in the past week there have been noise and loitering problems in the 200 to 400 blocks of Good Hope Street. There was a neighborhood watch meeting this evening, and it was suggested that parking be temporarily eliminated in front of the business that seems to be causing the problem and in front of the homes along this area to help prevent large gatherings of people. Mr. Herbst explained that The Taste reopened as an after hours club with no alcohol on Friday and Saturday nights. Mayor Knudtson reviewed the following issues: 1. The downtown merchants will be proposing in the near future a one-way parking plan for Water Street. 2. In the agenda packet there was a copy of an RFP presented by County Girardeau County for a transportation study. 3. The groundbreaking for the new Federal Building next to city hall will be November 3 at 10:00 a.m. 4. City staff is working on a proposal for a right turn lane on northbound traffic on Mt. Auburn at Kingshighway. 5. MoDOT is presently looking into a program for beautification of interchanges throughout the city. If they do not follow through with this, the city will need to look into such a program. 6. Today he spoke at an assembly at Alma Schrader School honoring astronaut Linda Godwin. 7. This past weekend he traveled to Columbia to lobby for Cape Girardeau to host the 2005 Harley Owners Group Convention. The CVB was successful in its bid, and the city will be hosting the convention in 2005. Proceedings of the City Council, City of Cape Girardeau, Mo. Regular Session octnher 20, 20(13 245 T00111195 Ms. Ritter announced that she attended a seven -state district meeting of the Zonta Club, and the City will be hosting the bi-annual district meeting of the Zontas in the fall of 2005. Mitch Robinson, Executive Director of the Cape Girardeau Area Industrial Recruitment Association, presented a report on the history of his organization. He reviewed the top ten selection factors that companies look at when locating in a new area, and he discussed job loss in Missouri. Upon questioning by Mr. Hopkins he reviewed the Metropolitan Planning Organization issues and why the city did not qualify as an MPO. He also explained that the Chamber and several private developers are continually working on retail growth in the city. Mr. Leslie announced that on Thursday, October 23, at 7:00 p.m. at the Osage Community Centre there will be a neighborhood meeting to discuss the Peach Tree/Ranchito stormwater improvements. Mr. and Mrs. Curtis Greer appeared regarding their request for a special use permit at their home at 329 Edgewood. This issue was denied by the Planning and Zoning Commission, and they requested a public hearing be held before the Council. Mr. Purcell made a motion, seconded by Mr. Herbst, to set a public hearing for November 17 on the request of Carol and Curtis Greer for a special use permit to operate a wholesale and retail grocery -related consignment business from their home located at 329 Edgewood Drive in an R-1, single family residential district. The motion was approved upon the following vote: Ayes, Boardman, Herbst, Hopkins, Knudtson, Purcell, Ritter, White. Nays, none. Mr. Steve Marchbanks of Finch-Temples-Marchbanks appeared regarding a resolution on the agenda awarding a consulting agreement for employee benefit programs. His firm submitted a bid for this service, and the Council should consider their experience and the fact that they are a local company when awarding this contract. It has the capability to consult with clients on health care needs and it can look at plans for the future and review them on a regular basis. They represent St. Francis Medical Center, and they review this information on a quarterly basis. The firm works with all major insurance carriers and is a preferred provider for Blue Cross Blue Shield. Being a local company is a good benefit for the employees. Two local companies were in the final three selected. The company recommended has done work in this area, although they are not local. His firm will work for the city and not for the insurance companies. They have the experience and the capability to do what is best for the city. Mr. Purcell questioned whether the bid presented by Finch -Temples was for the same service as CBIZ but at a lower cost. Ms. Ritter stated that when the city received the RFP response from Finch -Temples, no in depth answers were given to the questions. Mr. Marchbanks explained that before in-depth information can be provided, he would need to come in and evaluate what the city currently has, what they have done in the past, and then take this information to market. Their proposal gave examples of what they had done in the past, but specifics cannot be provided without reviewing the city's current plan. Regarding communications with employees, he explained that BCBS has a web site that provides health statistics. If the city wants its own health newsletter, then this would be an additional cost. Information could just be provided in the city's current employee newsletter. BILL NO. 03-185 was presented as follows: A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE A CONSULTING AGREEMENT WITH CBIZ BENEFITS & INSURANCE SERVICES, INC. FOR CITY EMPLOYEE BENEFIT PROGRAMS Proceedings of the