There being no appearances, the hearing was closed. This being the date set for a public hearing regarding the necessity to improve that part of William Street from Sprigg Street easterly to Main Street, for a distance of approximately 2,420 feet, the hearing was opened. Mr. Jack Proffer, 225 William, appeared and questioned the aesthetics of this project. He stated the city will only be gaining six feet of pavement but will lose 19 trees. He questioned whether the city ever considered establishing no parking on one side of the street to gain additional width for driving. Mr. John Mehrle appeared and stated that his family home is in the 500 block of William. If this project is completed, the front porch of his family home will be within 10 feet of the pavement. In addition, he stated that with the cost being $67 per front foot, the assessment to his family will be approximately $9,000. Mayor Spradling responded that this project should be able to be completed within the street right-of-way. If only construction easements are needed, then it is anticipated that this will not be an assessable project. Ms. Cindy Hall appeared and stated she lives on the corner of Spanish and William. She questioned the aestheticsof the project and whether the use of this street will justify the cost of the project. She recommended that after the trees are removed to complete the project that a plan be implement to replant trees, especially at Indian Park. There being no further appearances, the hearing was closed. 400 Proceedings of the City Council, City of Cape Girardeau, Mo. Regular S@SSIOtI March 202000 S31809 This being the date set for a public hearing regarding the necessity to improve that part of Independence Street from Pacific Street to Sprigg Street, for a distance of approximately 940 feet, the hearing was opened. This being the date set for a public hearing regarding the necessity to improve that part of Lorimier Street from Morgan Oak Street to New Route 74, for a distance of approximately 930 feet, the hearing was opened. There being no appearances, the hearing was closed. Ms. Diana Steele appeared and expressed her support for BILL NO. 2000-74 relating to amendments to the Minimum Property Maintenance Code. Mr. Don Howard appeared and requested the Minimum Property Maintenance Code be amended to allow complaints beyond 200' as now required. In addition, property owners should be responsible for maintenance on property, even if it is rental property. BILL NO. 2000-74 was given first reading as follows: AN ORDINANCE AMENDING CHAPTER 7 OF THE CITY CODE RELATING TO APPLICATION AND ENFORCEMENT OF THE PROPERTY MAINTENANCE CODE Mr. Neumeyer made a motion, seconded by Mr. Eggimann, to approve the first reading of BILL NO. 2000-74. Mr. Gateley questioned whether a motion needed to be made to remove BILL IVO. 2000-69 which was tabled at a previous meeting. City Attorney Eric Cunningham stated that this bill is not on the agenda for consideration, and a motion does not need to be made. Mr. Stoffregen questioned the difference between the proposed ordinance and the existing code. Mr. Cunningham explained that this ordinance will remove the complaint process from the Minimum Property Maintenance Code. Under the proposed ordinance, anyone will be able to make a report regarding weeds, trash, and interior and exterior conditions of a structure. Mr. Stoffregen responded that if this is approved, citizens will drive around town and continually make reports regarding structures. The motion was approved upon the following vote: Ayes, Eggimann, Cateley, Neumeyer, Purcell, Spradling, Stoffregen. Nays, none. Mr. Don Howard appeared in opposition to the reyuest by Lester Sample for a special use permit for a scrap iron recycling center on Maple Street. Ms. Patty Turner appeared in opposition to a liquor license the City Council previously approved for Show-Me's restaurant at 1751 Independence. She requested the council reconsider this license and to consider the safety of the children at the preschool behind the restaurant and the students at Cape Central High School. She presented a petition with 656 signatures in opposition to the liquor license for Show-Me's. In addition, she stated she wanted the city ordinances and state statutes amended to recognize daycares and preschools as schools under the liquor license regulations. She contacted Representative David Schwab, and on March I 1 he presented a bill to i congress to consider amending the state statutes. She presented a letter to the Council from Representative Schwab. Mr. Don Harris, owner of Show-Me's restaurant, Just Kids Daycare and Kaboom night club in Cape Girardeau, appeared regarding the liquor license for his establishment. He explained that this will be a franchise restaurant with at least 60 percent of sales from food. There will not be a happy hour with reduced