 BILL NO. 2001-155 was given first reading as follows: i
f
AN ORDINANCE GRANTING A SPECIAL USE PERMIT TO GREATER MISSOURI
BUILDERS, INC. AND TYSON P. ZAHNER, FOR PURPOSES OF CONSTRUCTING,
MAINTAINING AND OPERATING A DRIVE-IN RESTAURANT IN A 12-FOOT BY 28-
FOOT PORTABLE BUII.DING, IN THE 2100 BLOCK OF WILLIAM STREET (TOWN
PLAZA PARKING LOT), IN THE CITY AND COUNTY OF CAPE GIRARDEAU,MISSOURI
The first reading of BILL NO. 2001-155 was approved upon Mr. Eggimann's motion, Mr.
Neumeyer's second, and the following vote: Ayes: Eggimann, Hopkins, Neumeyer, Purcell,
Spradling, Stoffregen,White. Nays,none.
This being the date set for a public hearing regarding the request of First Assembly of God Church
of Cape Girardeau for a special use pemrit for a church and recreation complex and day care and
learning centers in the 3700 block of Old Hopper Road, the hearing was opened. The City
Planner's Council Letter in the agenda packet presented for the record a certified copy of the
following items: (1) Section 30-39 entitled "Special Use Regulations" from the City Code; (2) the
Application for Special Use Permit; and (3) the application file. Mayor Spradling announced that
Missouri Court rulings indicate that cities do not have zoning authority over the construction of a
church;therefore,this public hearing will focus on the requested daycare only.
I
 Rev. Gary Brothers of First Assembly of God explained that the Kids Corner Daycare has been
part of the church's ministry for 27 years. It is an extension of the church's ministry to the
community. It will be totally enclosed within the church facility, and over one-half of the
employees are church members,including all of the management. Bible lessons are taught to the
children, and they pray with the children. They also have a children's ministry team that comes
in to the daycare once per week to present programs to the children. In fact, during his tenure as
pastor, they had one occasion when a parent withdrew their child based on the religious teaching
they were giving and the focus on the Bible, because they did not want their child under that.
Currently, approximately 115-120 children per day attend the daycare from throughout the
community. The church does not expect this number to increase when they move to the new
facility. The plans they have drawn up do not include much expansion for the daycare. The
daycare is not limited to children of inembers of the congregation and is open to whomever
would like to come. Upon questioning by Mr. Neumeyer he explained that the church ministry
operates from three locations, including the present church, the old May Greene School, and the
old Save-A-Lot building in the Town Plaza. When the new facility is opened, the present
church building will be sold, and all activities occurring there will be moved to the new facility.
T'heir youth ministry and youth offices are in the old Save-A-Lot building on Kingshighway.
They want that function to stay there since it is a high traffic area for high school and college age
kids. They minister to over 350 children per week at the old May Greene School, but they will
also remain at that location. They will not come to the new facility on Hopper Road. Mr.
Purcell stated that the current church has approximately 145 to 150 paved parking spaces and 45
to 50 gravel parking spaces, and questioned why the proposed new church has parking for over
twice that amount. In addition, he stated concerns that the daycare is a commercial venture and
will encounter traffic problems in the area, and questioned how the daycare would be advertised.

He stated that some people at the Planning and Zoning Commission meeting said that the church
would be bussing people to the new facility, and that over 600 cars exit the parking lot at the end
of a service. Rev. Brothers stated they could not stack 600 cars on the parking lot in 201 spaces.
He said this past weekend was a typical attendance for the church. Saturday evening they had
85 cars in the parking lot. Sunday morning's first service had 163 cars, Sunday morning's
second service had 183 cars, and Sunday evening they had 164 cars in their parking lot. The
cars do not all exit at the same time. The opponents' figures about traffic flow are not true.
They do not bus people to services now. They stopped bussing after a Saturday night service
was added in October of 2000. Rev. Brothers explained that membership at the church is 2,000
but that an average single service attendance at the church building is around 350. This total
membership figure of 2000 people, however, includes all of their activities and locations. It
includes 150-200 youth ministered to on Wednesday nights, up to 400 at the May Greene School
facility, and their "networks ministry" of ineetings taking place in individual homes involving
600-700 people from Sikeston to Marble Hill. The new church is hoping for expansion of its
membership and plans for 490 parking spaces,but the new facility only seats 1000 people. They
intend to continue with multiple services, or else they would be full the first Sunday they moved
in. Church statistics show that they can only maintain 85 percent of capacity in either the seating
or the parking spaces. They have to give people room. People will only fill up the other 15
percent at special events. They overbuilt on purpose. Because of traffic concerns, the church
did not consider this expansion until the new Hopper Road was built. He said there is not one
driveway that comes out on this section of new Hopper Road. Children are brought to the
daycare early in the day and are picked up at various times throughout the day. However, the
number of cars coming for the daycare center would be miniscule compared to the number of
cars that would travel that road if the area were developed as a subdivision. It was his opinion
that the traffic for the daycare would not be significantly noticed because it will follow the new
Hopper Road. He did not feel people would use Old Hopper Road when they could use the
straighter new Hopper Road. Until recently, Mount Auburn Road where the church is now has
only been two lanes, and they have not had any problems. The sign for the church and daycaze
will be a combination sign similar to the present signage, and the advertising will not be any
different than what is currently being done.
Mr. Mark Lumbeck, 3719 Old Hopper, appeared and stated the road to the church will be near
his backyard and questioned if the city could do anything about it. He stated he was not opposed
to the church or the daycare, but he did not want a road in his backyard. Mayor Spradling
responded that the temporary construction road will be at the top of the hill on Old Hopper
Road, and issues relating this temporary street can be addressed in the special use permit.
Mr. Samuel Smith of Smith and Company, engineers for the project, stated that the road to the
church will be approximately 30' from the rear of Mr. Lumbeck's property, but the church
would be receptive to putting in a screen of trees or bushes. The plan presented is a preliminary
plan and is subject to change, even as to the placement of that road.
Ms. Scarlett Followell appeared and stated she lives in Twin Lakes Estates. She said this area
was annexed by the city and provided city water and sewer without a choice, and the traffic is
already bad without the church complex in place. It was her opinion the church needed to build
elsewhere in the city.
Mr. Bob Dodson, 3317 Kage, appeared and stated he has frontage on the new Hopper Road. the
south side of Hopper was sold for residential use without access to Carolewood Subdivision, and
if it is developed,there could be driveways onto Hopper Road.

