REGULAR SESSION—OCTOBER 21,2002
The Cape Girardeau City Council convened in regular session on Monday, October 21, 2002, at
7:00 p.m. with Mayor Jay B. Knudtson presiding and Council Members Evelyn Boardman,
Charles Herbst,Matthew Hopkins, Jay Purcell,Marcia Ritter and Hugh White present.
The invocation was presented by Rev. Bill Burke of the First Church of the Nazarene, and the
Pledge of Allegiance was led by VFW Boy Scout Troop 5.
Prior to the regular session,the City Council convened in closed session for purposes of discussing
litigation, property acquisition, personnel matters and privileged communications with the City
Attorney pursuant to Sections 610.021(1), (2) and (3) of the Revised Statutes of Missouri, upon
Mr. Hopkins' motion, Mr. Herbst's second, and the following vote: Ayes, Boardman, Herbst,
Hopkins, Knudtson,Purcell, Ritter, White. Nays,none.
The minutes of the October 7, 2002, regular and closed sessions were approved upon Mr. Herbst's
motion, Ms. Ritter's second, and the following vote: Ayes, Boardman, Herbst, Hopkins,
Knudtson,Purcell,Ritter, White. Nays,none.
Mayor Knudtson presented a plaque to Robert Foster honoring and commending him for his 25
years of service with the City of Cape Girardeau and congratulating him on his retirement.
On behalf of the City Council, the Mayor extended his sympathy and prayers to the family of Dr.
Mohammad Shakil on the recent death of him,his wife and his children.
The agenda was adopted as distributed upon Mr. Hopkins' motion, Mr. Purcell's second, and the
following vote: Ayes,Boardman,Herbst, Hopkins, Knudtson, Purcell, Ritter, White. Nays,none.
Ms. Nancy Jernigan presented the final report and recommendation of the Citizens Finance Task
Force. She explained that the projects were divided into four areas: (1) operating expenses -
including public safety, public works and parks positions and minimal wage adjustments for
employees; (2) equipment - approximately 70 percent of the city's rolling stock is beyond its
expected life; (3) stormwater projects; (4)capital projects, including a new fire station, expand and
renovate the Public Works building, and an aquatics center to replace Capaha Pool. The total
project costs are approximately $4 million. The task force developed a revenue package of four
taxes and/or fees to finance these projects: (1) one-quarter cent sales tax; (2) stormwater utility fee;
(3) use tax; and (4) extend the ten cent property tax which will sunset on the Show Me Center
bonds. The average cost increase to a family of four would be $80 to $90 per year. Upon the
request of the Mayor, Ms. Jernigan reviewed the aquatics center concept and the costs of a new
center versus repairing the current pool. Most communities are replacing pools with aquatic
centers, and the fees will cover the operating costs.
Mr. Melvin Gateley of the Task Force discussed other issues discussed by the task force. First,
they recommended that the City Council consider placing the issues on an election ballot in
February, April or August of 2003. Second, the report was the unanimous decision of the task
force, and the revenue package they agreed upon affects all citizens and not just one constituency.
Third, the task force spent much time reviewing the aquatic center. The task force urges the
Council to study and review all aspects of this issue in depth. Fourth, the task force recommended
that the Council continue to study the projects every three to five years and outline a capital plan to
keep the public informed on all matters. One objective of the task force was to publicize the

Mayor Knudtson explained that the City Council discussed the Citizens Finance Task Force report ;

j Mr. Albert Bell appeared regarding the street light requests in the Jefferson Ellis Bloomfield
;, > > > ;:
i Pacific and Hanover Street areas. There is a neighborhood watch meeting held each month at the ;j
f' Police Station, and the group is requesting street lights because of the many problems in the area. j
= Additional lights will help with security and deter crime, as has been accomplished in the Good

 Hope, Lorimier and Frederick Street areas. The residents in this area want safe streets, adequate i

 I
 Mr. Ron Acord, 402 South Ellis, appeared and stated he has been involved with the neighborhood

Ij reviewed progress that has been made. Increased streetlights and community policing drastically !i
 helped this area. He suggested the city develop a street light program and implement it on time.
 Increased lighting will reduce the need for resources, such as police and fire. !

Mr. Hopkins made a motion, seconded by Mr. Herbst, to take money from the unrestricted reserve j

;j He stated he has met all city requirements to this point, and the only other renovation will be a ;

i; Once all the city permits are received, it will take approximately two weeks to complete the i;

Mr. Jim Goggin appeared on behalf of Lynwood Baptist Church and requested that a public ;
' hearing be scheduled on this liquor license application to allow all citizens to speak on the matter. !;
 He presented a petition to the Council with 268 signatures of citizens opposed to this '
; establishment at 2005 N. Kingshighway. In addition, he presented letters from three surrounding i
j; property owners opposed to the bar. He requested this matter be tabled and a public hearing be set j`
i for three reasons: (1) Time -there are no plans available to the city to show what will be put into i;
'i this bar. (2) Verification - the City needs to verify that under Section 30-38(b)(18) of the zoning ;i
i code there are enou h arkin s aces available for this establishment. 3 Safe this will be the

 Mr. Scruggs reappeared and explained that he was waiting to get approval on the liquor license Ij

been presented to the city, and he intends to use only a 30'x57' portion of the building, which will ;j

request a liquor license before final building plans are presented. i

Mr. Hopkins made a motion, seconded by Mr. White, to conditionally approve a retail liquor by
the drink and Sunday sales license for Thomas Charles Scruggs, III, d/b/a Big's, 2005 N.
Kingshighway, Thomas Charles Scruggs, Managing Officer. Ms. Ritter made a motion, seconded
by Mr. Purcell, to table conditional approval of this license until a public hearing is held on the
matter. Mr. Purcell spoke in favor of the amending motion. Mr. Hopkins questioned whether the
goal of the public hearing was to provide information or to give hope to one side or the other that
` ' the license will be approved. Under the law he did not see how the Council could deny a liquor
license and felt there is no purpose for a public hearing. The Mayor stated that this public hearing
does not set a precedent for future liquor licenses. The purpose of the hearing is to evaluate the
merit of the request and not to argue over parking spaces. There is confusion on what is being
proposed, and the hearing will allow for a relationship with the neighboring property owners to
develop. He stated he would like to move quickly on this matter and hold the hearing before the
November 4 regular council meeting. Following additional discussion, the motion to table and
hold a public hearing was approved upon the following vote: Ayes: Boardman, Knudtson,
Purcell, Ritter, White. Nays, Hopkins. Mr. Herbst abstained for financial reasons. The public
hearing was set far Tuesday, October 29, at the Osage Community Centre.
Mr. Herbst thanked the Public Works and Police Departments for their teamwork and community
policing to put street lights in the Jefferson, Benton,Hanover Streets area.
Mayor Knudtson announced that Mayor Paul Sander in Jackson is wearing a Central orange
sweatshirt as a result of the wager on the Central High School/Jackson High School football game.
The Mayor commended the Central Tigers on their victory and wished them good luck the rest of
the year.
Mayor Knudtson announced that Assistant City Manager Walter Denton will be leaving the City
of Cape Girardeau effective November 1 for the City Administrator's position in O'Fallon,
Illinois. Mr. Denton has also served as several acting department heads, and he wished Walter the
best in his future career.
