Subdivisions
 1. Emerald Forest II Preliminary Plat: A re-subdivision of all of Giboney Woods Third and
all of Giboney Woods First Amended except Lot Numbers 6 and 7.
This is a 78-lot subdivision of what is currently a total of 33 lots. You may recall that t
his preliminary was presented to P&Z at its March 10, 2004 meeting. The owner of Lot 6 in
Giboney Woods First Amended was not agreeable to amending deed restrictions that would
allow the smaller lots and the Commission tabled the matter until these issues were resolved.
At the time of this writing, we have been informed that the developer has now reached an
agreement with that individual therefore no protest is expected. Review of the plat found that
a few corrections will be required which may not be completed by meeting time. If this is
the case and an approval recommendation is considered, such should be conditional. In
addition, the developer has requested variances that need to be considered.
2. Glenn Kinder Subdivision Record Plat.
This record plat was given conditional approval by the Commission at its February 12,
2003 meeting. However, corrections to satisfy the City's subdivision regulations were never
received. The plat was re-submitted in May of this year with two small parcels deeded to
adjoining property owners, in violation of City and State regulations. Mr. Howard Dillard,
Attorney is now representing the Kinder's in an effort to resolve the legal issues. A
/ recommendation for approval should again be conditional.

3. Meg Subdivision Record Plat.
This plat will create three lots on a single parcel located on the northwest corner of
Independence and Spanish and is zoned C-3 central business district. There exists a
commercial building on proposed Lot#3 and a dwelling on proposed Lot#2 with the two
structures having a party (fire) wall. Proposed Lot#1 is unimproved. There are some
corrections yet to be completed, therefore approval action should be conditional.
4. Merriwether Subdivision Record Plat.
This is a three-lot subdivision located on Good Hope Street between Sprigg Street and S.
Frederick Street in an area zoned C-3 central business district. Proposed Lots 1 and 3 are
improved with existing buildings. Lot#2 is unimproved. Requested corrections may not
have been received at meeting time so conditional approval should be considered.
5. New River Development Record Plat.
This is a three-lot re-subdivision of three existing lots located on the northeast corner of
Broadway and N. Main St. in a C-3 central business district. There are a few minor
corrections required and those may still be pending at the time of the meeting, so conditional
approval should be considered.

6. North Pointe Center Subdivision Preliminary Plat.
This is a four lot preliminary plat of a 15.26-acre tract located in the 1800 block of N.
Kingshighway zoned G2 general commercial district. This is the former Storey's property.
Most of this tract lies within the mapped floodplain and a part in the floodway, the limits of
which any change associated with the upcoming Letter of Map Revision will be
insignificant. This issue will be addressed as development occurs. There is a boundary
adjustment associated with this property, which is allowable, by Section 25-13 of the
subdivision regulations. A few minor corrections are pending which may require conditional
approval.
7. North Pointe Center First Addition Record Plat.
This is the next step in the development of a portion of number 6 above.
8. Rivendell Court Record Plat.
The City Council gave first reading approval of an ordinance for a special use permit to
Rivendell Properties, LLC at its October 4t" meeting. Second and third reading approval is
scheduled for the October 18`" meeting. The request is for a planned unit development for
professional retail and office space in an R-1 dwelling district. The record plat will re-
subdivide 61ots into 3 lots to fit the site plan that is a part of the special use permit. All staff
 concerns have been appropriately addressed.
Discussion Items.
1. Fountain Street, Phase II revised plans:
Smith and Company staff will be here to present this, with three roundabouts with
130-foot diameters and some other changes.
2. City Hall—Courthouse Connector:
Smith and Company staff will be here to present the preliminary plans for this project.
Be advised that I, Doug, Mark and Bill met with GSA, PCL,their architect, and a
contingent of Federal Court people, including Judge Blanton, on the plans for this on
September 28th. They are totally opposed to it, citing security, confusion, access, etc.
They have asked if they can be present at your meeting on the 13`h and they have been
invited.
 3. Proposed Sign Ordinance:
Beckie mailed the revised ordinance out to you under separate cover and she will be at
the meeting.

4. Staff Time:
The new Home-Occupation definition will be on for public hearing and first reading
at the October 18th council meeting. The Langston's special use permit for the day
care on Mt. Auburn will also be on far public hearing on the 1 gtn
In regard to Water and Main Streets, we received a survey addressed to you from
Deb Maevers, the owner of Pastimes Antiques on Main Street. She surveyed 24
businesses on Main Street regarding changing the street to two ways and moving the
clock. One agrees, 19 oppose, one was split and three did not care. A copy of the
survey is attached to this summary.
Back in June when the Council was considering the Home-Based-Business situation,
we prepared a report on special use permits issued over the last ten years. I do not
recall if I gave it to your or not, but thought you might find it of interest. A copy is
attached.
