Special SeSSlOt1 March 1 19 94 SIL.13703 SPECIAL SE5SION - MARCH 1, 1994 Council convened in special session on 'hesday, March 1, 1994, at 5:00 p.m. with Mayor Francis E. Rhodes presiding and Council Members Melvin Gateley, Melvin Kasten, Doug Richards, and Mary Wulfers present. Council Members David Limbaugh and A1 Spradling III were absent. Ms. Wulfers made a motion, seconded by Dr. Kasten, that the City Council convene in executive session to discuss contract negotiations. The motion was approved upon the following vote: Ayes, Gateley, Kasten, Rhodes, Richards, Wulfers. Nays, none. Mark Grimm, special council for the city, reviewed with the City Council, by conference call, a second draft of the Memorandums of Understanding for each riverboat company. The memorandums included changes suggested by each company. After discussion, the Council reached a consensus on the following items: 1. On item 2 of the Boyd memorandum, the wording should be broaden so as not to include specific areas of savings, but all savings that may be a result of permanent docking. 2. On item 1 of the Lady Luck memorandum, the reference to "local historical group" should be changed to the "Colonial Cape Girardeau Foundation." This change should also be reflected throughout the entire memorandum. 3. On item 2 of the Lady Luck memorandum, the wording should be put back in to include a payment to the city of two percent of the adjusted gross receipts if the State determines it will be a permanent docking facility. 4. On item 4.A.(ii) of the Lady Luck memorandum, the completion of the private projects should be changed back to fifty percent (50%). Mr. Grimm explained that it would be advisable for the Council to adopt a resolution endorsing one of the riverboat companies conditional upon entering into a development agreement with that company. Once the development agreement is entered into, a final resolution would be adopted and forwarded to the State Gaming Commission. If the city is unable to enter into an agreement with that company, the Council could adopt a resolution opposing that company and submit it to the Gaming Commission. The Memorandums of Understanding will be finalized with the companies on Wednesday and forwarded to their head offices for signatures. They should be received in the City Manager's office on Friday and will appear on the City Council agenda for Monday, March 7. A representative of each company will be present at the March 7 City Council meeting to answer any questions if necessary. 432 Proceedings of the City Council, City of Cape Girardeau, Mo.
