Regular S@SSIOCI May 7, 2001 159 --- --- S31809 - ---- ---- - -- REGULAR SESSION—MAY 7, 2001 Council convened in regular session on Monday, May 7, 2001, at 7:00 p.m. with Mayor Albert M. Spradling III presiding and Council Members Richard Eggimann, Matt Hopkins, Tom Neumeyer, Jay Purcell, Frank Stoffregen and Hugh White present. The invocation was presented by Rev. Robert Klein, St. Mark Lutheran Church, and the Pledge of Allegiance was recited. The City Council convened in closed session prior to the regular session for the purpose of discussing personnel matters upon Mr. Neumeyer's motion, Mr. White's second, and the following vote: Ayes: Eggimann, Hopkins, Neumeyer, Purcell, Spradling, Stoffregen, White. Nays, none. The minutes of the April 16, 2001, regular and closed sessions were approved upon Mr. Neumeyer's motion, Mr. Hopkins' second, and the following vote: Ayes, Eggimann, Hopkins, Neumeyer, Purcell, Spradling, Stoffregen, White. Nays, none. The agenda was adopted as distributed upon Mr. Eggimann's motion, Mr. Purcell's second, and the following vote: Ayes, Eggimann, Hopkins, Neumeyer, Purcell, Spradling, Stoffregen, White. Nays, none. Mayor Spradling welcomed Boy Scout Troops 8 and 21 who were attending the City Council meeting as part of their Communications Merit Badge. This being the date set for a public hearing regarding the Arena Creek Sanitary Sewer Improvements Facility Plan for upgrading sanitary sewers in the Arena Creek watershed area, the hearing was opened. Ms. Laverne Stiver appeared in support of the sewer project. She thanked the Public Works Department for their help in assisting with the sewer and stormwater problems the neighborhood has had. She stated that in 1999 the City Council approved the Capital Improvements Program which included a sanitary sewer project for this area, and she stated that this project still needs to be completed. Mr. Eric Marquart appeared and stated he did not know if he opposed the project, but he had several questions. He asked when the project would start, how it would affect the creek, where would the sewer lines be placed, would the existing sewer be replaced or repaired, and would the sewers be trenched or bored? Mr. Rich Vedder, Project Manager with Sverdrup, appeared and introduced Sue Fahnestock and John Bennett of Sverdup. He reviewed the proposed plan for the sewer project. The first phase is the facility plan, the second is review of the design documents, and the third is the construction. The project is being financed through the State Revolving Loan Fund. Ms. Fahnestock reviewed how the sewers in the area were evaluated, the options for repair and the final plan. A sewer condition assessment was completed to determine the inflow and infiltration into the sewers and compared the peak flow in the sewers versus the pipe capacity. The alternatives available to repair the problem are to rehabilitate the old sewer, rehabilitate the old sewer and put in a new parallel sewer, or to replace the main trunk sewer. She explained Proceedings of the City Council, City of Cape Girardeau, Mo. Regular S@SSIOtI May 7, 2001 160 531809 ! that the third alternative is the recommended option, and the cost to replace approximately 2 i miles of sewer will be $I.55 million. Mr. Rich Vedder reviewed the time table to complete the project, with construction beginning in March of 2002. He explained that the old sewer will have to be maintained while the new sewer is being installed, and due to the cost, the open cut method will most likely be used for the project. Upon questioning by Mr. Purcell, Mr. Vedder explained that the Public Works Department has a program in place to reduce the inflow and infiltration into the sewer, much of which is from downspouts from homes. The new sewer system will have a large enough capacity to handle anticipated inflow and infiltration that may still occur. Public Works Uirector poug Leslie stated that the department has repaireci 82 points of inflow and infiltration in the last six months that were identified under the original smoke test. As the new pipes are being installed, they will also be pressure tested. Upon questioning by Mr. Marquart, Mr. Vedder further explained that the project will commence down stream, and the new pipes will be installed going upstream. The project is only for the sanitary sewers and will be coordinated with the storm sewer study. There being no further appearances, the hearing was closed. This being the date set for a public hearing to discuss the financing of the Arena Creek Sanitary Sewer Improvement Project and the impact on user charges, the hearing was opened. Mr. Vedder stated that the project is being funded with the present '/a cent sales tax for wastewater revenue bonds, and there will not be an increase on the residential sewer rate charged to customers (basic rate $3.45 per month and a quantity charge of $1.04 per CFT). There being no further appearances, the hearing was closed. This being the date set for a public hearing regarding the request of Garnet Hunt White and Birthright of Cape Cirardeau, Inc. for a special use permit to operate the Birthright Center at 404 North Louisiana Avenue in an R-3, two family residential district, the hearing was opened. The City Planner's council letter in the agenda packet presented for the record a certified copy of the following items: (I) Section :i0-39 entitled `Special Use Regulations' from the City Code, (2) the Application for Special Use Permit, and (3) the Application file. Ms. Judy Seabaugh, the Director of Birthright, appeared and presented a history of Birthright. She presented a petition from residents in the 100 block of South Park, which is the location of their present facility, which states that the center does not generate excessive traffic or cause problems in the neighborhood. She explained that board members visited with property owners on North Louisiana to address their concerns. Upon questioning by Mr. Purcell, she indicated that the Birthright Center could operate at the present facility if the special use permit is denied. 