Mr. Randy Reed appeared in opposition to the liquor license on North Sprigg. He explained that
there is not a platted alley to the west of his property although there is gravel along his property

intends to purchase and develop the additional land behind his property.

the drink license for McDonald and McDonald Investments LLC d/b/a The White House Sports
Bar, 820 N. Sprigg Suite 6, Bobby McDonald, Managing Officer. Upon questioning by Ms.
Ritter, City Attorney Eric Cunningham explained that if the Council places conditions upon the I
liquor license and the owner violates the conditions, the Council has the right to revoke the license.
Following discussion, Mr. White made a motion, seconded by Mr. Herbst, to add the following
conditions to the liquor license: (1) no access to or from the McDonald property, present and
future, onto Mason Street; (2) existing rock-surfaced driveway be removed from the north Mason

Mr. Steve Mueller, 2129 Abbey Road, appeared regarding the record plat of Woodland Place
Eleventh Subdivision. He explained that on June 21 excavation began on a residence on Abbey
Road along the edge of the detention basin in this area. Approximately ten years ago the residents
in the area were assured that this was common ground and would not be developed. He
questioned if it is developed, what subdivision covenants would apply. He requested the City
Council consider keeping this area as part of the detention basin.
I
Mr. Wayne Mattes, 2137 Abbey Road, appeared and expressed concerns with flooding in the
Randol Farms area if this area is developed along the detention basin. The residence being ,
constructed is in the overflow area of the basin. The basin has reached the overflow level several I
times and has been as high as the neighbors' property. He requested the Council deny this
development and allow this area to remam as overflow for the detention basm. i

Ms. Kathy Cowley, 2317 Earleen, reviewed the history of the development of this area. In 1995
she received a letter from David Gerlach regarding the problems with the detention basin, and read
it aloud to the City Council. In the letter Mr. Gerlach explained plans to develop a detention basin
up stream from this basin to slow the speed and volume of water flow under Earleen Street. Mr.
Gerlach has never completed the repairs he outlined in his letter. Ms. Cowley requested that the
present detention basin be widened to accommodate the increased inflow.
Mr. Bill Dacus, 2323 Earleen, appeared and stated that this new development on Abbey adjoins
his property. The owner has brought in dirt and sloped it towards his property, and he questioned
the legality of doing this.
Mr. J. P. Pyeatte, 2321 Earleen, appeared and expressed concerns with the amount of water that
can be handled by this detention basin. When he moved to the properly, he was assured that no
house would be built in this area. He stated that if this development proceeds and water gets into
his basement,he will then want the city to cover the repair expenses.
Mrs. Nancy Browne appeared on behalf of Randol Farms and Caroline Gibson. She explained
that Ms. Gibson has a contract for purchase of one of the lots in Woodland Eleventh. In 1989 Mr.
Gerlach submitted a master plan for this area, and there is no designated common ground on this
plan. The property in Woodland Eleventh has never been part of the detention basin, and there is
nothing in writing regarding the development of this land. She explained that the Council has a
limited amount of discretion to decide if the plat complies with state statutes and city ordinances.
If it does comply, then the Council must approve the plat, or it can be forced to approve it by a writ
of mandamus.
Ms. Caroline Gibson appeared and stated she had completed extensive dirt work and
improvements to the property before she heard opposition from the neighbors. As of this date she
incurred$30,000 to purchase the lot and has drawn $33,000 on her construction loan.
Ms. Kathy Matthes appeared and stated during the flash flood in July of 2001, water was in the
pear trees along the detention basin.
BILL NO. 02-160 was given first reading as follows:
AN ORDINANCE APPROVING THE RECORD PLAT OF WOODLAND PLACE ELEVENTH
SUBDIVISION
Mr. Purcell made a motion, seconded by Mr. Hopkins, to approve the first reading of BILL NO.
02-160. Mr. White stated he has met with the neighbors and is aware of the water levels in the
basin. All aspects of the project meet the city standards and requirements. Following discussion,
the motion was approved upon the following vote: Ayes, Boardman, Herbst, Hopkins, Knudtson,
Purcell, Ritter. Nays,White.
Mr. Robert Pastrick, 2321 Perryville Road, appeared regarding the proposed sewer district on
Perryville Road. He stated that there are still four septic tanks in this neighborhood that are not
included in the district. Ms. Holdman is not pumping her septic tank, and sewage is running down
Mr. Friese's yard. He stated that this ordinance is discriminatory against the two property owners
who do not need city sewers, and it is inconsistent in that it does not eliminate all the septic tanks
in the area. Mr. Purcell commented that if the septic is not being pumped, then the County Health
Department needs to be contacted.

The City Council discussed the direction of the Citizens Finance Task Force. Mr. Purcell
suggested that the issues be referred back to the Task Force to study further, and then they can
make another recommendation to the Council. They need to review the way the city is operating
and develop ways to reduce expenses.

relating to city operations, and develop ideas to get input from other citizens. A timeline needs to
be developed if the Council is considering taking any issues before a vote of the people in the
spring. She questioned whether there are additional issues that the Council needs to review and
whether the Council should hold additional study sessions to review this information.
Mayor Knudtson commended the members of the task force for their dedication and commitment
to understanding the workings of the city in making their recommendations. Some of the reports
that the task force and city staff used for reference were ambiguous, but, there were no "bad facts"
given as stated in the local newspaper.
Following discussion, Ms. Boardman made a motion, seconded by Mr. Hopkins, to refer these
issues back to the Citizens Finance Task Force for additional review and consideration. The