prices. He questioned whether Ms. Turner is concerned with safety or has a personal vendetta against him because he is a competitor for daycares. He stated that Ms. Turner has inquired into his police record, and there have been four anonymous calls to the state ) 401 Proceedings of the City Council, City of Cape Girardeau, Mo. Regular S@SSIOCI March 20, 2000 S31809 department over daycares regarding his daycare operations. In addition, the Fire Department received an anonymous phone call regarding occupancy loads at Kaboom. He assured the City Council and the parents that Show-Me's is not a tavern but rather a restaurant with a liquor by the drink license. Ms. Sara Turner appeared in opposition to the Show-Me's liquor license and expressed concerns with the safety of the parents and the children at the preschool behind this restaurant. Ms. Gina Crites appeared regarding this liquor license and stated her main concern was that the City does not recognize children under the age of five as being important. Mayor Spradling responded that the Council does consider all children. This establishment meets all city and state ordinances. The daycare does not fall within the 200' guidelines for liquor establishments, and under state law and city code is not recognized as a school or church. The Council has no way to deny this liquor license as long as Mr. Harris complies with all city ordinances. The liquor license has already been approved, and this cannot be revoked. Ms. Michelle Dean appeared in opposition to the liquor license for Show-Me's restaurant and expressed concern for the safety of the children at the preschool. Mr. Gateley stated it would be in the best ►nterest of the students at the preschool and the students at Central High School to revisit this issue. Mr. Gateley made a motion to reconsider the liquor by the drink license for Show-Me's at 1751 Independence. Mayor Spradling responded that the motion was out of order because this issue is non-reviewable. This is a license that has already been granted and cannot be reconsidered. Mr. Gateley challenged Mayor Spradling's response. City Attorney Eric Cunningham stated that an issue has to be reconsidered at the same meeting it is approved; therefore, the Council cannot reconsider this issue. A new measure would have to be presented. Mr. Gateley requested that a new item be placed on the next agenda for consideration. He stated he felt any item can be reconsidered. Upon questioning by Mr. Stoffregen, Mr. Cunn►ngham stated that the city code regarding liquor licenses and the distance requirements from schools and churches is based on state statute, and he would have to investigate whether the city code can be changed. Mr. John Howard Dean appeared and requested that a fence be erected behind Show-Me's so the preschool will not have to view the back of the restaurant and the women that work in the restaurant. Ms. Dotty Ludwig appeared and stated she has been a daycare teacher for 23 years. She viewed a calendar from Show-Me's in St. Louis, and she did not feel this would be a family establishment. Ms. Turner reappeared and restated that her only concern is for the children that attend her preschool. She stated that she has a one year lease on her building, and if the liquor license continues at Show-Me's, she will not stay at that location. Ms. Leslie Moss appeared and stated that putting this type of restaurant in front of a preschool is not appropriate. She will always worry about her child at the preschool. She does not object to Show-Me's but rather objects to the location. Mr. Eggimann congratulated Mr. Neumeyer and Mr. Purcell for running for office in the Missouri House of Representatives. 402 Proceedings of the City Council, City of Cape Girardeau, Mo. Regular S@SSIOCI March 20, 2000 531809 BILL NO. 2000-34 was given second and third readings as follows: AN ORDINANCE AMEND(NG CHAPTER Il OF THE CITY CODE RELATING TO FIREWORKS Mr. Gateley made a motion, seconded by Mr. Neumeyer, to approve the second and third readings of BILL NO. 2000-34 and to adopt the ordinance. Mr. Stoffregen stated that this ordinance will ban the sale and use of bottle rockets within the city limits, and he expressed his concerns with this. Mr. Stoffregen made an amending motion, seconded by Mr. Eggimann, to remove the restriction on bottle rockets and allow the distribution and discharge of bottle rockets within the city limits. Mr. Purcell stated that by banning bottle rockets, this will increase the number of complaints to the Police Department. In addition, this will be a loss of sales tax money as residents will go to surrounding communities to purchase bottle rockets. He continued to read from Council Letter No. 91 the proposed amendments to the city code relating to fireworks. Mr. Cateley called for order and requested that comments be limited to the amending motion.
