Appearances of Items not on the Aqenda
Charles and Debbie Devers of 1729 Luce Street addressed a concern that they have
with a pole barn being constructed in a residential zone not far from their residence.
They were concerned about their property values when a neighbor began constructing
an accessory building on his property at 1716 Themis, as this accessory building is
being constructed as a pole barn. Charles and Debbie Devers informed the commission
that the pole barn is bigger than the house itself and that every square inch of the yard
that could be built on, has now been built on. The Devers noted that they understand
that was not necessarily the intention of the zoning code to allow for something like that,
but at the same time, it does. They stated that at 1716 Themis, the owner of the pole
barn has said that he plans to put vinyl siding on the building to make it look more
attractive.
The Devers were also concerned that a 35 foot metal pole barn doesn't allow residential
neighborhoods to maintain the residential feeling, but currently the code allows for this.
The Devers suggested that the code be revised to only allow for a certain percentage of
lot coverage, height of accessory buildings, restrictions to drainage, and the ability of the
city to grant a building permit without considering the architectural or historical character
of the neighborhood.
Bill Hinckley noted that he drove out and looked at the sight and said that he was
amazed at what was going up. He told the Devers and the other residents of the
neighborhood that showed up to the meeting that their concerns were valid and their

suggestions were valid. Bill Hinckley encouraged the Devers to continue talking witf as
many people about their issue as they could because it raises important issues in how
the zoning code can be re-written. Chairman Hinckley thanked the Devers for coming to
speak on behalf of this issue and that he wished he could be more helpful.
Hearinqs on Rezonina and Special Use Permit Applications
1. A request of Kelli Seabaugh for a Special Use Permit to operate a sign design and retail
business and to install a sign on an existing sign post on the property located at 401
South West End Boulevard. Sarah Wallace mentioned that this location has recently
been approved for a Special Use Permit to operate a retail clothing business but since
then plans have changed. She also noted that this area is zoned R-2 (Single-Family
Residential) District. Planning Staff recommended approval upon the conditions that we
have attached in the commission's handout. Kelly Seabaugh and Steve Rector spoke on
behalf of this request. They said that they wanted to open a business to design signs
and to sell them.
Harry Rediger asked about the actual construction of the sign and the applicants noted
that there would be no actual construction of signs at this address.
Scott McClanahan asked about foot traffic and Steve Rector said that it would be very
limited.
The commission discussed signage with the applicant. The applicant stated that they
would like to install a 1 inch thick flat panel sign on the West End Boulevard side of the
building that would be 2 feet by 8 feet and then also a 2 foot by 4 foot sign on the pole so
that proper signage could be visible to people coming from all directions.
Bill Hinckley closed the public hearing on the request for a Special Use Permit to operate
a sign design and retail business at 401 South West End Boulevard.
Discussion and Votinq on the Rezoninq and Special Use Permit Applications
2. A request of Kelli Seabaugh for a Special Use Permit to operate a sign design and retail
business and to install a sign on an existing sign post on the property located at 401
South West End Boulevard. Harry Rediger mentioned that the signage should be limited
to what the current zoning code allows and it was pointed out that this would mean
removing condition number 5 from the conditions that staff recommended. Harry Rediger
made the motion to recommend approval with the first 4 conditions recommended by
staff. This was seconded by Trae Bertrand and was approved by a vote of 6 in favor, 0 in
opposition, and 0 abstaining.
Subdivision Plats
3. Walden Park Phase 2, Record Plat. Sarah Wallace stated that record plats had been
submitted for Phase 2 of Walden Park and there was a problem with how one of the
lines had been labeled but revised plats were submitted that were acceptable. Planning
Staff recommended approval with no conditions. Ralph Maxton made a motion to
recommend approval of the plat, seconded by Scott McClanahan. The motion was
approved by a vote of 6 in favor, 0 in opposition, and 0 abstaining.

submitted for Phase 3 of Walden Park and there were no issues or comments with the

with no conditions. Harry Rediger made the motion to recommend approval, seconded
by Scott McClanahan. The motion was approved by a vote of 6 in favor, 0 in opposition,
and 0 abstaining.
5. Crown Subdivision, Record Plat. Sarah Wallace stated that this is the joining of two
parcels on the Northeast corner of Frederick and Olive Streets, to enable the owners to
build across the current property line. Acceptable plats have been submitted and
therefore Planning Staff recommended approval with no conditions. Harry Rediger made
the motion to recommend approval, seconded by Trisha Mothershead. The motion was
approved by a vote of 6 in favor, 0 in opposition, and 0 abstaining.
Other Items and Communications
6. Staff Time. Sarah Wallace gave copies of the draft for residential zoning districts to the
commission and gave an update that we are at a point with a good first draft and we
need to schedule public participation sessions. As the process moves forward, additional
public participation meetings will be held. All information will be located on the city's
website for residents to review. She mentioned that the February meeting could be an
informational discussion to get the residents involved.
Sarah Wallace also handed out a draft of TTF 4 projects. Harry Rediger gave the
commission an update on those projects and explained the handout.
The Development Code Meeting was rescheduled for Wednesday, January 21, 2009 at
