Nays, none. Ms. Ritter announced a study session would be held on Tuesday, June 10, 2003, at noon to further review the budget. Mayor Knudtson stated that the Council has the ability to amend the budget at the second and third readings of the ordinance. Mr. Don Howard appeared in regarding changes in the fireworks ordinance. He stated that the ordinance needs to be better enforced, and other types of fireworks also need to be prohibited. In addition, he expressed concern regarding issues occurring in the Cape Public School system relating to hazing and gangs in the fifth and sixth grades. Finally, he commended the City Council for its recent termination of the City Manager. Mr. Randy Reed appeared in opposition to a liquor license renewal request from McDonald and McDonald LLC on North Sprigg Street. He lives on Mason Street 50 feet from the bar. He complained of access to the bar from Mason Street, which is a violation of the conditions of his liquor license, as well as problems with other code violations, loud music, and trash on the parking lot and surrounding areas. Inspection Services Director Robb McClary explained that the City Council previously approved this liquor license with three conditions: (1) no stairway on the south of the building from the upper parking lot to the lower parking area; (2) remove gravel from the alleyway, and (3) no access to Mason Street from the bar. Mr. McDonald has made sporadic attempts to restrict the access with no success. In addition, city ordinance requires a barrier between residential and commercial property. Mr. McDonald previously agreed to install a chain link fence, which has not been completed. The property is tentatively scheduled to be sold, and the new owner has promised to work with the city on six separate issues to bring the property into compliance. The new owners have placed money in escrow, which should be sufficient to cover the improvements. Mr. Proceedings of the City Council, City of Cape Girardeau, Mo. Regular Session June 2, 2003 132 100111195 McClary explame-TEat the Council as three options:deny the liquor license, (2) approve the license, and (3) approve the license with the condition that the access issues to Mason Street be resolved before the new license would go into effect. At the request of Mayor Knudtson, Police Chief Steve Strong explained that the Police Department has received at least two complaints regarding this establishment. There is evidence from tire tracks that cars are accessing Mason Street from the bar property. Following discussion by the Council, Ms. Ritter made a motion, seconded by Ms. Boardman, to deny the request of McDonald and McDonald, LLC, d/b/a White House Sports Bar, 820 N. Sprigg, Suite 6, to renew its retail liquor by the drink license. The motion was approved upon the following vote: Ayes: Boardman, Hopkins, Knudtson, Purcell, Ritter, White. Nays, Herbst. Mr. John Heckrotte appeared in opposition to the proposed TIF project off of Bloomfield Road. He questioned who would pay for maintenance of the infrastructure. The project is to cover the construction of Bloomfield Road; however, there are no cost estimates included. He expressed concerns regarding the sewer line to the project. He stated that the developer should pay for the entire cost of the project. Mr. Randy Reed appeared and thanked the City Council for its decision regarding the liquor license for Mr. McDonald. Mr. Bobby McDonald appeared and stated that he has closed the alley, put in a dumpster and installed a fence around the dumpsters. He has provided security at the bar and has had little need for police intervention. If his license is denied, he will fold up and move out of town. The Mayor responded that the Council has not questioned these issues. The main issue has been the access to Mason Street. He stated to Mr. McDonald that he has had ten months to comply with the three conditions of the liquor license, and he has not done so. He suggested that Mr. McDonald repair the needed items and then reapply for the license. Mr. McDonald responded that he would not reapply for a liquor license. He has renovated buildings in other states as well as other locations in this city. He never had a problem with the city until he put in the bar and started dealing with Inspection Services Director Robb McClary. In addition, he stated he would now start building in Jackson because of problems with that department. He requested the Council revote the liquor license. The Mayor indicated the Council would not revote; he suggested Mr. McDonald comply with the requirements and then reapply for the license. Mayor Knudtson welcomed Public Works Director Doug Leslie as Interim City Manager and wished him the best in this position. The Mayor stated that the Council would be conducting a nationwide search to fill this position.
