REGULAR SESSION—SEPTEMBER 16,2002 The Cape Girardeau City Council convened in regular session on Monday, September 16, 2002, at 7:00 p.m. with Mayor Jay B. Knudtson presiding and Council Members Evelyn Boardman, Charles Herbst, Jay Purcell, Marcia Ritter and Hugh White present. Matthew Hopkins was absent. The invocation was presented by Council Member Hugh White, and the Pledge of Allegiance was recited. Prior to the regular session, the City Council convened in closed session for purposes of discussing litigation, property acquisition, and privileged communications with the City Attorney pursuant to Sections 610.021(1) and (2) of the Revised Statutes of Missouri, upon Mr. Herbst's motion, Mr. White's second, and the following vote: Ayes, Boardman, Herbst, Knudtson, Purcell, Ritter, White. Nays, none. The minutes of the September 3, 2002, regular and closed sessions were approved upon Mr. Herbst's motion, Ms. Boardman's second, and the following vote: Ayes, Boardman, Herbst, Knudtson,Purcell, Ritter, White. Nays, none. The agenda was adopted as distributed upon Mr. White's motion, Mr. Herbst's second, and the following vote: Ayes, Boardman,Herbst,Knudtson, Purcell,Ritter,White. Nays, none. This being the date set for a public hearing regarding the necessity to make certain sewer improvements in Lateral Sewer District No. 14-K-7, including the construction of a sanitary sewer eight inches in diameter along with manholes, wyes, pavement restoration and other necessary appurtenances to serve certain properties in lateral Sewer District No. 14-K-7, Mayor Knudtson announced that there was a technical problem regarding the notice for the hearing, and the hearing will not be held at this meeting. City Manager Michael Miller explained that the ordinance setting the public hearing date did not have the correct date of the hearing, and it will be necessary to adopt another ordinance setting a correct date for the public hearing. Following discussion, Mr. Purcell made a motion, seconded by Ms. Boardman, setting a special City Council meeting for September 23 to consider an emergency ordinance declaring it necessary to make certain sewer improvements in Lateral Sewer District No. 14-K-7 and setting a public hearing date. The motion was approved upon the following vote: Ayes, Boardman, Herbst, Knudtson, Purcell, Ritter, White. Nays, none. Ms. Julie Pastrick appeared and expressed her opposition to establishing this sewer district with four property owners in the district when only two property owners need connection to the city sewer. She stated that this project will impose a financial hardship on the two property owners who do not presently have problems with their septic systems. She stated that Ruth Ann Holdman had previously admitted to pumping sewage onto property owned by Mr. Friese, and she should be required to pump her septic system and clean up the property, or be forced to pay a daily fine. Mr. James McDonald appeared regarding the streets in Village on the Green. He requested that the city take over maintenance of all the streets in the subdivision and establish a 15 mph speed limit with no parking on the inside of the circle drive. He stated that the property owners would remove the blockade that is presently in place. Mr. Miller explained that the street is 25 years old, and city staff is not recommending to take over the street maintenance. If the property owners remove the barricade and open the street for public use, the city can enforce speed limits and parking restrictions even if the streets are not accepted for maintenance. Upon questioning by the Mayor, Mr. McDonald stated that all the property owners agreed that if the city will not accept the Proceedings of the City Council, City of Cape Girardeau, Mo.
