S, Lorimier Street from R-4, multiple family residential district, to G2, general commercial
district, and for a special use permit for mini-storage units at that location, the hearing was

traffic and the impact on the neighborhood. The zoning of the property to the south is C-2, and to
the north and east is R-4. The junk yard across the street is M-1.
Mr. Bruce Melvin appeared in support of the request of Mr. Stone. He stated he lives adjacent to
• the property, and he felt Mr. Stone would put up nice storage units that would enhance the
neighborhood. He did appear before the Planning and Zoning Commission and expressed his
support at that time. There being no further appearances, the hearing was closed.

of Mr. Stanfield and Mr. Holzum and requested this matter be tabled to a future meeting to allow
time to prepare a presentation.
Mr. Bill Green appeared in support of the reyuest. He stated new stores such as this are usually
built based on traffic counts and number of households in the surrounding area. Since there is
already a store near this location, he supported a new convenience store on the corner.
Mr. Eggimann made a motion, seconded by Mr. Purcell, to continue the public hearing on this
request to the September 25 meeting, and to also table the first reading of BILL Nos. 2000-193

hearing was opened. There being no appearances, the hearing was closed.
This being the date set for a public hearing regarding the property tax rates proposed to be set by
the City of Cape Girardeau for the fiscal year beginning July 1, 2000, and the real property tax

2000, the hearing was opened. There being no appearances, the hearing was closed.
Mr. Dillard Dale, business owner at 606 S. Kingshighway, appeared in opposition to the request
of Jerry Lipps to rezone 2355 Locust Street. He presented to the Council a petition signed by
businesses surrounding this area opposed to the rezoning.
Mr. Perry Rice of United Electric appeared and questioned why the Lipps rezoning request is
coming before the Council. It was his understanding that Mr. Lipps was required to wait to years
from the previous rejection to reapply unless there were changes in the request. Mr. Rice stated
that Mr. Lipps is not working with the business owners in the area.

Mayor Spradling explained that Mr. Lipps can reapply within two years, but the application does
( not have to be submitted to the Planning and Zoning Commission. The City Council has the right
to immediately reject the application or refer it to the Planning and Zoning Commission. City
I Attorney Eric Cunningham stated that A1 Lowes, attorney for Mr. Lipps, verbally indicated that
there is additional information to submit regarding this reyuest, but city staff is not aware of what
this information is.
Mr. Terry Young of Cape Janitor Supply appeared in opposition to Mr. Lipps' rezorung request.
Mr. Lipps' operation on Highway 177 is very dusty and has a high volume of traffic, and Mr.
' Young stated he does not want this around his business. The Council needs to consider the
businesses that are already located in this area.
Mr. Carry Johnson, a business owner at 610 Commercial, stated that other issues besides traffic
and dust were addressed at the Planning and Zoning Commission on Mr. Lipps' rezoning request.
This issue was defeated by the City Council by only one vote, and he is concerned that if the
application ,goes through again, that it will be approved by the Council. Mr. Eggimann responded
that if no new appreciable evidence is presented by Mr. Lipps, he will likely vote against the
application although he did vote in support of it previously. Mr. Purcell indicated he would
probably also oppose the request if no new information is presented. Mr. Stoffregen stated that if
no new information is presented at this time, then the application should be rejected by the
Council.
Mr. Terry Glodo, business owner at 592 Commercial, questioned how often this matter could be
brought back to the Council for consideration.
Mr. Purcell made a motion, seconded by Mr. Eggimann, to refer to the Planning and Zoning
Commission the application of Jerry l,ipps to rezone 2355 Locust Street from M-1 to M-2. Mr.
Purcell explained that he felt it would be negligent of the Council to deny this applicat►on if there is
additional information available. Mayor Spradling stated he originally voted in favor of the
! application. However, if the applicant had additional information to present, it should have been
included in the new application. Following additional comments by the Council, the motion failed
j upon the following roll call vote: Neumeyer, nay; Purcell, aye; Spradling, nay; Stoffregen, nay;
i White, nay; Eggimann, aye; Hopkins, nay.
Mr. IVeumeyer made a motion, seconded by Mr. Hopkins to reject the application of Jerry Lipps

Mr. Felix Kinsley appeared regarding the cable television franchise with Charter Communications.
He stated that he does receive the new, additional channels, and he urged the Council to renew
 their contract.
;
i Mr. Stoffregen reqiiested that city staff look into changing the yield signs to stop signs on Pioneer
Drive. Drivers are not slowing down at the yield signs, and there have been many close calls.
