 REGULAR SESSION—JIJNE 5, 2000
Council convened in regular session on Monday, June 5, 2000, at 7:30 p.m. with Mayor Spradling
presiding and Council Members, Richard Eggimann, Matt Hopkins, Tom Neumeyer, Jay Purcell,
Frank Stoffregen and Hugh White present.
The invocation was presented by Matt Hopkins, and the Pledge of Allegiance was recited.
The mirnites of the May I5, 2000, regular and closed sessions were approved upon Mr.
Eggimann's motion, Mr. Purcell's second, and the following vote: Ayes, Eggimann, Hopkins,
Neumeyer, Purcell, Spradling, Stoffregen, White. Nays, none.
The agenda was adopted as distributed upon Mr. Neumeyer's motion, Mr. Purcell's second, and
the following vote: Ayes, Eggimann, Hopkins, Neumeyer, Purcell, Spradling, Stoffregen, White.
Nays, none.
Police Chief Rick Hetzel, Cpl. Kevin Orr, and Mayor Spradling presented certificates to the
fourth graduating class of the Citizens Police Academy.
This being the date set for a hearing regarding the revocation of the alcoholic beverage license for
Taste Restaurant and L,ounge, 402 Good Hope, Barbara Sue Treece (Simpson), Managing Officer,
the hearing was opened.
Police Chief Hetzel explained the Police Department had been working with the management of
the Taste Lounge for the past year; however, only three bar letters had been issued to patrons to
preclude them from returning to the business. Chief Hetzel added that two of the most recent
assaults had been reported to the Taste Lounge; however, their employees had not contacted the
police as required by state law. Chief Hetzel pointed out that these indicators are common when a
bar is attempting to avoid revocation of their liquor license.
Chief Hetzel pointed out a nearby community, Crystal Springs, Missouri, had experienced a
similar problem in 1995 when they revoked a bar's liquor license. According to a letter from Mr.
Dan Bi►skin, the former Chief of Police in Crystal City, Missouri, that measure resolved the
continued problems with assaults, littering, and property damage in that area. Since the City has
now received a request for renewal of the Taste's liquor license, the purpose of this hearing is
changed from a revocation of the existing license to denial of the pending license application. The
Chief recommended that the liquor license renewal for this establishment be denied.
Mr. DeMarcus Pryor, part owner of the Taste, appeared on behalf of Michael Pryor. He stated
that more alternatives need to be explored to solve the problems instead of suspending the liquor
license. He stated that they are trying additional efforts to improve the safety of the club and need
time to curtail the violence. There is a list of patrons that have been barred from the
establishment. He requested that the Police Chief and Police Department work with Mr. Pryor to
solve the problems in this area. However, he did not feel that the crowds in the streets were the
responsibility of the bar owners. Upon questioning by the Council, Mr. Pryor explained that his
father purchased the lot next door to the bar and tore down the house to try to eliminate some
problems, and there presently are no definite plans for this lot.

Mr. Brian Davis appeared in opposition to revoking the liquor license for the Taste. He explained
that this is the only bar in the city that caters to black entertainment. The majority of the people
that congregate ouside the bar are underage and are staying in the streets past the city's curfew.
The Police Department needs to address this issue.
Mr, Rick James appeared and stated that in other communities with similar problems, the Police
Department sets up a blockade so individuals cannot cruise the streets where the problems are
occurring. He indicated he felt that when a crowd starts to form, the police just sit and watch and
do not disperse the crowd. Community relations need to be established with the police because
individuals do not respect the Cape police.
Ms. Mary Louise Reddin appeared and stated that the residents in the neighborhood are forced to
clean up a large amount of trash left from the crowds in the area. She stated she was not in
support of closing down the bar; however, the bar owner needs to hire someone to clean up the
area and get rid of the noise.
Mr. Patrick uck appeared in opposition to revoking the liquor license for the Taste. He stated he
felt that the police are not doing anything to help the situation and expect Mr. Pryor to take care of
the problems. In addition, he felt that Mr. Pryor needs to be given a chance to take care of the
problems in the area without being on probation.
Mr. Michael Pratcher appeared and stated that the problems in the area are just symptoms of a
society problem. There is a drug problem in the town, and the police will only intervene once a
fight has commenced.
Nis. Lisa Rodgers appeared and stated that the trash in the strees is not left by the patrons of the
bar but rather by the teenagers that congregate in the area. They are also the ones starting the
fights.
Ms. Helen Sterling expressed concerns with the welfare of this area. There is a weed and seed
substation on Good Hope; however, they need to get out into the streets and help the area. In
addition, a community center for teenagers needs to be established on the south side of Cape to
help deter the crime.
Ms. Robyn Sides appeared and stated that she did not feel the police are fulfilling their
responsibility to control the altercations around the bar. Even if the liquor license is taken away,
people will still congregate in the area.
i
Mayor Spradling responded that everyone is asking for more policing in this area. However,
approximately one year ago he attended a meeting at St. .lames church and was criticized for
aggressive policing and was asked to keep the police out of the area. The police need to be
respected, and the individuals in the neighborhood and Mr. Pryor need to meet with the Police
Chief so he will know what role the police should take on in this area.
Mr. Leroy Wagoner appeared and stated that if the people involved in the altercations are not of
age to be in the bar, then the curfew needs to be enforced by the police.
Ms. Michelle ,lefferson stated that the Police need to be present in the area but need to do more
than they are presently doing. They need to get rid of the teenagers at curfew time and need to
disperse the crowds before a fight begins.

