Zoninq Items
1. Special Use Permit, southeast corner of Broadway and West End Boulevard, owned by
Southeast Missouri Hospital Association, Inc. to erect a sign, located in an R-4, Multi-Family
Residential District.
Southeast Missouri Hospital wants to install a three-sided, 10-foot-high monument
sign at the southeast corner of Broadway and West End Boulevard. The sign is part
of a beautification project at the intersection and will be landscaped following the
completion of the Broadway widening project.
2. Special Use Permit, 2731 Chrysler Avenue, owned by Joyce A. Tummins, for a one-chair
beauty shop located in an R-1, Single-Family Residential District.
Ms. Tummins wants to operate a one-chair beauty shop in the basement of her
residence. There will be a separate outside entrance for the basement shop. The
shop will be operated from 9:00 a.m to 9:00 p.m. and will be by appointment only.
On November 1, 2004, by Ordinance No. 3398, the Council amended the definition
of a Home Occupation. It is very possible that Ms. Tummins could operate her
business under the home occupations regulations, but she has chosen to go ahead
with a Special Use Permit request to assist in obtaining her State license. Attached
is a copy of the home occupation requirements.
Subdivisions
1. Dodd Place Subdivision, Record Plat. (Edward & Marilyn Dodd)
This is a two-lot subdivision located in the 600 block of Broadway. The property is
located is a C-3 district and is development with commercial structures. The
property needs to be separated in order to sell the structures individually. Utilities
are already in place at this location.
2. North Pointe Center Second Addition, Record Plat. (North Pointe Center, LLC)
This is a two-lot subdivision located in the 1700 block of North Kingshighway. The
property is located in a C-2 district, and will be developed commercially. The staff
has recommended that there be deed restrictions disallowing access onto North
Kingshighway. Utilities are already in place at this location.
 3. Arbor Heights Fifth Addition, Record Plat. (Stage Development, LLC)
This is a nineteen-lot subdivision located along the 1800 block of Autumn Drive.
This is the final phase of the Arbor Heights development. The property is located in
an R-1 district and is undeveloped at this time. The developers have requested a
variance to the building line widths for Lots 81 and 82. Improvements will need to be
installed or escrowed prior to the plat being forwarded to the City Council for
approval.
4. Steven Roberts Subdivision, Record Plat. (Roberts Communication Properties)
This is a two-lot subdivision located at 204 North Kingshighway. This was the
former location of the Sprint phone store, and a special use permit was previously
approved for a telecommunication tower at this location. The property is located in
an M-1 district and is currently developed with a commercial building and a tower.
The owners desire to sell the commercial building but maintain ownership of the
tower and equipment building, which will be located on Lot 2. Utilities are already in
place at this location.
5. Rigdon Commercial Subdivision, Record Plat. (Mark Rigdon)
This is a three-lot subdivision located in the 1800 block of Cape La Croix Road. The
property is located in a C-2 district and is developed with storage buildings. The
developer has requested a variance from the 25-foot rear setback requirements as
part of the subdivision plat approval. The variance request would put the rear lot line
on the west edge of the asphalt drive behind the buildings. The staff does not agree
with the rationale for the variance and feels the full 25 feet is needed in order to
allow the drive to be widened in the future. Utilities are in place at this location.
6. Jansco's First Subdivision, Record Plat. (Jansco Investments, Inc.)
This is a two-lot subdivision located in the 500 block of Asher Street. The property is
located in an M-1 district and both of the proposed lots are currently developed.
Utilities are already in place at this location.
7. Pat's Place Subdivision, Record Plat. (Patricia Bratton Trust)
This is a two-lot subdivision located on Village Drive. The property is located in an
R-4 district and the proposed lot 1 is developed with a residential structure. Utilities
are already in place at this location.

EXPLANATION OF HOME OCCUPATIONS IN
RESIDENTIAL ZONING DISTRICTS
Home occupations, also referred to as home-based businesses, are regulated in the City of Cape Girardeau
by our Zoning Ordinance. The provisions that allow home occupations in residential zoning districts are
cited, in full, below. If a business is located in a commercial or industrial zoning district, these
restrictions do not apply and the business would be regulated by the provisions of the district in which it is
located.
Zoning Ordinance Section 30-2. Definitions.
"Home Occupation"
Home Occupation means any activity, whether or not for financial gain, conducted in or directed from a
residential dwelling unit by one or more family members residing within that dwelling unit.
A permitted home occupation shall be an activity which is clearly incidental and secondary to the use of
the premises as a residence, not requiring a special use permit, provided that:
1. The activity employs no more than one (1) employee at any given time, other than family
members residing in the dwelling unit.
2. The number of vehicle trips generated by business customers, clients and vendors who visit the
residential dwelling unit does not exceed twelve (12) trips per day on a weekly average, occurring
only between the hours of 7:00 a.m. and 10:00 p.m., excluding trips referenced in subparagraph
(5)herein.
 3. Direct sale parties or gatherings (such as Tupperware) are limited to once a month and held only
between the hours of 9:00 a.m. and 10:00 p.m.
4. There is no outside appearance of a home occupation including, but not limited to, parking, signs
or lights.
5. The volume of deliveries or truck traffic is not in excess of two (2) per day on a weekly average,
excluding regular postal service and trips referenced in subparagraph (2) herein. Semi tractor-
trailer use for deliveries is not permitted.
6. The activity is conducted wholly within a main building or accessory building.
7. The activity uses no equipment or processes that create noise, vibration, glare, fumes, smoke, dust,
odors or electrical interference with radio or television reception, detectable by any neighbors.
8. The activity does not generate any solid waste or sewer discharge, in volume or type, which is not
normally associated with residential use in the neighborhood.
9. The activity does not involve any illegal activity.
10.The activity does not require the receipt, storage, or shipping of any hazardous materials in
quantities exceeding those allowable in the currently City Fire Code.
NOTE: A proposed business in a residential district that cannot meet the above restrictions may apply for
a Special Use Permit under procedures established in the Zoning Ordinance. Information on this process
can be obtained from the Planning Services Office in City Hall.