City Council, City of Cape Girardeau, Mo. Regular Session October 20, 2003 246 T00111195 - -- _- Mr. Purcell made a motion, seconded by Ms. Ritter, to approve the reading of BILL NO. 03-185 and adopt the resolution. Mayor Knudtson stated that city staff has reviewed all the proposals and they feel that CBIZ has submitted the best proposal. Finch -Temples and others are long-standing companies in this community, and there are questions regarding their ability to provide consulting services that the city needs. He suggested that staff meet again with the three finalists to review additional information and then make a recommendation on their abilities. Upon questioning by Ms. Ritter, Interim Human Resources Director Heather Brooks expressed concern with meeting the time -line for the city to secure this service. The City's current contract ends December 31, 2003. Regarding employee communication, the CBIZ proposal specifically outlines the types of communication they will have with city employees that the City is not currently getting with our insurance carrier. Ms. Ritter questioned if the city does not meet the timeline whether the city could operate on a month-to-month basis with the present carrier. Mr. Marchbanks stated that most companies will allow a month-to-month process at the renewal rate. Ms. Brooks explained that the renewal rate is 30 percent higher than the rate the city is presently paying. She stated that Curt May and CBS, who also presented proposals, both were nervous about meeting the present timeline. Mr. White made a motion, seconded by Ms. Boardman, to table approval of BILL NO. 03-185. Ms. Ritter stated that she wants to be comfortable with not putting the employees at risk and that open enrollment will be available. Finance Director John Richbourg explained that when an employee is informed of a new insurance rate in mid-December, it is difficult for that employee to find other insurance if necessary if the rate is too high. The motion to table was approved upon the following vote: Ayes, Boardman, Herbst, Hopkins, Knudtson, Purcell, Ritter, White. Nays, none. Mr. Frank Snider III appeared regarding his request for a special use permit at 901 S. Benton. This issue was denied by the Planning and Zoning Commission, and he requested a public hearing be held before the Council. He stated there would be one part-time employee on the premises. He continued that one of the Commissioners stated he did not want any home-based businesses in the City, and Mr. Snider felt the commission was biased. Mr. Hopkins made a motion, seconded by Mr. Purcell, to set a public hearing for November 17 on the request of Frank Snider III for a special use permit to operate a private detective agency out of the home of Frank Snider, Sr., and a request for an advertising sign and employees on the premises at 901 S. Benton in an R-2 residential district. The motion was approved upon the following vote: Ayes, Boardman, Herbst, Hopkins, Knudtson, Purcell, Ritter, White. Nays, none. Ms. Mary Skelton, 635 S. Sprigg, appeared and presented the following questions for the Council to consider before taking a final vote on BILL NO. 03-179 for a special use permit for Clila at the corner of Sprigg and Highway 74: 1. How will this convenience store/gas station selling cigarettes and package liquor affect the playground at Ranney Park, the two daycare homes and the church -run daycare all within two blocks of this location? 2. If diesel is advertised for sale at this facility, will the owners stop large trucks and semis other than supply vehicles from entering? 3. Will this facility be open on Sundays? 4. If card activated pumps are used from 10 p.m. to 8 a.m., how will these be monitored? How will lower income local residents have access? 5. What measures will be taken to prevent loitering and littering especially after hours? 6. How will this convenience store affect the truly neighborhood store, Ole Country Store, formerly Ratliffs, which would really be a safe place for children to frequent? 7. How will this traffic bottleneck affect the ingress and egress of emergency vehicles both for the neighbors and this business site? Proceedings of the City Council, City of Cape Girardeau, Mo. Re¢ular Session October 20, 2003 247 T00111195 Ms. Patsy Langston, 703 S. Sprigg presented maps of the area around this proposed gas station. She expressed concern with the new Highway 74 and the fact that all north -south streets were cut off when the new highway was put in, except Sprigg and West End Boulevard. All streets south of Highway 74 must exit onto one of these two streets to access the north. All store traffic will come off of Sprigg. When going into or coming out of the store, vehicles must cross traffic. There will be a lot of emergency vehicles, and she questioned how these would be affected with only two north/south streets and this entrance to the store being on one of those two streets. Mayor Knudtson explained that MoDOT and city engineers have spent much time reviewing this traffic situation, and they have assured that if there is a traffic problem, it will be remedied. Police Chief Steve Strong stated that he and Fire Inspector Mike Morgan have reviewed this plan with the developers and city staff. If