There will be a muffler shop at the location on Aquamsi Street operated by his son. The location
i on Maple Street is one block from Sides Recycling and across the street from the city park. He is
presently negotiating to either rent or sell the building on Spanish, and it will not be rented to an

Mr. Don Howard appeared in opposition to the request and stated that there are enough junk cars
on the south side of the city and does not want another one. He requested the Council to deny the
request. He stated there is a risk that the junk will be outside of the fence and the fence will not be
maintained correctly. He thanked the City Council for cleaning up Fort D.
Mr. Neumeyer questioned how this special use permit would benefit the Maple Street site. Mr.
Sample responded this is an industrial area and he will be fixing up the building and putting up a
new fence. If the permit is not approved, he will have to resume the operation on Spanish, and the
cars will remain there. People do not like salvage yards and landfills, but we need to recycle our
goods. Upon questioning by Mr. Gateley, Mr. Sample stated that the trailer on Maple Street is
used for storage now but will be removed. This is where the compactor will be located.
The Council questioned if there is a specific definition of a salvage yard, and what uses are
allowed in an M-2 zone. City Attorney Eric Cunningham stated there is no specific definition, and
he read from the city code the requirements for an M-2 zone. He stated that this type of business
would need a special use permit wherever it was located.
There being no further appearances the hearing was closed.
BILL NO. 2000-55 was given first reading as follows:
AN ORDINANCE GRANTING A SPECIAL USE PERMIT TO LESTER SAMPLE, FOR
PURPOSES OF MAINTAINING AND OPERATING A SCRAP IRON RECYCLING
BUSINESS AT 503 MAPLE STREET, IN THE CITY AIiD COUNTY OF CAPE
GIRARDEAU, MISSOURI
Mr. Purcell made a motion, seconded by Mr. Gateley, to approve the first reading of BILL IVO.
2000-55. Mr, Gateley stated that there are uncertainties about this request, but these could be
clarified by the next Council meeting. This permit will help to clean up the Spanish Street area.
Mr. Purcell stated that the Planning and Zoning Commission overwhelmingly approved this
application. There will be a fence built around it, and this will eliminate one junk yard on Spanish
Street. Mr. Neumeyer expressed concerns regarding this request. The areas on Spanish and
Maple Streets are being operated illegally Mr. Neumeyer said, and the cars could be removed if
the codes were enforced. He stated that this permit will not benefit the neighborhood. In 1993
Mr. Sample requested a special use permit for the operation on Maple Street. It was denied but
the activity continues. Following further discussion, the motion was approved upon the following
vote: Ayes, Gateley, Purcell, Spradling, Stoffregen. Nays, Neumeyer.
This being the date set for a public hearing regarding the request of Henry Maze and James
Reichert for a special use permit for a residential use at 769 Progress Street in an M-1, light
industrial district, the hearing was opened. The City Planner's Council Letter in the agenda packet
presented for the record a certified copy of the following items: (1) Section 30-39 entitled
"Special Use Regulations" from the City Code; (2) the Application for Special Use Permit; and
(3) the Application File. There being no appearances, the hearing was closed.
This being the date set for a public hearing to consider vacating the city's interest in a IS' wide
sewer, utility and drainage easement located on the north side of the existing USPS Area Mail
Processing Center, along the north line of lot 14 in Cape West Third Subdivision and the south line
of lot 1 in Cape West Eighth Subdivision, the hearing was opened. There being no appearances,

Center, the hearing was opened. There being no appearances, the hearing was closed. i
Mr. Don Howard appeared before the Council in opposition to the special use permit for Lester
Sample on Maple Street. This operation is a salvage yard, and the city is not enforcing the laws
regarding salvage yards. In addition, he stated that on the Minimum Property Maintenance Code
the 200' requirement needs to be eliminated to allow anyone to file a complaint on any property.
Mr. Purcell questioned if the 200' requirement is removed, would he drive around the city and file
complaints on properties. Mr. Howard indicated he would.
