The proposed residential building would house patients of the Community Counseling Center moving from psychological treatment or institutionalization to independent living. Garen Miller, architect for the applicant, presented the request and Jay White and John Hudak of Community Counseling Center answered questions. A petition containing 26 signatures of area residents opposing the project was presented. In addition, Rick Hetzel, owner of the adjacent property, and Linda Shelton and Neil Kefauver, area residents, spoke in opposition. Rick Hetzel's property is single family and he was concerned that the proposed multi-unit building would bring down his property values. Linda Shelton and Neil Kefauver represented area residents and expressed concern with mentally ill patients wandering around and wondering if they would be on their medication or not. The applicant indicated that the residents must be capable of independent living to qualify for the housing and that they would be monitored and have an attendant present on site. Commissioner Swan stated that she didn't think the Commission had the authority or expertise regarding this use and that the job of the Commission was to look at the zoning. Commissioner Rhodes stated that the highest and best use of the property was not subsidized housing. The vote on the motion to approve the rezoning request was 5 in favar and 5 in opposition. As there was no majority, the motion failed. / 5. That the request of Jerry and Carol McGuire for a Special Use Permit to construct and operate a wedding chapel and banquet hall on an existing vacant lot in the 1900 block of North Sprigg Street, on the west side of the street, between Lexington Avenue and Bertling Street, within an R-2, Single-Family Residential District, be recommended for disapproval. Jerry McGuire, the applicant, presented the request. The principal factors considered by the Commission were an adverse impact on traffic and an adverse impact on the neighborhood of a commercial use in a residential district. Rex Gould and Darryl Morgan, property owners in the Forest Hills Subdivision across from the subject property, represented 13 property owners present opposed to the proposed project. In addition, an e- mail was received from another resident of Forest Hills Subdivision in opposition. The residents raised concerns regarding alcoholic beverages being served and/or consumed at the banquet hall, noise, lighting, and litter. The vote on the motion to approve the Special Use Permit was 0 in favar and 10 in opposition. 6. That the request of Drury Southwest Signs, Inc., for a Special Use Permit and Variance to construct a billboard at the northeast corner of I-55 and Highway 74, within a C-2, General Commercial District, be recommended for disapproval. The Variance request was for a 672- square-foot billboard where a maximum 300 square-foot billboard is allowed, and for a 55-foot height where 30 feet is the maximum /* height allowed. Jeff Bohnert of Drury Southwest Signs, Inc., presented the request. A letter was received from the Ruth A. Norman Revocable Living Trust, the adjacent property owner on the north, opposing the proposed billboard. The principal factor considered by the Commission was that Section 30-41 of the Code of Ordinances states that no billboard shall be placed within 1,400 feet of another billboard and the proposed billboard would be located within 1,400 feet of three existing billboards. The vote on the motion to approve the Special Use Permit was 0 in favor and 10 in opposition. 7. That the recard plat and variance for Kinder Place be recommended for disapproval. Mitch Kinder, the applicant, presented the request. No citizens appeared regarding the request. The vote on the motion to approve was 3 in favor and 7 in opposition. The principal factor considered by the Commission was that the proposed new lots would be approximately 67 feet wide where 80-foot wide lots are required. In its action, the Commission indicated that a two-lot subdivision of the property that met front footage requirements would be acceptable. 8. That the record plat and variance for Resubdivision of Lots 36 & 38 of Doctor's Park be recommended for approval. Nancy Browne, representing the applicant, presented the project. No citizens appeared regarding the request. The vote on the motion to approve was 10 in favor and 0 in opposition. 9. That the record plat and variance for Rock Creek Meadows Townhouses Phase N be recommended for approval. The vote on the motion to approve was 10 in favor and 0 in opposition. 10. That the record plat for Forest Hills Estates Fourth Addition be recommended for approval. David Reinheimer, the applicant, presented the project. The vote on the motion to approve was 10 in favor and 0 in opposition. 11. That the record plat for Former Public Works Subdivision — Phase 2 be recommended for approval. The vote on the motion to approve was 9 in favor, 0 in opposition, and 1 abstain. Commissioner Rhodes abstained. 12. That the record plat for Silver Springs Apartments be recommended for disapproval. The proposed record plat was associated with the rezoning request by Community Counseling Center above. The vote on the motion to approve was 0 in favor and 10 in opposition. The recommendation for disapproval of the subdivision record plat was based on the disapproval of the rezoning request. 13. Staff time.
