Hearinqs on Rezoninq and Special Use Permit Applications
1. A request of Velosity Electronics and the City of Cape Girardeau for a Special Use
Permit for a telecommunication tower at the North County water tank property. The city
has a water tower on the property that is surrounded by County Park North. The city staff
is working with the tower provider to accommodate city equipment on the tower. Mark
Hasheider of the Cape Girardeau Fire Department informed the commission that there
would be communication equipment at the site including a communication building. He
also noted there would be shrubs around the communication equipment and that the
telecommunication tower would not take away from the feeling of the park. Mark
Hasheider also noted that there would be locations for 8 antennas on the tower and that
this would be a great benefit because of the height of the tower. Mark Hasheider also
commented that this area is not without towers and that people can already see other
towers. Eric from Velosity Electronics mentioned that the tower would provide wireless
broadband internet to the area. Eric said that Velosity Electronics needed a central
location with access to fiber optic internet in order to provide more and better internet to
customers. Eric said that this would be an ideal location for the tower in order to reach to
other towers. He added the tower would be a feeder tower to reach towers up to 8 miles
away from it. Trisha Mothershead asked about the county commission's support, Mark
said that they were not against the idea of it. Mark added that this tower would be a
microwave to the Jackson Police Department and to the Cape Girardeau Fire
Department. Mark said that this tower would provide for other access as well and then
Eric noted that two other cell phone companies could use it. Ralph Maxton asked about
moving the tower location further north. Mark mentioned that the "reach" was for the
entire county and so it needed a central location. Ralph Maxton asked if this would
cause us to eventually abandon the Gordonville Tower. Mark Hasheider said that the
Gordonville Tower would get much less usage if the County Park North Tower got
approved, but if the County Park Tower does not get approved, then eventually the
Gordonville Tower will need to be taken down and re-built to a larger height.
Votina on the Rezoninq and Special Use Permit Applications
2. A request of Velosity Electronics and The City of Cape Girardeau for a Special Use
Permit for a telecommunications tower at the North County water tank property. Harry
Rediger made a motion to recommend approval of the Special Use Permit, which was
seconded by Scott McClanahan. The motion was approved unanimously.
Subdivision Plats
3. Bouldercrest Estates Subdivision, Record Plat. Trisha Mothershead and Scott Rhodes
declared that they were abstaining from action on this item. Ms. Brown explained that
the applicant had made the corrections and submitted acceptable plats. Ralph Maxton
made a motion to recommend approval, which was seconded by Harry Rediger. The
motion was approved by a vote of 7 in favor, 0 in opposition, and 2 abstaining.
4. Windridge Properties II, Record Plat. Scott Rhodes declared that he was abstaining
from action on this item. Ms. Brown noted some of the concerns regarding this request.
Pam Davidson spoke regarding the subdivision. She said her engineer was supposed to
be at the meeting but did not show up. Charles Haubold asked about the previous two
buildings that were brought to Planning and Zoning and asked Pam Davidson to explain
water retention to protect the neighborhood next to the subdivision. Pam Davidson said
that they are still concerned about water to see what they can do on that site. She also
noted that there were curves around the lot to retain water so there is some water
retention on the site. Charles Haubold was concerned about the homes that have been
built since that could get water damage if the stormwater issue is not addressed. It was
also said that if the City of Cape Girardeau approves this subdivision, the developer
could face lawsuits when homeowners take legal action when their homes get flooded.
Pam Davidson noted that there would be underground tanks to solve the stormwater
problem. Charles Haubold asked if the city has this worked out. Ms. Brown mentioned
that she has not met with Kelly Green to resolve the storm water issue on the site and
there is nothing in the office that shows how this will be accomplished. Charles Haubold
asked about if this subdivision gets approved, what will be done to protect the
neighborhood against stormwater. Ms. Brown said that it could either be recommended
approval with conditions or table it for next month. Harry Rediger voiced his concern of
the property owners that spoke the last time and said that unless there was an approved
plan in front to resolve the stormwater issue, it would be wrong to have a conditional
approval. Charles Haubold said that the individuals need to see an approved plan. Ray
Buhs added that not everything is in writing to say this will be done. Charles also
mentioned that we owe it to the neighbors to let them see a final plan and that there is
no need for anyone to get into a lawsuit. His big concern was that the people in the
neighborhood next to this subdivision spent a lot of money on their homes and that they
do not need their homes to get flooded. Pam Davidson apologized that the engineer was
not at the meeting. Harry Rediger added that they are not opposing the subdivision, just
that they need more information and that it needs to be complete. Bill Hinckley said that
the people concerned who have to live with flooded backyards need to look at the overall
plans to be assured they will not get more flooding. Scott McClanahan agreed. Charles
Haubold said that this should be tabled until the neighborhood can see it. The motion to
table was made by Bill Hinckley, which was seconded by Ray Buhs. The motion to table
was approved by a vote of 8 in favor, 0 oppose, and 1 abstaining.
5. Staff Time. Sarah Wallace addressed the commission on the Dream initiative. She had
given each of the commission members a handout with maps and a memo containing a
strategic plan for the Dream initiative. She asked the commission to look at the handout.
Staff also commented on the zoning code and adding an agriculture district so that when
new annexations are made into the city, they would be annexed in as Agriculture
Districts and this would give the districts more flexibility instead of being annexed in as
R-1. Also talked about adding districts similar to R-1 and R-2 and an Estates Residential
District. It was also mentioned that these meetings are normally held on the Tuesday
before Planning and Zoning and that everyone is welcome to attend.
Charles noted that Trisha Mothershead is on the Comprehensive Plan Oversight
Committee which meets quarterly.
Harry Rediger commented on the meetings with stakeholders on the TTF4 projects and
wanted input from staff, council, and chamber. Also mentioned that there is a meeting
scheduled for January 6, 2009 to discuss this. It was suggested to meet at the Osage
Center at 5 p.m. depending on what is available. He added that it is a really important
 meeting.
Ken Eftink informed the Commission that the Historical Preservation Commission will be
reviewing design guidelines and an application for the Boulevard Local Historic District.
Sarah Wallace noted that this would be an overlay district so it would not affect the
zoning of the area. Charles Haubold was concerned that we could end up putting
something in effect that we may not want and asked if it might be better to wait a couple
months before moving along with any plans of this sort. Ken Eftink said that we could
deal with it on a case by case basis. It was said that items that would be a problem
would be kept off of the agenda. Sarah Wallace addressed zoning again saying it would
specify, mixed uses, and overlay districts. Charles said again that we don't need to do
something if we are going to change it in a month.
Ken Eftink also addressed the annexations by the airport of NAB Automation and
Midamerica Hotels Corp. He said that there has been a petition for annexation and that
they would come back for rezoning.
6. Bill Hinckley made a motion to adjourn which was seconded by Trae Bertrand and
approved unanimously.
