REGUI.AR SESSION- FEBRUARY 3, 1997
Council convened in regular session on Monday, February 3, 1997, at 7:30 p.m. with Mayor AI
Spradling III presiding and Council Members Richard Eggimann, Melv►n Gateley, Melvin Kasten,
Tom Neumeyer, Jack Rickard, and J.J. Williamson present.

and the following vote: Ayes, Eggimann, Gateley, Kasten, Neumeyer, Rickard, Spradling,
Williamson. Nays, none. Mr. Marc Powers of the Southeast Missouriczn challenged the reasons for
entering into executive session. He stated he understood the Council was going to discuss the proposal
by TCI Cablevision to amend the existing cable franchise agreement, and the Sunshine Law does not
allow tlus type of discussion in closed session. City Attorney Eric Cunrungham responded that Section
3.13(b) of the City Charter provides for City Council executive sess►ons to discuss contract
negotiations, and the Sunshine Law itself allows for legal consultation between the City Council and
its attorney. In addition, Article 6 of the 1Vlissouri Constition authorizes the City of Cape Girardeau,
as a constitutional charter city, to enact such a charter provision. Mayor Spradling stated he
understood the request of Mr. Powers but respectfully derued him access to discussions on this mattere

IVeighborhood Development Grant under the Commuruty Development Block Grant Program, the
hearing was opened. Housing Assistance Coordinator Steve Williams explained that approximately
27 housing units were rehabilitated and approximately 1,700 lineal feet of 8" water main
improvements were completed under the Locust-Maple Neighborhood Restoration, Project#94-ND-
02. He outlined the targeted area, the funds available for the project, and the project costs. Mr.
Williamson questioned whether there would be grant money available for housing on the northeast side
of the city. Mr. Williams explained that in the 1980's, two grants were completed on the northeast
side of the city, and at that tme there were problems with getting enough people to participate in the
project. The City is still looking at this area. There being no further appearances, the hearing was
