Mr. Shrimplin presented a proposed amendment to Section 30-105 of the Zoning Code (Chapter 30 of the City Code). He explained that staff recently became aware of a conflict in the code involving the definitions of "yard" and "front yard". Per the definition of "yard", a front yard is the minimum horizontal distance between the (front) lot line and the main building. For lots fronting on a public street, the front lot line is the right-of-way line. For lots with private streets, however, there is no right-of-way, and in many cases, the front lot line is the centerline of the street. The definition of "front yard" uses the minimum horizontal distance between the street line and the main building. Chapter 30 contains a definition of "street line" that includes an access easement over a private street. So using the definition of "front yard", if the street is private and in an access easement, then the front yard begins not at the centerline of the street, but at the easement line. The proposed amendment changes the definition of"yard" by deleting the sentence describing how to measure a front, rear, or side yard, leaving only the first sentence, to read: "Yard. An open space on the same lot with a building, unoccupied and unobstructed by any portion of a structure from the ground upward, except as otherwise provided herein." A motion was made by Mr. Glenn and seconded by Mr. Koetting to recommend approval of the proposed amendment to Section 30-105 of the Zoning Code. The motion passed with a vote of 8 in favor, 0 in opposition, and 0 abstaining. (Aye: Dowdy, Glenn, Greaser, Koetting, McClanahan, Skinner, Spooler, We/ch) Commission Communication Vice-Chairman McClanahan stated officer nominations will be accepted at the December 14, 2016 Planning & Zoning Commission meeting. Election of officers will be held at the January 11, 2017 meeting. Staff Communication Mr. Shrimplin stated the Habitat Community of Hope preliminary plat is being revised to eliminate the variances. Mr. Koehler explained that the plat is still being proposed as a cluster subdivision with smaller lot sizes, but the setbacks will meet the R-1 standards. Mr. Skinner asked if there have been any discussions about establishing a process for notifying the community about proposed developments like this. Mr. Shrimplin responded by stating staff has not had any such discussions, but the topic may come up when the City Council reviews the plat. Mr. Shrimplin informed the Commission that the City was selected to receive one hundred (100) hours of pro bono technical assistance from Benchmark Planning, which will be used for City of Cape Girardeau Planning &Zoning Commission Meeting Minutes November 9, 2016 Page 3 of 3 neighborhood planning activities for the Red Star neighborhood. Benchmark's consulting team conducted an initial visit in early October and has scheduled a follow-up meeting with City staff and the Red Star neighborhood leaders on December 5, 2016. He added that progress in the Red Star neighborhood has attracted interest from residents in the South Cape neighborhood. Mr. Shrimplin announced there was an open house held to solicit public input on the proposed Downtown Strategic Plan Update. He invited the Commissioners to contact Alex McElroy, Development Services Director, if they have any questions or comments about the update.