;, Mr. am Drusch, attorney, appeared oniea`omany of the neigh6ors and property owners 'T
;; opposed to the church daycare. He stated the special use permit process has regulations dealing =;
 with daycares, and he read portions of the City Code relating to this, including a statement that
' he thought a daycare in a residential area could have no more than ten children. Upon !'
!
; questioning by Mr. Drusch, City Attorney Eric Cunningham stated that the ordinance and !
,
special use permit do not restrict the number of children in the daycare. Mr. Drusch continued
' that the main concern is that the daycare is a commercial establishment, regardless of what
" Reverend Brothers said, meant to make a profit, in a residential neighborhood. He said that
;; whatever the church charges per child, times the number of children, is "commerce." There are
'' lots of daycare centers throughout this city. They are not all located in churches, and they are
j; not required to be in churches. They are established to make money, and so is this one. Kids go ;;
 there for the church to make money. He pointed out that the City Council had been told that +
'i participation in the daycare was not limited to parishioners' kids. He said that special use permit !'
1, regulations state that commercial establishments, except for marinas, are not allowed in Ij
± residential areas, and if this is approved,it was his opinion it would constitute spot zoning. ;

 Mr. Judd Marquis, 3713 Hopper, appeared and stated that there will be roads on three sides of ii
 his property, and he felt he was being bullied off of his property. '
;':
j Mr. Liam Maher appeared in opposition to the recreation complex proposed by the church. He i;
;;
;, did not feel it was necessary when the Osage Community Centre was in close proximity of the

;
;! not the entire complex. i
it
Mr. Bruce Jateff appeared and displayed four maps indicating property owners who have signed ;
± a petition opposing a special use permit for this property. Mr. Jateff read the petition and stated '
'
! there are a total of 226 signatures. Mr. James Shandy presented another page of the petition to
;: the City Council. Mr. Purcell stated that the petition will need to be verified and authenticated I;
;; to determine whether a super majority vote by the Council will be necessary. ;;
i;
" Ms. Dorothy DiGirolamo, 1002 Camino Court, appeared and stated that petition submitted was
j'; for the daycare and all other proposed uses on this site, but not the church. Traffic is a problem +
 now and will be worse when school starts.
,; i;
Mr. Steve LeGrand, 3618 Old Hopper, appeared and stated that this portion of Old Hopper is ''
very poorly maintained by the Cape Special Road District, and the street will not be able to ;'

handle the construction traffic. He opposed the temporary construction entrance because he said ;':
many times temporary becomes permanent. Mayor Spradling responded that if the special use
'! permit is not approved for the daycare, the city will have no control over the proposed entrance 'i
' to the church. !'
; ;
; Upon questioning by Mr. Purcell, Samuel Smith explained that it was the recommendation of ii
i; the Planning and Zoning Commission and the city staff to designate Old Hopper Road as a ;'
`i temporary construction access, and therefore it is on the proposed plan. If the city opposes this ''
j entrance, the church can build the permanent street from Hopper to the church property and use
{ this as a construction entrance. The church does not need to use Old Hopper Road as a ''
i; temporary construction entrance at all. "

 Ms. Sandy Donnelly, a member of the church and developer in the city, stated she developed ';

continued that she did not understand the opposition to the church plan because the church has.
done nothing but good for the community. The daycare is a bible base for children, and