there is a concern with traffic, the Police and Fire will jointly work with city staff to resolve it. At the present time there is not a large amount of truck traffic at the diesel pumps at the Bi -State store on Morgan Oak. It is difficult to speak for someone else; however, if a trucker in the area knew he had to make two left hand turns to access these pumps, the trucker would probably prefer to go to a pump on Interstate 55 for easier traffic flow. Upon questioning by the Mayor, Chief Strong discussed traffic concerns. This is not the only street with a problem. There are several major intersections on William, and there is no problem with the Police accessing these areas. There will also be zone cars in the southern part of the city for response. Morgan Oak is not designed for truck traffic. It is difficult to maneuver trucks at the intersection of Morgan Oak and Sprigg and, therefore, this causes the traffic to back up. He stated he did not foresee a problem with this development. On the contrary, traffic flow could actually improve in the area. Ms. Ritter continued that she has driven this area and sat at Maple and Sprigg to watch the traffic. Everyone is making assumptions as to where the exits are going to be from the new development. She requested a representative of the Blank family show where the entrances are going to be in relation to where Sprigg Street narrows. Scott Blank responded that the entrances are 45' wide, and they will be moved as far south as possible. Ms. Ritter questioned city staff whether they were comfortable with the location of the proposed left turn lane. City Planner Kent Bratton and City Engineer Mark Lester both responded they were. Mr. Purcell reminded the Council that at the last meeting Mr. Koehler presented information on the number of cars that would pass through this intersection. People are caught up in the way the traffic flows now, but it will flow more smoothly when the bridge route is completed and the store is established. Ms. Langston reappeared and expressed concerns with the volume of traffic that will be entering this establishment. The store hopes to have between 500 and 1000 vehicles per day, and a lot of this traffic must cross lanes of traffic. Most convenience stores have exits on more than one street; however, this store exits onto Sprigg Street only. The traffic will back up on Sprigg to Maple, which will cause traffic on Maple to back up. She is concerned with emergency vehicles because her son is a diabetic and needs medical attention. There are many people on the southern end of town that have medical conditions. Mayor Knudtson thanked Ms. Langston for her comments; however, he stated that the engineers and planners need to be trusted. Ms. Langston spent a lot of time on her maps; however, she is not an engineer. Regarding the traffic, decisions must be made based on what the professionals say. The Mayor pledged that if traffic becomes a problem the city will take care if it. He questioned Proceedings of the City Council, City of Cape Girardeau, Mo. Regular Session October 20, 2003 248 TOU,,,,95 whether traffic is the issue or if the neighbors just do not li ecw is s going there. Ms. Ritter stated that the Council needs to look at the southern quadrant of the city and identify another exit for this area. Mr. Hopkins stated that staff is looking into this. Mr. Herbst suggested that the extension of Hackberry or another street be included in the Transportation Trust Fund III projects. Mr. Patrick Buck, 1108 S. Sprigg, appeared and stated he drives Sprigg Street daily and understands that the bottleneck may be gone when the new bridge is opened. He questioned who will pay for street improvements if it becomes necessary to widen or improve Sprigg Street. This development will impact the quiet neighborhood. This will take away from the neighborhood the same as his business is taking away from the neighborhood on Good Hope Street. Mr. Eldon Nattier, 611 S. Sprigg, appeared on behalf of Pastor John Goff of the Cape Girardeau Church of God, who was not able to attend the meeting, and stated that Rev. Goff s views on the issue have not changed. Mr. Nattier stated that the entire city is counting on the City Council to listen and to abide by the wants of the residents. Mr. James Coley, 611 S. Sprigg, appeared and stated his name and where he lives as all are asked to do when appearing at a meeting. He stated that at the previous City Council meeting many people spoke against the special use permit and stated where they lived. Many spoke in favor of it. None lived south of Highway 74, and only three who spoke did give information that they were residents of the city. Mr. Blank, his son, and Rev. Bill Bird who appeared live in the city but not south of Highway 74. The rest of the people who spoke did not even live within the city. The gentleman who appeared with drawings of the facility said it would blend in the neighborhood, but there is no similar construction in the area and it will not blend in. Several people who appeared said they lived in Illinois. The vote of the Council does not reflect what a majority of Cape residents said. Members of the neighborhood group were approached by another business owner of property in the