NO VAN RIDE. NO VAN RIDE NO VAN RIDE Zoning Items 1. Special Use Permit: Terry Cole, et al.,monument business sign at 2907 Independence in a G 1 Local Commercial Zone. This is a sign for a new office building being constructed by C&D, Inc., on the south side of Independence, just east of Gregory Leet's building. 2. Special Use Permit: AJL Investments, monument business sign at 1417 North Mt. Auburn Road in a G 1 Local Commercial Zone. This is a sign for the Cape Family Practice building on the west side of North Mt. Auburn Road, between Beavercreek Drive and Kage Road. 3. Special Use Permit: Alan and Ruth Langston, to construct a new 2,400-square-foot childcare center at the northwest corner of Mt. Auburn and Old Hopper Road, in an R-1 zone. This is the application that the Commission considered at its September 8, 2004, meeting and that the Commission recommended be denied by the City Council. Ms. Veronica Langston, developer, appeared at the September 20, 2004, City Council meeting and requested a formal public hearing. At the public hearing before the Council on October 18, 2004, Ms. Langston stated that they had revised their plans and Mrs. Hunze had given them"permission"to use her driveway. In view of their revisions, the Council referred the application back to the Commission for further consideration. Also at the Council hearing, residents of the area submitted another unofficial petition against the project with additional signatures. In addition, Ms. Langston submitted two unofficial petitions with signatures supporting the project. However, her petitions incorrectly refer to rezoning of the property. Copies of all these petitions are included with the application. Prior to the City Council meeting on September 20t", the Police Department prepared a traffio-safety report for the City Manager regarding this proposal and concurred with the Commissions findings. A copy of this report is included in the application package. Attached to this summary, and included in the application, is a copy of the letter I sent to Ms. Langston requesting additional information. At the time this report was prepared, we had not received a revised site plan or any additional information regarding the project. Also attached to this summary is an aerial photo of the area that shows the Hunze driveway, which connects to New Hopper Road. }•a<e 1 ti ; Subdivisions 1. Land, LLC, has submitted a revised preliminary plat of the west"half' of the Ashland Court Subdivision. Attached to this summary is a copy of the preliminary plat for phases 2,3,4,5 and 6 that was approved by Council on 1-6-97. The revised plat moves Vantage Drive one block west, more or less, of the original alignment. The developers have coordinated this change with Bo Shantz, developer of Hunter's Lane Subdivision on the north side. By my count, the equivalent area is reduced from 91 lots to 85. The staff feels this change is reasonable. Included with the preliminary plat in the agenda packet is a location map showing the relationship of the revised preliminary plat to the area around it. At the time of this summary, corrections are still needed. 5. Ashland Court Third Addition, Record Plat: This is a record plat for the east 321ots on the above preliminary plat. It also includes, at this point, the re-subdivision of four of the original lots in Gibony Woods First Amended and Gibony Woods Third that accomplishes the transfer of additional property to the original Lot 6 of Giboney First(this is the record plat which is the next agenda item below). At the time of this summary, corrections are still needed. 8. Giboney Woods Fourth, Record Plat: This is the plat whereby additional property is transferred from Lot 5, Giboney First Amended and Lots 4 and 5 of Giboney Woods Third Subdivisions to Lot 6 of Giboney Woods First Amended.
