Regular Session January 5 _ 1 g _ 98 REGULAR SESSION-JANUARY 5, 1998 Council convened in regular session on Monday, January 5, 1998, at 7:30 p.m. with Mayor Albert M. Spradling, III presiding and Council Members Richard Eggimann, Melvin Gateley, Melvin Kasten, Tom Neumeyer, and J.J. Williamson present. The invocation was presented by Melvin Gateley, and the Pledge of Allegiance was recited. The minutes of the December l5, 1997, regular session were approved upon Dr. Kasten's motion, Mr. Williamson's second, and the following vote: Ayes, Eggimann, Gateley, Kasten, Neumeyer, Spradling, Williamson. Nays, none. The agenda was adopted as distributed upon Mr. Gateley's motion, Mr. Neumeyer's second, and the following vote: Ayes, Eggimann, Gateley, Kasten, Neumeyer, Spradling, Williamson. Nays, none. This being the date set for a public hearing regarding the voluntary annexation of the Brown, Patterson, Eastman, McCulley and Horn tracts located in "Franks" Subdivision, adjoining and connecting to Limbaugh Lane and adjacent to the city limits to the northwest, the hearing was opened. There be►ng no appearances, the hearing was closed. i I Mr. Wayne Hughes appeared regarding B[LL NO. 98-4. He stated he would be willing to grant a sewer easement but requested the sewer be placed at a depth that would be usable to his property in the future. The staff has agreed to this, but he would like this in writing before granting the easement. He also stated that two staff inembers verbally indicated to him that the lateral sewer would be extended 60' towards his property, and this was also shown on the drawings. Mr. Gateley expressed concerns that this project is deviating from the original plans and from the discussion held at the November 3 City Council meeting. City Engineer Mark Lester stated that city staff has talked extensively with Mr. Hughes and told him that the lateral would not be extended 60' towards his property. The existing plans do not include 60' of lateral lines to serve the Hughes property. Mr. Lester presented to the Council documentation of the events concerning this sewer district. The letter dated December 23 states that the sewer will be at a depth of approximately four feet. This w►11 not disallow anyone from connecting to the sewer. The City can grade the sewer to make it usable to Mr. Hughes property. The project has been bid, but the city can issue an addendum. This will add to the construction time. City Manager Mike Miller stated that if Mr. Hughes will sign the easement immediately, the city will make the necessary adjustments. Mr. Dwayne Casey, owner of Peppy's Sports Bar, appeared regarding the liquor license for his establishment that was denied at the previous Council meeting. He stated in the past six months his employees had contacted the Police Department four times for assistance, and was surprised to hear that there were 22 incidents at the location. In addition, his employees did not attend the training offered by the Police Department because at the time he had fired his employees and no one was available to attend. State Liquor Control has indicated they would be willing to provide training. He requested the Council reconsider granting a liquor license, and he assured that he would do everything he could to make sure the establishment would run properly. Mayor Spradling responded that Mr. Casey would need to reapply for a liquor license before the Council can reconsider the issue. Ms. Debra Hughey appeared regarding a special use permit request at Lorberg Funeral Chapel on South West End Boulevard and questioned what type of business and sign would be at this location. City Attorney Eric Cunningham responded that the request had been withdrawn. 386 Proceedings of the City Council, City of Cape Girardeau, Mo.