area and asked what the neighborhood wanted, and discussions continue. Mr. Blank was previously invited to talk with the neighbors. This invitation still stands but so far he has not done that. He questioned if none of the Council members live south of Highway 74 then why are they telling the residents this is progress. He asked the Council to represent the citizens in their vote because that is what they are supposed to do. Mr. Don Howard appeared and questioned how tractor trailers are going to be able to negotiate a right hand turn from northbound Sprigg onto the new bridge route. How are the police, fire and ambulance going to be able to respond when there is one way north and south. The highway is cutting off certain parts of the city, and the residents deserve better. There are many other places along Highway 74 that a convenience store could be placed other than this lot. BILL NO. 03-179 was given second and third readings as follows: AN ORDINANCE GRANTING A SPECIAL USE PERMIT TO CLILA, L.P., FOR THE PURPOSE OF CONSTRUCTING, MAINTAINING AND OPERATING A CONVENIENCE STORE AND GAS STATION AT THE SOUTHEAST CORNER OF SOUTH SPRIGG STREET AND MISSOURI ROUTE 74, IN THE CITY AND COUNTY OF CAPE GIRARDEAU Mr. Purcell made a motion, seconded by Ms. Boardman, to approve the second and third readings of BILL NO. 03-179 and to adopt the ordinance. Mayor Knudtson stated that many of these questions could have been resolved if Mr. Blank, the neighbors and staff would have met. He requested the staff coordinate a meeting of all parties involved, including the neighbors, to answer questions. Mr. Coley questioned if the vote can be tabled until this meeting occurs. The Mayor Proceedings of the City Council, City of Cape Girardeau, Mo. Regular Session October 20, 2003 T00111195 indicated he will not support tabling the matter. He has faith in the staff to work out the traffic issues. Ms. Ritter supported tabling the matter to the next City Council meeting. Mr. Purcell opposed tabling the matter. He stated that there were many professionals that spoke on this matter, and the City should trust their opinion. Mr. Coley again stated that on the Greer special use permit the Council listened to a handful of neighbors and tabled the matter, and he is requesting the same consideration. The neighbors on the Greer matter did not complete an adequate petition process as they neighbors on South Sprigg did. Following discussion, the motion was approved upon the following vote: Ayes, Boardman, Hopkins, Knudtson, Purcell, White. Nays, Herbst, Ritter. BILL NO. 03-179 is ORDINANCE NO. 3230. BILL NO. 03-180 was given second and third readings as follows: AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE OF ORDINANCES OF THE CITY OF CAPE GIRARDEAU, MISSOURI, BY CHANGING THE ZONING OF LOTS LOCATED AT THE SOUTHEAST CORNER OF SOUTH SPRIGG STREET AND MISSOURI STATE ROUTE 74, CITY AND COUNTY OF CAPE GIRARDEAU FROM R-3 AND C-1 TO C-1 The second and third readings of BILL NO. 03-180 were approved and the ordinance adopted upon Mr. Purcell's motion, Mr. White's second, and the following vote: Ayes, Boardman, Herbst, Hopkins, Knudtson, Purcell, Ritter, White. Nays, none. BILL NO. 03-180 is ORDINANCE NO. 3231. Mayor Knudtson requested Mr. Leslie organize a meeting with the parties and have a representative of MoDOT present. Mr. Blank appeared and stated that Mr. Herbst had contacted him after the last City Council meeting, and if Mr. Herbst takes the forefront on the meeting, then he will participate. Mrs. Gaye Blank appeared and stated that when the bed and breakfast on South Sprigg requested a permit for this location, they did not object. When the city sent letters to adjoining property owners regarding this convenience store, she was under the impression that if anyone objected, they would contact the Blank family, and no one did. Upon questioning by Ms. Langston, Mr. Herbst explained that residents within 185 feet of the property were notified by letter of the proposed special use permit, and her property is not within this distance. Mr. Nelson Sparks appeared and stated he met with Mr. Herbst this evening at a neighborhood watch meeting held at the Police Department South Precinct. He presented a petition signed by approximately 55 homeowners opposed to the newly opened Taste Lounge on Good Hope Street as an after hours club. The residents do not want this business in their neighborhood. This business was closed approximately two and one-half years ago by the City Council, and the neighborhood thought it was closed for good. The Mayor explained that the liquor license was denied, and the owner at the time shut down the business. The Council does not have the authority to close the business. Mr. Patrick Buck, owner of the Taste Lounge, appeared and stated he does not want to disturb the neighborhood. He kept the name of the business, but it is an after-hours club without alcohol. He is willing to work with the city to make sure the same problems do not reoccur, and he does not want the neighbors yards to be trashed. Mayor Knudtson responded that he has faith in Mr. Buck. He does have issues to face with the neighbors, and it sounds as if he is willing to take extra steps to listen to the neighbors and work with them.
