SPECIAL SESSION - JLTLY 8, 1993
Council convened in special joint session with the Board of Appeals on Thursday, July
8, 1993, at 3:00 p.m. in the Office of the City Manager at City Hall. Mayor Francis E.
Rhodes and Council Members Melvin Gateley, Melvin Kasten, David Limbaugh, Doug
Richards, A1 Spradling III, and Mary Wulfers present.
Those present representing the Board of Appeals were Ralph Flori, Roy Halbert, Tony
Sebek, and David Pfeiffer. Ralph Maxton was absent.
Mayar Rhodes stated the purpose of the meeting was to review the 1990 BOCA
Minimum Property Standards and the amendments thereto proposed by the Board of
Appeals.
Tony Sebek explained that the City, in 1990, adopted the 1990 BOCA National Building
Code which addresses new construction, and major and minor remodeling. The BOCA
Minunum Property Standards would address real estate problems upon written complaint
received by the Code Official. The Board of Appeals would make the fmal decision on
a complaint if it is not resolved between the landlord and tenant.
Regarding Article 102.3, it was suggested that the person making the complaint should
be required to sign the complaint, furnish his/her address, and that his/her name and
address be made available to the complainee.
Ralph Flori stated that the City currently does not have a minunum maintenance code
comparable to the BOCA Minunum Property Standards, and issues are being brought to
the attention of the Inspection Services Division that nothing can be done about.
Mr. Limbaugh questioned what the actual charge of the Board of Appeals was. Mr. J.
Ronald Fischer, City Manager, explained that several years ago the City wrote a report
on housing issues. At that time, the City Council requested that the Board of Appeals
look at proposing some type of minimum property standards for Cape Girardeau. Mr.
Flori stated that the Board reviewed several different property maintenance codes, and
the 1990 BOCA Minimum Property Standards, with the proposed amendments, is their
recommendation.
There was discussion on whether this is actually the code the city would want to adopt
or whether the City wants to come up with its own minimum property standards.
It was the consensus of the City Council that each member of the Council should write
i down their recommended changes to the code, article by article, and submit them to the
City Manager by August 15. These would then be submitted to the Board of Appeals
;
i for their review.
There being no further business, the meeting adjourned.