Mr. Scott Johnson appeared and stated he did not feel Mr. Pryor is responsible for what other
people are doing, and it is also not the fault of the police. This is a society problem. The
community needs to be cleaned up, and the children need to get off the streets..
Mr. Dennis Meyer of Meyer Supply appeared and stated that the problems on Good Hope have
progressively gotten worse over the last five to ten years, and the focal points are the bars. He
stated he did hope that the people in the area really do want to help and do want the police to
patrol the area. He explained that he was not speaking in favor of retaining the liquor license for
the Taste. If it is the focal point, then it is a problem.
There being no further appearances, the Mayor closed the hearing. Mayor Spradling made a
motion, seconded by Mr. Purcell, to conditionally approve a retail liquor by the drink license for
Pryor & Parker, Inc. d/b/a Taste Restaurant and L,ounge, 402 Good Hope, for a six month
probationary period, and that the license must be reapplied for at the end of the six month period.
Mr. Eggimann spoke in favor of placing stipulations on the license if too many incidents occur
during this time period. Mayor Spradling stated he did not support placing stipulations on the
license. If problems continue, this would be a basis for denial at the time of renewal. Following
additional comments by the Comcil, the motion was approved upon the following vote: Ayes,
Eggimann, Hopkins, Neumeyer, Purcell, Spradling, Stoffregen, White. Nays, none.
This being the date set for a public hearing regarding a voluntary petition for annexation from the
Deer Creek Christian Academy, Inc. for a 1.56 acre tract in the Route W Commercial Center
adjoining the northern city limits, the hearing was opened. There being no appearances, the
hearing was closed.
This being the date set for a public hearing regarding the request of Deer Creek Academy, Inc. to
rezone 2039 State Route W from R-1, single family residential district, (zoning classification upon
annexation), to C-I, local commercial district, the hearing was opened. There being no
appearances, the hearing was closed.
This being the date set for a public hearing regarding the request of Jerry Lipps to rezone 2355
Locust St. from M-I, light industrial district, to M-2, heavy industrial district, the hearing was
opened. Mr. AI Lowes appeared on behalf of the applicant and presented architectural drawings
of the concrete plant to be placed at this area. If the rezoning is approved, the applicant will pave
Locust Street from Kingshighway to the property in question, being approximately 500 feet. He
read a letter from Bill Gosche regarding diist from the plant, and discussed the economic impact
the plant would have on the city.
Mr. John Legler, President of Legler Equipment, presented pictures of a ready mix plant similar
to the one that would be installed by Mr. Lipps. He explained the dust collection system and
stated that the plant would be 95% efficient.
Mr. John Haertling of Rose City Motors expressed concerns regarding increased traffic in the area
from the plant. Most people do not recognize Locust Street as a city street between his business
and Auto Trim Design.. He felt the large trucks would drive too fast through the area and
endanger the people looking at cars.
Mr. Perry Young of Cape .lenair Supply expressed concerns regarding the property value of his
business if this is rezoned M-2. He felt that this area is predominantly a retail area, and did not
support the rezoning.

Mr. Perry Rice of United Electric Supply appeared on behalf of Jerry Brown and read a letter to
the Counci) (that was presented in the City Council packet) in opposition to the rezoning. In
addition, he questioned if this is approved and Mr. Lipps builds the concrete plant, will he have to
comply with elevation and detention basin requirements. Mayor Spradling responded he would
have to comply with all stormwater regulations.
Mr. Dillard Dale of Auto Trim Design appeared in opposition to the rezoning and stated that a
batch plant will not enhance the neighborhood. If the rezoning is approved and the plant built, he
will have to pay additional money to enhance the painting operation in his building to handle the
dust from the plant.
Ms. Debbie Glower of the carpet center at .592 Commerciat, questioned the additional trac on
Commercial street as a result of the batch plant. If it is too difficult for the large trucks to enter
onto Kingshighway, they will drive south on Commercial to Bloomfield Road to use the stop light.
Upon questioning by Mr. Eggimann, City Planner Kent Bratton stated that the right-of-way for
Locust Street is 50', and the Planning and Zoning Commission opposed the application due to the
impact on the surrounding neighborhood. He then read from the city code the types of businesses
that can be placed in an M-I district.
7'here being no fiirther appearances, the hearing was closed.
BILL NO. 2000-130 was given first reading as follows:
AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE OF ORD(NANCES OF THE
C{'TY OF CAPE GIRARDEAU, MISSOURI BY CHANGING THE ZONING OF 2355

TO M-2
Mr, Eggimann made a motion, seconded by Mr. Purcell, to approve the first reading of BILL
NO. 2000-130. Mr. Eggimann expressed concerns regas•ding dust, access to the proposed site,
and traffic on Commercial St. Following discussion, Mayor Spradling made a motion, seconded
by Mr. Purcell, to amend the ordinance by adding conditions that Mr. Lipps pave Locust Street 24
feet wide from Kingshighway east to the property line of Mr. Lipps per city specifications, and all
truck trac from the concrete plant be limited to Locust Street. City Manager Michael Miller
stated that the City Attorney had advised that if conditions are placed on the zoning, the matter
should be tabled to prepare a contract between the parties for the paving of Locust Street.
Following discussion, the amending motion was approved upon the following vote: Ayes,
Eggimann, Hopkins, Purcell, Spradling, Stoffregen. Nays, Neumeyer, White. The original
