Regilar S@SS1011 June 19, 2000 s3eo9 REGIJLAR SESSION—JC1NE 19, 2000 Council convened in regular session on Monday, June 19, 2000, at 7:30 p.m. with Mayor Albert M. Spradling III presiding and Council Members, Richard Eggimann, Matt Hopkins, Tom Neumeyer, Jay Purcell, Frank Stoffregen and Hugh White present. The invocation was presented by Rev. Paul Short of St. Andrew Lutheran Church, and the Pledge of Allegiance was recited. The Council convened in closed session prior to the regular session for purposes of communications with legal counsel upon Mr. Hopkins' motion, Mr. Neumeyer's second, and the following vote: Ayes: Eggimann, Hopkins, Neumeyer, Spradling, Stoffregen, White. Nays, none. (Purcell was absent for the closed session). The minutes of the June 5, 2000, regular session were approved upon Mr. Neumeyer's motion, Mr. White's second, and the following vote: Ayes, Eggimann, Hopkins, Neumeyer, Purcell, Spradling, Stoffregen, White. Nays, none. The agenda was adopted as distributed upon Mr. Eggimann's motion, Mr. Stoffregen's second, and the following vote: Ayes, Eggimann, Hopkins, Neumeyer, Purcell, Spradling, Stoffregen, White. Nays, none. This being the date set for a public hearing regarding the request of Bo and Dianne Shantz for a special use permit for an insurance office on the northeast corner of Perryville Road and Lexington Avenue in an R-1 single family residential district, the hearing was opened. Mr. Bo Shantz appeared and distributed letters in support of the reyuest, the building plans for the business, photos of possible signage for the business, and a plat of the lot subdividing the property into six residential lots. He stated that most of his business is done over the telephone and would have approximately 10 customers per day. From the outside the business will appear as though it is a house. There will be a concrete slab on the north side for parking, and the drive will be off of Perryville Road. Mr. Steve Wilson appeared and presented a petition signed by residents in the area opposing the special use permit. He requested the Council review the petition, and if the special use permit is granted, consider placing restrictions on the permit that the business be owner occupied and restrict the type of lighting and signage. Mr. John Essner, 1817 Meyer, appeared and stated that if this is approved, it will be the beginning of commercialization of Lexington Avenue and set a precedent for the future. It would adversely affect surrounding property values. He also questioned how handicap accessibility would be addressed in the house being operated as a business. Mr. Jim Mittrucker, 1821 Meyer, appeared and stated that Mr. Shantz is selling automobiles from this lot and presented a picture to the City Council. He stated the maintenance of the lot has not been good, but it has improved. He felt a nice building would look better on this corner; however, he is opposed to commercial use. There being no further appearances, the hearing was closed. Upon questiorung by Mayor Spradling regarding the petition received, City Attorney Eric Cunningham stated that if the owners of 30 percent of the property within 185 feet of the proposed area sign a proper petition, then the Proceedings of the City Council, City of Cape Girardeau, Mo. ls Reular SQSSIOt1 June 19, 2000 531809 ordinance must be approved by a super majority vote. Mr. Hopkins made a motion, seconded by Mr. Eggimann, to table the first reading of BILL NO. 2000-137 to the July 17 agenda to allow city staff to verify the petition. The motion was approved upon the following vote: Ayes: Eggimann, Hopkins, Neumeyer, Purcell, Spradling, Stoffregen, White. Nays, none. BILL NO. 2000-137 reads as follows: AN ORDWANCE GRANTING A SPECIAL USE PERMIT TO BO SHANTZ AND DIANNE SHANTZ, FOR PURPOSES OF CONSTRUCTING, MAINTAINING AND OPERATING AN INSURANCE OFFICE AT 2010 PERRYVILLE ROAD, IN THE CITY AND COUNTY OF CAPE GIRARDEAU, MISSOURI Ms. Mary Robertson appeared in opposition to granting a liquor license at 600 Broadway and allowing the sale of small alcoholic containers. She stated that liquor sales would adversely affect this area. She read letters from Scott Shivelbine of Shivelbine's Music, Don Beatty of Nowell's Camera Shop, and Steve Robertson of Robertson's Photography opposing the liyuor license. Ms. Robertson stated that Old Town Cape has received a grant to enhance the downtown area, and this would be a negative impact. She also stated that according to her measurements, this establishment is within 200 feet of a church. She questioned how many complaints must be made against an establishment before the Council will revoke the license. Mr. Spradling stated that if concerns are presented by the Police Department, the Council usually will place an establishment on probation before considering revocation of the liquor license. Upon questioning by the Council, Mr. Cunningham explained that the only grounds mentioned by Ms. Robertson to deny this license is if the establishment is within 200' of a church or school, and the school or church has not given permission for the license. In addition, the city also has related ordinances which prohibit the public consumption of alcohol. Mr. Neumeyer requested that approval of this license be delayed for two weeks to verify the distance from a church or school. Mayor Spradling responded that since this is conditional approval of the license, part of the condition is to verify the distances before the license is issued. BILL NO. 2000-136 was given second and third readings as follows: AN ORDINANCE ADOPTING THE ANNUAL OPERATING BUDGET FOR THE CITY OF CAPE GIRARDEAU, MISSOURI, FOR THE FISCAL YEAR BEGINNING JULY l, 2000 Mr. Eggimann made a motion, seconded by Mr. Neumeyer to approve the second and third readings of BILL NO. 2000-136 and adopt the ordinance. Mr. Hopkins made a motion, seconded by Mr. Eggimann, to amend the budget by eliminating the three percent cost of living raise and replacing it with a LAGERS employee retirement upgrade to LT-8(65). The amending motion was approved upon the following vote: Ayes: Eggimann, Hopkins, Neumeyer, Purcell, Spradling, Stoffregen, White. Nays, none. The original motion was approved as amended upon the following vote: Ayes: Eggimann, Hopkins, Neumeyer, Purcell, Spradling, Stoffregen, White. Nays, none. BILL NO. 2000-136 is ORDINANCE NO. 2740.
