I SPECIAL SESSION- OCTOBER 13, 1997 ��

Council convened in special session on Monday, October 13, 1997, at 4:30 p.m. with Mayor Pro
Tempore Melvin Gateley presiding and Council Members Richard Eggimann, Melvin Kasten, Tom
Neumeyer, and J.J. Williamson present. Mayor Albert M. Spradling III was present. (

` Mayor Pro Tem Gateley called the meeting to order and stated the purpose of the meeting was to I�
consider a resolution regarding a water main extension to serve the new Notre Dame High School. !I
BILL NO. 97-243 was presented as follows:
A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE A DEVELOPMENT
AGREEMENT FOR CONSTRUCTION OF THE ROUTE K WATER MAIN EXTENSION IN f
CAPE GIRARDEAU, MISSOURI, WITH DRURY SOUTHWEST, INC. i
Mr. Williamson made a motion, seconded by Mr. Eggimann, to approve the reading of BILL NO.
97-243 and to adopt the resolution. Following questions by Mr. Eggimann, City Engineer Mark
,
Lester reviewed the time schedule for the project. City Attorney Eric Cunningham stated the �
proposed annexation will include approximately 138 acres not including Route K. Following
discussion, the motion was approved upon the following vote: Ayes, Eggimann, Gateley, Kasten,
Neumeyer, Williamson. Nays, none. BILL NO. 97-243 is RESOLUTION NO. 131 l.
Mr. Neumeyer made a motion, seconded by Mr. Eggimann, to enter into executive session for the
purpose of discussing property acquisition. The motion was approved upon the following vote: Ayes,
Eggimann, Gateley, Kasten, Neumeyer, Williamson. Nays, none.
There being no further business, the Council adjourned upon Mr. Neumeyer's motion, Mr.
Eggimann's second, and the following vote: Ayes, Eggimann, Gateley, Kasten, Neumeyer,
Williamson. Nays, none.

EXECUTIVE SESSION- OCTOBER 13, 1997
The following items were discussed in executive session on October 13, 1997:
Blattner/Erlbacher Pronertv: Bill Vaughn explained that the city needs to purchase an easement for
� the west side relief sewer project. The easement is located south of Bloomfield Road, east of Cape
� LaCroix Creek and north of the New Highway 74. The property is currently owned by Mr. Blattner
and Mr. Erlbacher. The City's appraisal of the easement was $2,500, and the commissioner's award
was$8,500. This matter is scheduled for jury trial on Monday, October 20. The City also needs to
purchase property for the recreation trail from Mr. Blattner and Mr. Erlbacher. The property has
appraised for$15,000. They have agreed to settle the issue on the trail project for the amount of the
appraisal conditional on the City settling the easement acquisition on the sewer for the commissioner's I
award. Following discussion, Mr. Williamson made a motion, seconded by Dr. Kasten, authorizing �
city staff to settle the easement acquisition on the west side relief sewer project for the amount of the
commissioner's award. The motion was approved upon the following vote: Ayes, Gateley, Kasten,
! Neumeyer, Williamson. Nays, Eggimann.