1 Ms. Delores Mier, a volunteer for Birthright, appeared and explained the purpose of Birthright ' and the clientele that they assist. She stated they work with many help agencies, and they need a ' larger building. p I Ms. Cathy Mattes, a volunteer for Birthright, appeared and addressed the traffic concerns in the neighborhood. She reviewed the hours of operation of the center, the amount of parking at the center, and presented pictures of traffic in the area. I ,, ( Ii Proceedings of the City Council, City of Cape Girardeau, Mo. Reular S@SSIOn Ma_y 7, 2001 161 - ------ 531809 - -- Ms. Doris Oberle, a volunteer for Birthright, appeared in support of the request. Ms. Mary Jane Houston, a volunteer with Birthright, appeared in support of the request. Mr. Bill Donnelly, a volunteer with Birthright, appeared and distributed an aerial map of the Louisiana Street area. He stated that the school buses do not drive along Louisiana, and he did not feel there is a traffic problem. Mr. Thomas L. Meyer appeared on behalf of Garnet White in support of the request. Ms. Pat Blackwell appeared and stated her property adjoins the property in question in the rear. If the center plans to use the rear yard as a parking lot, she will oppose the special use permit. Ms. Rebecca Mattes appeared and stated that the rear yard of the house will not be used as a parking lot. The only area that will be utilized for parking is the driveway, carport and the concrete area in de rear. The parking area will not be enlarged. Ms. Deanna Long appeared representing the neighbors on North Louisiana between Bessie and Luce Streets. She presented an outline to the City Council stating reasons the neighbors felt the special use permit should be denied. She said the property owners want to maintain the integrity of the neighborhood. She reviewed the criteria the Council must consider when reviewing a special use permit application. The neighbors feel that this request violates four of the criteria, including increasing traffic hazards or congestion, increasing fire hazards, adversely affecting the character of the neighborhood, and adversely affecting the general welfare of the community, and reviewed each. The street was built in the 1930's. [t is not a typical street. It is 24' wide. Where Birthright is now the street is 3.5' wide. So the fact that neighbors on Park Street say it causes no traffic problems is different from Louisiana Street. The single car driveways are narrow, difficult to access and are bordered by rock and concrete driveways. The City has already put no parking on one side of the street. She said there is not enough space for six more cars to park. The Fire Department trucks need 18' of clearance, and the average car is 7.S' wide. The character of the neighborhood will be damaged. At least one house is already listed as protected historical site. Children walk along that road going to and from school. She stated that this could affect property values and the ability to obtain homeowners insurance. She presented pictures of traffic on Louisiana Street. Mr. John Wymen, :i30 N. Louisiana, appeared and stated he did not oppose the Birthright Center, but he did oppose the granting of any special use ermit in this neighborhood. Mr. Lawrence Aeschlimann, 317 N. Louisiana, appeared and requested the Council deny the reyuest and to keep the neighborhood as a residential area. Ms. Dorris Wymen, 330 N. Louisiana, appeared and stated that this street is very busy with the hospital traffic and the children f►•om school. She continued that in the winter time, no one will be able to park in the rear of the proposed Birthright Center because of the very steep driveway to the rear of the property. There being no further appearances, the hearing was closed. Proceedings of the City Council, City of Cape Girardeau, Mo. Regular S@SSIOtI May 7, 2001 162 531809 BILL NO. 2001-87 was given first ►•eading as follows: AN ORDINANCE GRANTING A SPEC[AL USE PERMIT TO GARNET HUNT WHITE AND BIRTHRIGHT OF CAPE GIRARDEAU, INC., FOR PURPOSES OF MAINTAINING AND OPERATING A BIRTHRIGHT CENTER AT 404 NORTH LOUISIANA AVEIVUE, IN THE CITY AND COUNTY OF CAPE GIRARDEAU, MISSOURI Mr. Eggimann made a motion, seconded by Mr. White, to approve the first reading of BILL NO. 2001-87. Statler Trust and The Rebel Group, LLC to rezone the southwest corner of the intersection of South Silver Springs Road and Highway 74 (Shawnee Parkway) from R-I, single family residential district to G2, general commercial district, the hearing was opened. Mr. Bill Beggs appeared and stated he owned an orchard adjacent to this property and opposed the rezoning request. He felt that the large warehouse proposed for the sight could be a fire hazard for the neighborhood, and with the school nearby, there could be a traffic problem. He stated he also felt it could be spot zoning since only seven feet of the property adjoins commercial property. Mr. Wilver Wessel appeared and stated he owns 20 acres of land adjoining this site and opposes this rezoning request. He reviewed the history of the property, and stated his intentions are to sell the property to someone to develop a park. lJpon questioning by Mr. Pw•cell, City Planner Kent Bratton stated that the city was not informed of the use of the property other than for a retail/office building as stated in the application, and under G2 zoning, this would be allowed. , There being no further appearances, the hearing was closed. Two properties on Pacific Street are dumping on the right-of-way, and one has built a fence on it. He indicated he had been attempting to contact the city to improve the alley and had received no response. He wants the alley opened back up so he can use it as a rear access to his property. After he contacted Mr. Miller about the problem, he received a call from the Public Works Department about improving the alley. He thanked Mr. Miller and Harry Salazar of the Public Works Department for responding to him. Mr. Stoffregen requested that a four-way stop, and preferably a traffic light, be placed at the intersection of Hopper and Mt. Auburn Roads. Mayor Spradling requested the staff prepare an ordinance for the next City Council agenda for a four-way stop sign; however, an estimate would have to be prepared on the cost of stop lights at this intersection.
